At the time of foreclosure, the remaining loan balance was approximately {$100000.00}. After the foreclosure, the property was later sold for approximately {$150000.00}. Nearly 11 months after the foreclosure, I received a notice from 21st Mortgage Corporation claiming that I still owe a deficiency balance of approximately {$35000.00}. However, I have not received any documentation explaining how this amount was calculated, especially given the difference between the foreclosure balance and the resale price. 21st mortgage remained the lein holder of this property through auction and resale of property. I told him that I was going to pay for both this month and next month my next paycheck, which is next week. He then, decided it was okay to yell and lecture me. I told him I was not denying payment, that I had a few things going on. He said I was denying payment even though I told him I was paying for both months so that I am current on it. When I asked why he was lecturing me, he said " because it sounds like you need a lecture. The company has refused to communicate with me in writing despite repeated requests and is refusing to confirm receipt of a valid payment made via XXXX XXXX on XX/XX/year> and they normally apply the payment the same day, but they are refusing to confirm receipt of payment since I requested everything we do be done in writing I have proof of payment and multiple unanswered written communications. We have spoken to the company rep and their supervisor twice now and have not been able to come to a solution. We are 4 months behind on our mortgage. We had gotten two offers in the mail- the first one was that they would make a payment if we could make a payment. They said that offer expired. The second letter offered {$3000.00} to move out peacefully and clean the home. I discussed that with them today and they said we'd have to move out within 2 weeks. I offered to start making payments again but they said that wouldn't be enough because we'd still owe the last 4 months. I asked for a payment plan on the past due amount but they said they couldn't do that either. Our loan company 21st mortgage accepted a falsely classified appraisal ( as a manufactured home instead of a mobile home ) with incorrect sales price number, failed to identify a HUD # and labeling broken windows as good, we were not aware of the windows being in such poor condition until after we moved in in which the seller replaced the two windows that didn't lock at all which were the exact windows that the appraiser took a picture of and labeled as good condition, community office for our lot rent has a section stating that excess moisture is grounds for eviction how can we be on grounds for eviction for something that was there before we had possession of the property, which should have been caught by the community office inspection, or the appraiser and somebody should have notified us, which never happened. My mortgage company, 21st has unprofessional collection tactics and needs to stopped. They use threatening tactics, unprofessional, no empathy, and do not try to work with. My wife was out of work for three months no pay and the laughed at her and when I called, they laughed at me when ai advised I was a collection supervisor and was told your a supervisor and was laughed at. Then they threatened to take my home when I said I would make both payments, just needed information to access my 401K for a hardship loan, only to be told now that I was two pay periods past due. I was approved to pay the two weeks without their help, and they once again made only threats to take my homeXXXX XXXX complaints tell the same story. They won't release the title to us and still have our money as well. I was approved for the loan @ 5 % down but only for XXXX years and not the XXXX I wanted. When I asked why not XXXX years he said it was because of my age. I believe his name was XXXX. My wife had to have XXXX to which her short term XXXX payments were not made to her until after she went back to work. I had to take another job due to work slowing down for the winter and the cost of health benefits going up for her. I called the park in which we lived and the mortgage company which work hand in hand because there are only a few companies that handle manufactured home loans and only two that work with the manufactured home park in which we lived. Company not applying payments made for over a month, this company does not apply the payments in time then sends a letter of intent to foreclosure even though active payments are being made. I asked the company for proof of communication dates and times they claim to have been to my home, they then sent an email to me stating that no more calls or emails would be accepted on my account. Ive continued to make payments every two weeks so money is always going to my account. We got about 3 months behind on the mortgage payment due to slow work. I am an independent XXXX in the XXXX XXXX, so they sent out letters to get caught up. I was unable at the time, so they turned it over to the courts and had the police come to my house with the intent to foreclose. I then, the very next week, started to pay. I made 3 complete payments they refused to apply to my account. Please see all attachments. They sent partial payments back, so I sent them back and advised that it was not the correct amount so they sent the whole thing back. I sent it all back to 21st Mortgage. I was getting put on call and cancelled at my current XXXX job. I got a better paying job an hour away- my car engine blew up and I was unable to keep that job. They did not disclose after signing the contract it became a negotiable instrument. That they would then sale and keep all the proceeds from it which paid this off. There was not mutual obligation. There was not equal consideration. They did not put up any of their own money for this mortgage, so 21st did not put up anything of value.
