On XX/XX/XXXX, I called in to discuss the balance of my car loan because the loan had matured, but I still owed money. The rep, XXXX, told me to continue making my monthly payments, he would note my account, and I would receive a modificaiton agreement. I never received a modification agreement, but continued to pay on my account monthly as agreed. I called in XX/XX/XXXX, to ask about the balance and the rep told me that my account had been charged off and I would be subject to repossesion. I asked to make payment arrangements until the balance was paid in full, but they refused stating that since it was charged off, I couldn't make arrangements. I called in XX/XX/XXXX and talked to XXXX and XXXX and they both told me that a modification was emailed to me in early XXXX but they couldn't find the actual sent document or date that it was sent. I never received the modificaiton agreement and now I am at risk of having my car repossessed even though I am making monthly payments.

I made a {$4500.00} down payment on a vehicle priced around {$8700.00}, and the remaining balance was financed through XXXX XXXX XXXX at 27.99 % APR for 72 months. The financing included optional add-ons, including a {$2000.00} vehicle service contract. I cancelled the service contract on XX/XX/XXXX while it was still active and signed a cancellation request form. The contract term was 12 months, and it was cancelled after about one month, so a refund should have been issued to the lender. The lender has confirmed that no refund was ever received or applied to the loan. The dealership has now stated that the contract expired and no cancellation was processed. This failure to process the cancellation was not caused by me. As a result, I have been charged interest on a cancelled product and the loan balance remains inflated. After paying approximately {$9500.00}, the payoff is still about {$8300.00}.

As a result, I am requested a reasonable accommodation under disability-related communication needs. All communication regarding my account must be conducted in writing ( email or secure message ). I have made multiple attempts to resolve this matter in good faith, including submitting hardship documentation and contacting the bank through available channels. However, I have not received a written response. We believe the lender engaged in unfair and abusive lending practices that led to a recent repossession. Key Issues : Extreme Negative Equity : The consumer owes approximately {$22000.00} on a vehicle with a current market value of roughly $ XXXX {$13000.00}. This loan-to-value ratio is grossly disproportionate and suggests the loan was structured to be impossible to repay. Predatory Terms : The loan was originated in XXXX. Despite regular payments, the balance remains nearly {$10000.00} above the car 's value, indicating an unconscionable interest rate and likely hidden fees. Aggressive Repossession : The vehicle was repossessed after only 3 months of hardship due to job loss. The lender is now demanding {$3000.00} just to reinstate the loan, which would leave the consumer in a continued " debt trap '' for a vehicle worth half of the remaining balance.

On XX/XX/year>, I submitted six ACH payments totaling {$22000.00} to pay off my auto loan with American Credit Acceptance. My online loan portal immediately reflected a XXXX balance. On XX/XX/year>, my bank confirmed that all six payments cleared successfully and were withdrawn from my account. Later that same day, my XXXX loan portal suddenly showed all six payments as reversed, backdated to XX/XX/XXXX, and my account was marked past due. I contacted my bank, and they confirmed that the funds were fully settled, not pending, not returned, and not rejected. They also confirmed that ACH payments typically take up to three business days to post on the receiving institutions side, which would place full settlement no later than XX/XX/year>. I contacted American Credit Acceptance by phone. I was initially told to send a cashiers check because the payments did not go through.

I put down {$28000.00} on a 2018 XXXX XXXX XXXX. After doing some research I discovered that I couldve bought the vehicle for a cash amount instead of taking out a loan and making monthly payments. I was preyed upon and I was targeted. Targeted due to previous credit stipulations and so forth. They repossessed the truck after I couldnt afford the XXXX XXXX monthly payments. They all knew I wasnt capable of making such high payments and I expressed that to the dealership. I questioned them on numerous occasions about the payments being so high with such a substantial amount down payment. They kept talking about what my credit reflected. I feel like I was lured and taken advantage of. Im making a complaint and would like to be compensated.

I am filing this complaint regarding inaccurate credit reporting by American Credit Acceptance. The account being reported reflects a repossession XXXX charge-off, however there are several inconsistencies in the reporting that raise concerns about the accuracy of the information being furnished XXXX credit reporting agencies. The payment history on my credit report contains several months marked ND ( XXXX XXXX ) within the delinquency timeline while the account is reported as delinquent both before XXXX after those months. This creates an incomplete XXXX inconsistent payment history. Additionally, the account reflects a charge-off amount of {$22000.00} while also reporting a remaining balance of {$13000.00}. I have not received documentation verifying the repossession process, the sale of the vehicle, the sale price, or how the alleged deficiency balance was calculated.

I am filing this complaint regarding an auto loan with American Credit Acceptance related to a XXXX XXXX XXXX XXXX. The vehicle became subject to multiple safety recalls involving a high-voltage battery fire risk. XXXX issued warnings instructing owners not to charge the vehicle and not to park the vehicle in garages or near other vehicles due to the risk of fire or explosion. The recall notice also stated that a remedy was not available for an extended period of time. Because the manufacturer restricted normal use of the vehicle and failed to provide a timely repair, the vehicle could not be safely operated. I notified the lender that the vehicle had a dangerous unresolved safety recall and was under stop-sale conditions. Despite this, the account continues to be reported as delinquent and I have not received clear information about the status of the repossessed vehicle.

I am being charged {$3500.00} on top of my auto loan for a warranty that was never active due to a lack of payment from either American Credit Acceptance or XXXX XXXXXXXX XXXX XXXXXXXX. One day I decided to look into my warranty ( the one I am being charged for but never was active ) because my XXXX XXXX XXXX started to give me issues, only to find out I do not have an active warranty because American Credit Acceptance or XXXX XXXX XXXX XXXXXXXX did not send the {$3500.00} to XXXX XXXX XXXX. XXXX XXXX sent notice to American Credit Acceptance and XXXX XXXX XXXX XXXXXXXX but neither responded to resolve the issue. I tried to reach out to the dealership only to find out they closed down and filed for bankruptcy. I found the owners number in my phone though and asked him about the situation and all he can do is blame American Credit acceptance. He then said either way there was nothing he could do because he got rid of all the files from the dealership.

I also provided documentation showing the dealership held the vehicle for months under an improper mechanics XXXX, despite performing no repairs. The dealership responded acknowledging they were holding the vehicle and demanding payment. After the insurance payout, American Credit Acceptance ( ACA ) sent me a collection notice stating that I owe {$6300.00}. I purchased XXXX insurance specifically to prevent being personally responsible for a remaining loan balance after a total loss. XXXX XXXX confirmed in writing that : I do have a XXXX insurance policy. The dealership verified directly with the insurance provider that the policy is valid and in-force. Despite this confirmation, XXXX has continued to treat the balance as collectible. My attorney formally notified XXXX that the balance should be covered under XXXX coverage and that the debt is disputed. XXXX has not provided written confirmation that the XXXX claim has been processed, nor have they cancelled the balance. What do you want the company to do to fix the problem?

My vehicle was declared a total loss in California on or about XX/XX/XXXX. American Credit Acceptance LLC was notified shortly afterward, and they were aware that an insurance and GAP insurance payoff was pending to satisfy the loan balance. Despite being notified of the total loss and pending insurance payment, American Credit Acceptance LLC failed to process the payoff in a timely manner and did not act in good faith to resolve the account. Instead, they allowed the claim and payoff process to be prolonged unnecessarily. During this period, they continued to accept my monthly payments and applied those payments primarily to interest rather than reducing the principal balance. From approximately XX/XX/XXXX through XX/XX/XXXX, American Credit Acceptance LLC continued charging and accruing interest on the account while the insurance and GAP providers were working to resolve the total loss claim.

I have attempted to resolve this matter through standard channels, through my attorney, and through previous correspondence. Every attempt was met with hostility, runaround, and outright denial of my rights as a consumer who fulfilled his financial obligations. THE ORDEAL Let me be clear about what happened : I paid all monies requested by American Credit Acceptance to have my XXXX XXXX XXXX released to me. Despite this, I was denied possession of my vehicle. The road to retrieving my vehicle was filled with turbulence, tension, and frustration. It took XXXX full days of emotional calls to the American Credit Acceptance XXXX Department, multiple calls to the XXXX phone number, and several calls to the actual tow yard holding my vehicle.

I was late on my XXXX payment so today I called in to let them know that I could only pay a certain amount of that late payment. This is when they told me that I qualified for an extension. I was surprised to hear this because I had previously called in to ask for an extension or deferred payment so that I would not fall behind. XXXX in the month of XXXX, I had called to ask to make a deferred payment.I was told no. However today ( XX/XX/XXXX ) XXXX, the first customer service representative I spoke with, stated that I had to fall behind before the company could do an extension. I asked to speak with the XXXX department and I was transferred to a supervisor, XXXX XXXX, she fused to give any employee number but stated that this conversation would be notated in their records.
