I was told the financing was 0 % for 60 months and that if I made the monthly payments, the loan would be paid off in five years. I relied on those statements when agreeing to the purchase. I was not given a copy of the contract at the time of signing and only received one later after repeatedly requesting it from Aqua Finance. Dear Aqua Finance , Inc., Thank you for your response. However, your explanation raises several unresolved issues that require clarification and correction. You state that the account was charged off as a loss on XX/XX/year>, and that the unpaid balance was written off from your receivables. Under IRS regulations ( 26 C.F.R. 1.6050P-1 ), when a creditor discharges indebtedness of {$600.00} or more and treats it as a loss, the creditor is generally required to issue a Form 1099-C to the borrower. To date, no Form 1099-C has been received, nor have I been notified that one was filed with the IRS. If the debt was not discharged, then continuing to characterize the balance as a loss raises concerns regarding the accuracy and consistency of the reporting. The company received this notice, but did not respond. Despite this, the company continues to report the account to Experian as delinquent and continues collection activity. At loan inception, I explicitly instructed that any payments exceeding the required monthly amount be applied to principal. This complaint concerns inaccurate billing and servicing of a point-of-sale home improvement installment loan arranged by a contractor and assigned to Aqua Finance. The loan balance being serviced is incorrect and can not be reconciled to the contractors own records. The contractor issued an invoice dated XX/XX/year> stating Total paid {$53000.00}. This directly contradicts Aqua Finances position that {$53000.00} is still owed as principal. Aqua has never reconciled this invoice with the loan balance. Work was not complete when completion was certified.
