The caller stated they were attempting to deliver legal documents and instructed me to call XXXX with a case number. The call appeared to originate from XXXX. The voicemail implied that legal action or service of process was imminent. However : The caller did not identify a legitimate company, creditor, or law firm. No written notice of a debt has been provided. The message appeared designed to intimidate me into returning the call under threat of legal action. The company name XXXX XXXX XXXX does not appear to correspond to any legitimate or verifiable business.

I took out a loan for an emergency medical treatment and upon making my second payment the interest rate is 460 %! I already call up my bank because a scammer pretend to be my bank then yesterday tried to use my card. At first I didn't worry about it because it went through my voice mail but the notification I got about my bank account made me think that my other personal information was leaked.

This loan is abusive and predatory. Despite making payments, the principal balance is not reduced at all. I have revoked ACH authorization with my bank to stop further withdrawals. I am filing this complaint against XXXX ( XXXX / BlueChip Financial / related entities ) because I believe the loan and the way it has been serviced may involve murky or misleading legality, and I feel I was not given clear, fair, or transparent lending terms. 1 ) The APR and repayment structure feel intentionally predatory and deceptive The loans APR is extremely high, and the payment structure appears designed to keep borrowers paying for long periods while making it difficult to meaningfully reduce the balance. Even when making payments as scheduled, it felt like most of the payment went toward fees/interest instead of principal, which made the loan feel like a debt trap rather than a fair installment loan. 2 ) Confusing legal structure / tribal affiliation appears used to avoid consumer protections Spotloan appears to operate using a structure that implies tribal association or tribal lending protections.

I did not give consent for any of my loan or debt-related information to be disclosed to any third party. This disclosure was not made for the limited purpose of locating me, and the communication went beyond what is legally permitted. Sharing the existence of a debt and the amount owed with a third party is a violation of my privacy and, to my understanding, violates federal consumer protection and financial privacy laws, including but not limited to the Gramm-Leach-Bliley Act ( GLBA ) and applicable debt collection regulations.

The text disclosed the existence of the alleged debt, identified the sender as a debt collector, referenced an overdue account, and included a payment link. My mother is not a co-signer, joint obligor, or otherwise responsible for this debt, and I did not provide consent or authorization for third-party communications. This communication constitutes an unlawful third-party disclosure in violation of the Fair Debt Collection Practices Act ( 15 U.S.C. 1692c ( b ) ). I am requesting that the company be held accountable for this violation and that appropriate corrective action be taken.

I took out a {$500.00} loan from XXXX. Since then, XXXX has been automatically withdrawing {$100.00} from my bank account every time I get paid ( every two weeks ). This has been happening for the last 5 months. At this point I have paid approximately {$1000.00} total ( {$100.00} x about 10 payments ), which is double the original loan amount, yet the loan still does not appear to be paid off. The lender has not clearly explained how these payments are being applied ( principal vs. interest/fees ) or why the balance is not decreasing in a reasonable way. I believe this loan is predatory due to the extremely high cost relative to the {$500.00} borrowed and the repeated withdrawals tied to my pay periods. I am requesting that XXXX provide a full, itemized payment history and payoff amount, that any improper charges/fees be reversed, and that I receive a refund for any overpayment. I also want the automatic withdrawals stopped and the account brought to a fair resolution.

XXXX continues to send communications reflecting incorrect and inconsistent amounts owed despite a confirmed settlement agreement. Continued Use of Incorrect Balance After Settlement On XXXX XXXX XXXX XXXX and I agreed to settle the account for a total of {$200.00}, payable in three biweekly installments of {$67.00}. Despite this agreement, I continue to receive emails and account communications that reflect amounts different from, and higher than, the agreed settlement balance. Sending notices with incorrect balances after a settlement agreement is misleading, confusing, and improper. It creates uncertainty as to what amount is actually owed and raises concerns that XXXX may attempt to collect more than the agreed settlement. Failure to Accurately Update Account Records XXXX response does not explain why its systems have not been updated to reflect the settlement accurately, nor does it confirm that no additional interest, fees, or balance increases are being applied.

The lack of communication raises serious concerns about the companys transparency and willingness to address issues in good faith. What I Want the Company to Do : Provide a detailed written explanation of how the interest and fees were calculated. Reduce the APR to a lawful and reasonable rate. CFPB, I am filing a complaint regarding misleading and inconsistent information I received from Spotloan about my eligibility to apply for a new loan. Before submitting my application, I called XXXX and spoke with a relationship manager to confirm my eligibility. During the call, the representative told me that he had checked with his supervisor, and both confirmed that I was eligible to apply. At no point did the representative mention anything about my previous loan statusincluding the fact that XXXX had previously forgiven my balancebeing a barrier or affecting my eligibility in any way. Based on the managers statement and confirmation from his supervisor, I proceeded to submit my application. Immediately after submitting it, the system automatically denied me. This was completely inconsistent with the information I had just been given on the phone, and it left me shocked and confused.

This complaint concerns multiple high-cost loans I received from XXXX over time. The interest charged on each loan was extremely high and appears to be far above New Jerseys legal limit of approximately 30 % APR. Across several loans ( approximately 2-3 total ), the effective interest rate I paid exceeded 200 % -300 % per loan. A large portion of every payment went only toward interest. Despite paying significant amounts over time, the balances barely decreased because of the high-interest structure. When I questioned the legality of the interest rates and mentioned that I might need to file a complaint, XXXX closed my account and waived the remaining balance on the final loan instead of reviewing the large amount of interest I had already paid on all prior loans. This only happened after I raised concerns before that, I had already paid the full principal plus extremely high interest on the earlier loans.

CFPB, I am filing this complaint because I believe XXXX ( BlueChip Financial ) has engaged in retaliatory and unfair practices following my prior CFPB complaints. In its most recent CFPB response on XX/XX/year>, XXXX acknowledged that its own employees made mistakes while handling my loan and settlement. The company admitted : At the time you agreed to the settlement, the agent who assisted you did not take the proper actions in our loan system to have your payments automatically debited from your bank account on file. and also stated : During this telephone conversation, the agent who assisted you failed to mention the settlement of {$540.00} that was already in place on your account and offered you a new settlement of {$710.00}. Spotloan concluded : Due to the agent errors that occurred in XXXX and now in XXXX, we are willing to forgive the remaining balance on your loan and close your account. There is no need to make any further payments and we will stop contacting you.
