During the financial hardship caused by the COVID-19 pandemic, I contacted BMW Financial Services and entered into a payment arrangement in good faith. Despite this active arrangement, my vehicle was still repossessed. Following the repossession : My account was marked as a charge-off The account was transferred to recovery A deficiency balance of {$4100.00} is being reported I dispute this balance and the reporting for the following reasons : XXXX. XXXX occurred despite an active payment arrangement, which I complied with. 2. The {$4100.00} deficiency balance has not been properly validated. I have not received documentation showing how this amount was calculated. 3. This vehicle was a 36-month lease, not a loan, and all 36 payments were made in full. Furthermore, the contract was in the name of XXXX XXXX XXXX, yet the derogatory mark is being reported against my name ( XXXX XXXX ). No repossession ever occurred. Tax Reporting Error : I received an incorrect 1099-C for XXXX claiming {$13000.00} in discharged debt. Because the lease was paid in full and the contract was not in my name, there is no debt to be canceled. I am requesting that the company immediately delete the repossession from my credit reports and issue a corrected 1099-C to the IRS showing a {$0.00} discharge. ''

However, on XX/XX/XXXX, BMW Financial Services reversed this payment and reported it as a returned item, adding the amount back to my account along with a fee. After contacting BMW Financial Services, I was informed that this reversal resulted from an internal processing error involving a batch of checks that were inadvertently mailed back. I was explicitly told that this error was on BMWs end and not caused by me or my financial institution. Despite this acknowledgment, BMW Financial Services has failed to correct my account. My account is now being reported as past due, and I have received a past-due notice attempting to collect on an amount that is not owed.

I was also instructed to call after making that payment to arrange a promise-to-pay plan for the following month until my account became current. I relied on those instructions in good faith and believed my account was compliant with the timeline the BMW representative provided. BMW Financial Services attempted to call me during this period, but because I had been told I had until XX/XX/XXXX to make the next payment, I did not believe the account was at risk of repossession before that date. On XX/XX/XXXX BMW Financial Services repossessed my XXXX BMW XXXX XXXX, which occurred XXXX days before the payment date I had been instructed to follow.

I am submitting this complaint regarding a delinquent vehicle lease account reported by BMW Financial Services that is severely impacting my ability to obtain employment, housing, and financial stability. The vehicle associated with this lease has always been in the possession and control of my estranged spouse in the state of Hawaii. I reside in Florida and have not had possession or operational control of the vehicle since shortly after the lease originated in XX/XX/year>. My spouse has been responsible for making payments on the lease while retaining full possession of the vehicle. However, she has made inconsistent and partial payments which have resulted in repeated delinquency reporting on my credit file. This reporting is causing severe financial harm despite the fact that I have no control over the vehicle or the payments being made. After several attempts to have her or BMW Financial remove me from the lease I have been met with no answers or solutions.

Over the past year ( XXXX ), I have made multiple attempts to resolve this issue by contacting XXXX XXXX XXXX customer support by phone and attempting to access the online portal. Despite repeated attempts, I have not been able to obtain working access to my account or a clear explanation for why access is being denied. Because I was unable to monitor my account online, I was unaware that my bank had failed to send one of my automatic payments. As a result, my account became past due without my knowledge. I did not receive any direct phone calls or email notifications from XXXX XXXX XXXX regarding the missed payment.

At the time of signing, the dealer explicitly informed me that my first payment would be automatically covered as part of the lease transaction and that no payment was due from me. As this was my first lease in over 20 years, I relied on this guidance in good faith. As a direct result of the dealer 's erroneous instructions, I was unaware that a payment was due and incurred one late payment. Upon discovering the error, I immediately brought my account current and have made every payment on time since - a record spanning over two years. I have submitted two formal goodwill deletion requests in writing to BMW Financial Services asking that this single late payment be removed from my credit report given the circumstances. Both requests were denied.

Around XXXX XXXX that same day, I discovered the vehicle was missing and called XXXX. Police informed me the vehicle had been repossessed due to delinquency. On XX/XX/XXXX, I paid the past-due amount in full and took an XXXX to the storage/location BMW XXXX provided to retrieve the vehicle. When I first saw the vehicle at the lot, I clearly observed a large inward dent/damage on the passenger-side door frame/body area ( the damage was obvious and was present at the time I picked up the vehicle ). I reported the damage to BMW XXXX immediately.

I am filing a complaint against BMW Financial Services regarding their refusal to refund an insurance overpayment related to my leased vehicle that was declared a total loss. My leased BMW vehicle was recently totaled in an accident. My auto insurance company issued a payment directly to BMW Financial Services to satisfy the lease payoff balance. The insurance payment exceeded the total payoff amount owed on the lease. The confirmed overpayment amount is approximately {$5600.00}. BMW Financial Services has acknowledged receipt of the insurance funds and the existence of the overpayment. However, they have refused to issue a refund to me and instead stated that the funds can only be applied toward leasing or purchasing another BMW vehicle. Additionally, I currently have another active BMW account. I requested that the overpayment be credited toward my existing BMW Financial Services account, but they also refused to apply the funds to that account.

I am disputing lease-end charges assessed by BMW Financial Services on a 36-month vehicle lease that ended on XX/XX/year>. The vehicle was returned on XX/XX/year> with XXXX miles, well below the XXXX allowance. BMW assessed excess wear charges, including {$900.00} for three tire replacements and {$600.00} for a windshield crack. I disputed these charges in writing. After review, BMW acknowledged inspection issues and waived the windshield charge. However, BMW continues to insist the tire charges are valid based solely on a tread-depth threshold, without addressing whether the condition of the tires is reasonable or consistent with expected durability given the vehicles exceptionally low mileage. I am not disputing that the tires may have met BMWs stated tread-depth threshold at return. Rather, I am disputing the attribution of responsibility for early tire wear to the consumer when the vehicle was used lightly and within normal driving conditions.

It appears payment has not posted as of today, XX/XX/XXXX. The payment may have gone to incorrect account number, I believe I copy and pasted account number when bill pay set up prior to payment. Please note, this payment is intended to cover month of XXXX, a manual payment posted to account today, XX/XX/XXXX, the amount of {$1000.00} which i attempted to cancel as I had already made previously mentioned bill payment. Unfortunately, the payment dated XX/XX/XXXX did not show as pending or anywhere on XXXX website, no ability or option to cancel. In XXXX, my vehicle was repossessed by or on behalf of BMW Financial Services without lawful notice and without compliance with UCC Article 9 requirements. I was never provided with proper pre-repossession or post-repossession notices as required under UCC 9-611, 9-614, and 9-616. At the time of the repossession, the vehicle contained numerous personal belongings, including high-value luxury items, electronic devices, medical and legal documents, disability-related equipment, and items of significant sentimental value. None of these items were inventoried, safeguarded, or returned to me. Since XXXX, I have repeatedly requested written documentation explaining : the legal basis for the repossession, the towing authorization, the towing company and impound location, the chain of custody of the vehicle, the disposition or sale of the vehicle, and the loss of my personal property. BMW Financial Services has failed to provide this information.

At the time of the tow, I was inside the hospital attending a scheduled XXXX XXXX appointment with my girlfriend, who was XXXX XXXX XXXX. I was not present at the vehicle when it was taken. The repossession was conducted from hospital visitor parking during active medical care. Under Florida Statutes 679.609, a secured creditor may repossess collateral without judicial process only if it can be done without breach of the peace. The legality of this repossession is disputed. At the time of the repossession, the vehicle contained non-collateral personal property, including a wallet, Florida drivers license, debit card, and credit cards. I did not have immediate access to retrieve these items following the tow.

Although BMW Financial Services submitted the payment, it did not clear due to a temporary shortage in my bank account. Despite this, I received a text message from BMW stating that the final payment had been made and that my title was being processed. When I reviewed my bank account and saw that the payment had not cleared, I immediately contacted BMW Financial Services to notify them of the issue. The representative I spoke with stated that BMWs system showed the account as paid in full. I explained clearly that the payment had not gone through on my end and that I would ensure the payment was made. As stated, I resubmitted the payment the next day, and the funds were successfully withdrawn on XX/XX/year>. After the payment cleared, BMW Financial Services began contacting me again demanding payment for the same amount.

I am requesting assistance from the Consumer Financial Protection Bureau regarding serious misconduct by BMW of XXXX in connection with a motor vehicle lease agreement I signed on XX/XX/year>. The contract includes a clear financing contingency stating that the lease is subject to assignee approval within ten days of execution, and that if approval is not obtained within that period, the lease is void and the vehicle must be returned on demand. This ten-day requirement is a mandatory condition precedent, meaning no contract can form unless approval is obtained by XX/XX/year>. I requested a change of due date to BMW XXXX towards the end of my loan term. I had never been late on any prior payments and in facts paid for months in advance. I paid my final payment on the loan according to what I thought was the new payment due date. They marked it initially 60 days late, then changed it to 30 days on my credit reports. I sent them disputes through the credit bureaus as well as directly through the mail. They stated they can't seem to find any request made on my behalf even though it shows I have logged into their system on multiple occasions. I initially submitted a dispute back in XX/XX/2025 which was approved through TransUnion. I subsequently followed up in XX/XX/2025 with a letter to BMW requesting to change the inaccurate information. And once again in XX/XX/2025.

I have repeatedly requested validation, including a signed contract bearing my wet signature, itemized statement, proof of assignment, and verification procedures, but have received no such evidence.

BMW Financial services provided me false information regarding their credit reporting rules. They indicated that they did not report late payments until accounts are 60 days late. The call was recorded and they have record of this on my file. Ive attempted to fix this directly with them 3 times with no luck or update. I want this fixed and updated. They tanked my credit XXXX points over misinformation provided by their own reps. This is abuse of power and a violation of the FCRA and consumer protection laws. The notice listed {$2700.00} as Total Installments Past Due, and did not include the XX/XX/XXXX installment or any future payments. The notice also said the amount may change only for expenses incurred, but did not mention adding future monthly installments. Despite that written notice, the company verbally stated that the reinstatement amount would increase to {$4300.00} if not paid by XX/XX/XXXX. They were closed for the XXXX holiday from XXXX. I was told verbally on XX/XX/XXXX that due to the closure, I would need to pay by XX/XX/XXXX to avoid the higher amount, which conflicts with the written deadline of XX/XX/XXXX. Under Pennsylvania law, because XX/XX/XXXX falls on a Saturday and the company was closed for the holiday, payment should roll to the next business day ( XXXX ).
