I am a veteran applying for a VA home loan through New American Funding ( NAF ), and I am filing this complaint due to significant delays, repeated requests for previously submitted documentation, and unprofessional conduct that resulted in me missing my scheduled closing date. I went under contract on XX/XX/year>, with an original closing date of XX/XX/year>. XXXX represented that my loan could close within approximately XXXX days. However, I did not receive the full list of underwriting document requirements until XX/XX/XXXX, more than XXXX weeks after going under contract. I submitted all requested documentation the same day. Despite my prompt compliance, I was repeatedly asked to resubmit documents that had already been provided, often without clear explanation. Communication throughout the process was inconsistent, disorganized, and lacked accountability. On XX/XX/XXXX, just XXXX days before my scheduled closing, I was informed that I would miss the XX/XX/XXXX closing date.

I am filing a complaint against my mortgage servicer, New American Funding, and their vendor, XXXX. While my home was occupied, XXXX and/or their subcontractors repeatedly accessed my property without permission. They initially changed my locks and removed my personal belongings, including food and furniture, leaving me locked out of my home. After this, I was later provided with a code to regain access. However, XXXX continued to treat the property as vacant. They repeatedly accessed the home without my authorization, including providing lockbox access codes to third parties. Even after I removed the key from the lockbox, they still gained entry by breaking a window to access the home. At no point was the property abandoned. I was actively occupying the home, and these actions were unauthorized and caused significant disruption, damage, and loss of personal property. In addition to removing my belongings and damaging the property, their actions also caused plumbing damage.

I have been trying to do a short sale since XXXX ( it is now XXXX ), and I was given false information on how to apply for a short sale multiple times during the process. I was then not told that I didn't meet the qualifications at that time until several months later, after doing an appraisal of the property on XX/XX/XXXX. A pipe ended up bursting due to use vacating the property in order to sale the property, so there was severe water damage. I then was told I was eligible again for a short sale and that they were planning to do an appraisal of the property. However the XXXX never got back to my realtor or myself to get the access code. They claim that on XX/XX/XXXX they attempted to do an appraisal at my property, however they had no access to the inside of the home. They then told me that there was no appraisal done yet a few days later.

New American Funding required a cosigner on my loan. A distant relative, a deaf senior, agreed to cosign -- mainly because he was assured by XXXX XXXX, the loan officer in XXXX XXXX, XXXX -- that he could be removed from the loan in XXXX months. The title company assured him there was no risk to signing. Escrow closed on XX/XX/year>. It has been a year and a half. I inquired about refinancing twice, both times the answer was no. I asked if my son could be on the loan. Without checking his income or credit, XXXX XXXX said no. My payment history is perfect. I am the only one making payments. My son and I are the sole occupants of the house. The cosigner does not want to sign for any new loans or grants to make repairs. The septic system has failed, which affects health and safety and I can not fix it without removing him from the loan. I applied for a refinance with New American Funding on XX/XX/XXXX. From the beginning of the process, I had difficulty getting any meaningful response regarding my refinance application. Before the appraisal was even completed, I repeatedly had to chase the lender for updates and answers. The email record shows that I initiated at least ten separate follow-ups between XX/XX/XXXX and XX/XX/XXXX just to obtain responses or status updates regarding my refinance application. These included follow-up emails on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. On XX/XX/XXXX, I specifically documented that I called at a scheduled time, no one answered, and I left another voicemail. On XX/XX/XXXX, I documented that I had asked about refinancing about a week earlier and still had not heard back. On XX/XX/XXXX, I documented that I had not received an update in about three weeks.

Servicers are required to provide payoff statements under RESPA ( 12 U.S.C. 2605 ). On XX/XX/XXXX, a RESPA Request for Information and Notice of Error was mailed via Certified Mail. Servicer acknowledged receipt by phone on XX/XX/XXXX but failed to respond in writing within required timeframes. Borrower submitted a complete loss-mitigation application on XX/XX/XXXX via Certified Mail with Return Receipt. Servicer continued foreclosure proceedings without issuing a written loss-mitigation decision, in violation of 12 C.F.R. 1024.41. A week later I got the estimate and I didn't agree. I already checked on a house to sit on my foundation for a {$16000.00} which was cheaper than his estimate of {$220000.00} he still denied. I am writing to dispute the unauthorizedXX/XX/XXXX force-placed insurance charge and the subsequent interference with my mortgage payoff. XXXX. Fraudulent Completion and Builder Abandonment Our builder, XXXX XXXX, prematurely obtained a Certificate of Occupancy from XXXX XXXX and fraudulently informed XXXX that construction was complete. Despite the home being unfinished and the builder explicitly stating to both XXXX and us that he was refusing to honor any warranty and walking away, XXXX proceeded to disburse the final payment. Per VA guidelines, lenders have a responsibility to ensure builders are licensed, insured, and provide a XX/XX/XXXX-year builders warranty. Later in the process, NAF suddenly reversed this decision and stated they would no longer accept my bonus income, even though it is documented and taxable. New American Funding ( NAF ) is unreasonably withholding insurance proceeds paid to repair my Florida home following Hurricane XXXX on XX/XX/XXXX, creating a deadlock that prevents repairs from starting and exposes the property to continued deterioration. NAF received {$84000.00} on XX/XX/XXXX in insurance proceeds for covered hurricane damage. Despite full documentation of the scope and cost of repairs, NAF has released only {$33000.00} and continues to withhold the remaining funds. Total repair costs, as documented by a licensed contractor, are approximately {$300000.00}. The contractor requires {$89000.00} upfront to mobilize and begin work, which is standard for disaster-related reconstruction. Because NAF has released only a partial amount of the insurance proceeds, the contractor can not begin work. As a result, there is no construction progress to inspect.

The property fails VA Minimum Property Requirements due to a non-functional heating system and 5 defects, and the lender has advised that the loan can not close through no fault of the buyer. Despite this, the seller 's attorney has threatened to retain the deposit, and the lender has not issued a clear written statement confirming no buyer fault or addressing earnest money release. I am submitting this complaint regarding New American Fundings servicing of our mortgage loan ( Loan No. XXXX ), specifically their handling of escrow, property taxes, supplemental tax bills, and related payment increases. Our monthly mortgage payment increased from approximately {$8000.00} to {$11000.00} despite the only identified increase being approximately {$20000.00} in supplemental property tax bills, which we provided to New American Funding and were told would be spread over 24 months. The resulting payment increase far exceeds what such an amount would mathematically justify. New American Funding issued us an escrow refund of approximately {$21000.00} in XXXX, which we questioned at the time. We were told the refund was required and correct. Less than a year later, we were informed that our escrow account was severely negative and that New American Funding had advanced tens of thousands of dollars without notifying us.

I have requested multiple times to be removed and not receive any further notification from them on this offering. After many calls I went through the qualification process and declined the offered coverage due to health reasons and cost. I have an FHA-insured mortgage on a property in Florida that was severely damaged by a hurricane. Due to the extent of the damage, the home was uninhabitable, and the insurance carrier was sued. The insurance litigation took approximately one year to resolve. During this time, mortgage payments were not made solely because of the hurricane damage and the pending insurance claim, which constitutes a declared disaster-related hardship under FHA servicing guidelines. The insurance carrier has now paid nearly the full amount of the past-due mortgage balance. However, my mortgage servicer is currently holding the insurance proceeds in a suspense or restricted account and has not applied the funds to the loan. As a result of the servicers failure to apply the insurance proceeds, my account continues to reflect an artificial delinquency even though funds sufficient to cure the default exist and I am now able and willing to resume regular monthly payments.

Went through the process to buy and place a manufactured home on land I already owned. I started the process with New American Funding. Initially the process went well, though there were frequent delays in processing. XXXX was slow to disburse funds to the appropriate parties. The largest issue came from acquiring homeowners insurance. My mortgage officer ( XXXX XXXX ) suggested XXXX XXXX XXXX. I opted to have my property taxes and insurance paid through my escrow account to save myself the effort. Once the home was placed, completed, and insured, we moved into our home. This is when the problems began. XXXX, for reasons that they refused to elaborate on, was not disbursing the last of the funds to the titling company. For over a year, they would not release the last of the project funds so my home could be titled. Several contact attempts were made but I was stone-walled. Then XXXX XXXXXXXX XXXX called me to inform me that they hadnt been paid at all during the entire process.

I contacted the property-preservation vendor immediately after receiving their notice and clearly informed them that the home was not abandoned, that a prior sale had fallen through, utilities were being restored, and I was actively maintaining the property. The vendor acknowledged this and stated they would remove the property from their list. I then brought the mortgage fully current, and New American Funding confirmed that the account was in good standing and that no further property-preservation activity would occur. Despite that, the vendor entered the property without notice or authorization after the mortgage was current and after I had confirmed that the home was occupied and maintained. During this unauthorized entry in XXXX, the vendor improperly attempted winterization.

At the time of refinancing, I was approximately XXXX years into the loan and did not have mortgage insurance. The purpose of the refinance was to obtain {$40000.00} in cash-out, and I had approximately {$90000.00} in total equity prior to the transaction. I signed an FHA Note, FHA Amendatory Clause, and Closing Disclosure clearly showing Loan Type : FHA, FHA Case Number XXXX, and all FHA-required documents. I did not refinance my loan, I did not pay off the loan, and I did not sign any documents converting my FHA mortgage to a conventional mortgage. However, after the loan was transferred from New American Funding XXXX XXXX XXXX XXXX XXXX, the companies involved illegally changed the loan type from FHA to Conventional without my knowledge or consent. HUD has now confirmed to me in writing that : My FHA Case Number was canceled on XX/XX/XXXX at the request of New American Funding, Even though the loan had already closed as FHA, And FHA insurance had already been applied to the loan.

We co-own a property with our daughter, and the mortgage is serviced by New American Funding ( NAF ). All three of us are on the loan and title. Across more than XXXX decades of homeownership and business ownership, we have never had a single late mortgage payment reported. In XXXX, our daughter logged into the NAF portal and submitted her monthly payment as she has always done. For reasons still unexplained, the payment did not post. At no point did NAF provide any notification of a missed or unprocessed payment no phone calls, no emails, and no mailed notices. Had we received even XXXX notice, the issue would have been corrected immediately. Despite the complete lack of communication, NAF reported the account as 30 days late to all credit bureaus without warning. This has caused immediate and measurable harm. We operate multiple businesses that depend on flawless credit, and this single erroneous report has already affected our credit standing.

I called XXXX during their business hours but was met with a message stating they were closed and a restatement of the business hours during which they obviously werent open. My issue are XXXX. I dont owe any mortgage for XX/XX/year>. XXXX needs to make aure all monies paid are transferred properly to new mortgage company and balances updated accordingly. XXXX. My escrow amount varies drastically from New American Funding to XXXX ( that also needs to be resolved ). New American Funding needs to stop post dating letters they send in the mail.
