I am writing to the Consumer Financial Protection Bureau ( the 'Bureau XXXX ) to formally escalate and supplement my prior complaints against BSI Financial XXXX XXXX XXXX Mortgage XXXX XXXX and XXXX XXXX XXXX XXXX collectively, 'Respondents ' ). My autopay was deleted through a system error or fraud on your end. I received no notice that the autopayment was deleted, nor did I receive any notification that the payment became late via email or physical letter. I only discovered this issue when I received an alert to my credit report on approximately XX/XX/year>2026. Immediately upon logging in and seeing the autopay had been removed without my authorization, I paid the full amount plus the following months payment ( {$3500.00} ) on XX/XX/scrub>, 2026. BSI claims that I manually deleted this autopayment. I have reported to BSI that this is either fraud or a catastrophic system error, as I did not delete it. To date, BSI has refused to provide relevant logs or documentation to support their claim. This error has resulted in a XXXXday delinquency being reported to my credit bureaus, causing a drop of approximately XXXX points to my credit score.

The servicer failed to respond within 30 business days and did not provide a valid extension. When they eventually responded, the response was incomplete. They failed to provide key documents, including tax bills, full escrow records, servicing notes, and proof of mailing. The records provided show irregular escrow payments that do not match expected tax amounts, raising concerns that funds may have been misapplied. The servicer also issued and reissued a refund check with inconsistent explanations, further indicating account errors. As a result, inaccurate late payment reporting occurred, which has negatively impacted my credit and ability to obtain financing.

On XX/XX/XXXX, the buyers title company sent a cashiers check via XXXX to my mortgage servicer, BSI, to pay off my loan at closing. I have XXXX tracking confirming delivery, and BSI later confirmed by email that the check was received. BSI later informed me that the payoff check had been routed to the wrong department internally. Because the payment was not processed in time, an automatic debit of {$4600.00} was executed from my account on XX/XX/XXXX. On that same day, XX/XX/XXXX, a three-way call took place between myself, BSI, and the buyers title company. The issue was corrected immediately, the buyers tittle company was charged and the account showed paid in full on the BSI portal that same day. I requested an immediate reversal of the {$4600.00} draft. Despite the account being acknowledged as paid on XX/XX/XXXX, BSI retained my {$4600.00} for XXXX additional days, issuing the refund only on XX/XX/XXXX. BSI stated that this delay was due to internal procedure.

My mortgage company " XXXX '' uses a loan servicing company called " BSI Financial Services '' that purposely uses inaccurate information on their loan servicing portal so that you miss your payment and have to pay a large 10 % of the mortgage fee. Here is their website- XXXX XXXX XXXXXXXX They purposely show that a payment of {$0.00} is due all the way up until exactly the 1st of the month. Then list the amount owed on the 1st of the month and charge you a late fee if it's not submitted by the 5th or often the 3rd of the month if the 5th falls on a weekend. Many times, even when I check how much my payment is on the 1st it will say {$0.00} and not allow me to make a payment. I have had to submit my monthly payment as a " principal '' payment to force my payment into the system. They do this because they want you to miss your payment. Even when I'm enrolled in auto-pay the portal does not accurately show that I have a payment scheduled within the deadline.

I am filing this complaint regarding a serious mortgage servicing error involving escrow misapplication and duplicate tax collection. Between XXXX and XXXX, I made all required monthly mortgage payments, including escrow payments designated for XXXX XXXX property taxes. During those years, my loan was serviced by BSI Financial Services. Despite my payments, XXXX XXXX marked my property taxes as unpaid and initiated proceedings that placed my property at risk of tax sale. I later learned that XXXX had paid property taxes to the wrong parcel number for XXXX consecutive years. After my mortgage servicing transferred to XXXX XXXX, they paid {$38000.00} in back taxes, penalties, and interest to prevent further action by the county. However, XXXX XXXX did not credit my escrow account for the funds previously collected and disbursed during XXXX. The servicer has failed to provide the legally required Transfer of Servicing Notice ( " Hello/Goodbye Letter '' ) required under 12 C.F.R. 1024.33. I originally requested discontinuing PMI on my home loan in XXXX of XXXX. My mortgage company, BSI financial services, has this letter on file. I was told that PMI could not be discontinued until reaching 80 % loan to value. I called numerous times in XXXX of XXXX to verify that I had passed this threshold and that I wanted to discontinue PMI. Agents informed me I had reached 79.6 % amortization and assured me that PMI would be dropped. I received an Escrow disclosure form last month, XX/XX/XXXX, showing PMI was never dropped and that it was still scheduled to continue into XXXX of this year. I called and asked BSI why this happened and they said they had never received a letter from me to discontinue PMI. When I asked about the letter they had on file, they claimed that it could not be used and I needed to submit a new letter.

In response, the credit reporting agencies stated that BSI Financial XXXX verified the late payments and also acknowledged that certain account fields were updated. The acknowledgment that account fields were modified indicates that the original reporting was inaccurate or incomplete. Despite this, the late payments for the disputed months continue to be reported without BSI Financial XXXX providing billing statements, payment posting records, or documentation showing how delinquency was calculated for those months. I requested documentation to support the reporting of these late payments, including due dates, payment receipt dates, and records relied upon during bureau investigations.

I am filing this complaint against BSI Financial Services for failing to acknowledge a Loss Mitigation Application. My household suffered a significant financial hardship starting in XX/XX/XXXX when I ( XXXX XXXX XXXX lost my job. I remained unemployed until XX/XX/XXXX. This hardship is now fully resolved as I am back to full-time employment. On XX/XX/XXXX, we submitted a complete Loss Mitigation Application ( Workout Package ) to BSI Financial 's Default Resolution Team. Per 12 CFR 1024.41, BSI was required to acknowledge receipt of this package within XXXX business days and provide a status update. BSI has failed to do so. We have attempted to contact the Default Resolution Team by phone multiple times, but we are repeatedly placed on hold for extended periods and then disconnected. We ( my wife and I ) are unable to reach a Single Point of Contact. The point of contact we were provided, XXXX XXXX, does not have a direct line, and the number provided is to the call center.

My homeowners insurance carrier issued multiple checks related to covered losses due to the XXXX XXXX XXXX in XXXX, California. One check in the amount of approximately {$30000.00} was issued for water mitigation related to a prior contractor. No work corresponding to that check was completed, the check has not been cashed, and BSI was notified in writing that the funds could not be used due to active court litigation involving that contractor. Despite this, BSI has repeatedly relied on the uncashed {$30000.00} check as a reason to delay or deny the release of additional insurance proceeds, including approximately {$28000.00} specifically designated for lead and contamination abatement. BSI has stated that I must first complete 70 % of the overall property repairs before any abatement funds will be released and that I am required to pay the {$28000.00} abatement cost out of pocket.

I am filing this complaint regarding an improper mortgage servicing transfer and resulting inaccurate credit reporting. I was never notified that the servicing of my mortgage loan from XXXX XXXX XXXX was transferred to a new servicer. I received no written notice before or after the transfer, as required under the Real Estate Settlement Procedures Act ( RESPA ). I made my mortgage payments in good faith to the servicer I reasonably believed was still servicing my loan. I only became aware of the servicing transfer after my credit report reflected a late or missed mortgage payment on XX/XX/year> and my credit score dropped by approximately XXXX points. After this I investigated and called my Mortage company and they verified my account was current. This company never contacted me about needing any info on my insurance and they've been incredibly difficult to work with. They should have gotten this from buying the mortgage from the bank anyway. They then failed to pay my insurance so I had to pay it directly but they still have my escrow money. When I pointed this out to them via their online portal, they sent me a letter stating that they were going to " force '' insurance on me at triple the rate. This appears to be a scam to hold people 's escrow money and make interest while they delay and then sell inflated insurance when people violate the mortgage agreement to keep the property covered. My loan transferred from XXXX XXXX, and I had a fully executed modification agreement after a trial period under the VA XXXX modification, granted on XX/XX/year>. ( I paid {$2200.00} a month from XXXX to XX/XX/year> ). In XXXX, I received a fully executed modification from XXXX, and my new payments were set to begin on XXXX XX/XX/year> in the amount of XXXX. My account was transferred from XXXX to BSI in XXXX. BSI listed my loan as in default and required me to sign another modification agreement. BSI instructed me that they needed to review the documents, which occurred, and the agreement was re-signed and supposedly honored ( I thought we were good ). I was supposed to begin making my new payments with BSI in XXXX. I have paid the new loan amount indicated in the BSI agreement for XXXX and XXXX. The issue is that my account is not showing current ; I have a notice of intent dated for XXXX, and I owe roughly {$14000.00} immediately.

I still have an escrow balance of {$670.00} and my winter taxes is only {$480.00} so technically my monthly escrow payment should have went down and should be receiving a refund from my escrow ( like I do every year ) but instead my monthly payment increased by {$300.00}. I followed up multiple times : XX/XX/XXXX : First follow-up ( no response ) XX/XX/XXXX : Second follow-up XX/XX/XXXX, XXXX : I received repeated automated responses, including messages stating the request would be completed by XX/XX/XXXX, a date that had already passed. These responses showed the request was not being processed. For 31 days ( Oct 10Nov 10 ), no payoff statement was provided, and daily interest continued to accrue. The payoff statement was finally issued on XX/XX/XXXX, only after I filed a CFPB complaint. Based on the payoff statement, the per diem interest is $ XXXX. Because of the XXXX delay, approximately {$2400.00} in additional interest accrued unnecessarily.

OXX/XX/XXXX BSI financial paid a tax bill that was not in my name. It was in the previous owners name. BSI had sent me a letter on this before they paid it. I contacted the tax assessor in XXXX XXXX XXXX XXXX was told i did not owe it because i was tax exempt. So i contacted BSI and informed them of this. They paid it anyway out of escrow. {$180.00}. I did not know they had paid this till XXXX of XXXX when i got a notice from them saying my escrow was going to be short. I contacted them to discuss this and first they couldnt even tell me why then they found this tax bill they had paid. I contacted the tax office they once again said they should have not paid this bill because it was in someone elsrs name. I also contacted the XXXX attorney to ask if they knew anything about this tax because all taxes were supposed to be paid at closing. They informed me that they had paid all taxes and they contacted the tax assessor and they also found out that it was in the previous owners name.

This complaint was created in order to add existing information to an existing complaint ( # XXXX ). Since XXXX, I have been struggling to make payments. I fell a little behind due to car and house issues, and was fully transparent about this with BSI. I was about 15 days late in XXXX and barely managed to make my XXXX payment on time. Now I am late for XXXX after repeatedly asking for assistance from the company. I was also told different things from different operators. One told me that after 30 days I could get a modification, another said 60, and now they are telling me 90 days. This is just ridiculous. I also applied for forbearance before I was in default and they denied me because they require 90-day delinquency before ANY assistance. This forces borrowers to damage credit and risk foreclosure to get help. Their denial letter gave only 48 hours to appeal - clearly designed to prevent successful appeals.

Despite this, the company refuses to provide written verification showing the date of my removal or any documentation confirming that I am no longer liable. The servicer also refuses to notify their foreclosure attorneys that I am not a proper party to the lawsuit unless the other borrower gives authorization even though I am no longer an account holder and have the legal right to request my own liability status. I have repeatedly requested documentation under 12 U.S.C. 2605 ( e ) ( RESPA ) and S.C.

My mortgage was sold to BSI Financial around XX/XX/XXXX. I have multiple properties with different lenders and I have never in my life dealt with a situation like this one. Here are the details of what happened. Around XX/XX/XXXX, I noticed in my BSI web portal that my regular payment of {$1400.00} had suddenly increased to {$3400.00}. I was not contacted by BSI to be notified of this dramatic change. I immediately contacted customer service to ask why this had changed, and requested my auto payment scheduled for the next day to be canceled as this was not the correct payment amount. They could not explain the difference other than there was an escrow shortage and insisted that it was correct, which I knew was not possible. The next day BSI withdrew {$3400.00} from my account. I had previously authorized automatic payment, but this was for the amount of {$1400.00}, not whatever BSI decided to withdraw.
