Debt collection· False statements or representationCO

The company sued me in court to obtain a judgement against me. They then were granted a judgment with the specific amount allowed to collect with court fees added and XXXX % annum annually. This means legally they can add XXXX % interest to the full amount once a year if Im correct. The added this amount back in XXXX. I have been slowly working on my credit and then all of a sudden they added a random {$30.00} this month increasing the amount owed with no explanation. I disputed with credit bureaus but they say the new amount is correct? How is that? I want an explanation of where this extra {$30.00} added on to the balance came from that once again cared my credit to dip. If the annual interest was already added in XXXX then they have no legal right to add random amounts through the year as they please.

I am in receipt of the response submitted by Cavalry Portfolio Services , LLC. I formally dispute their conclusions and assert that their response fails to comply with federal law and does not meet the required standards for investigation or validation. First, Cavalry admits that validation of the alleged debt was not provided until after my CFPB complaint was filed. This is a critical failure. They continued reporting this account to the credit reporting agencies without first providing proper validation. This is a direct violation of the Fair Credit Reporting Act, specifically 15 U.S.C. 1681s-2 ( b ), which requires a reasonable investigation of disputed information. Their claim that I did not previously dispute the account is irrelevant. Once a dispute is filedwhether directly or through the CFPBthey are legally obligated to conduct a thorough and reasonable investigation.

I am submitting this complaint regarding Cavalry Portfolio Services , LLC and their failure to properly investigate and validate a disputed account. I previously sent a written dispute regarding an account they are reporting on my credit report. In response, XXXX sent letters dated XX/XX/year> and XX/XX/year>. In both letters, they stated that my dispute lacks specific facts and refused to conduct an investigation. Despite receiving my dispute, Cavalry has failed to provide any documentation validating the debt, including proof of the original creditor, account history, or evidence that I am legally obligated to pay this debt. Instead of conducting a reasonable investigation as required, they have repeatedly requested that I provide additional information while continuing to report the account. Under the Fair Credit Reporting Act and the Fair Debt Collection Practices Act, the burden of investigation and validation is on the furnisher of the information, not the consumer.

In XX/XX/XXXX, I made a payment of {$3600.00} to XXXX XXXX XXXX XXXX XXXX XXXX the authorized collection agency for XXXX XXXX XXXX XXXX XXXX issued a written confirmation on XX/XX/XXXX stating that they received the payment and that XXXX XXXX XXXX accepted it and applied it to the account. Despite this, Cavalry Portfolio Services is reporting a {$6100.00} balance, a {$6100.00} pastdue amount, and no payment history. This is mathematically impossible based on the documented payment that XXXX accepted. Cavalry is reporting the full balance as if no payment ever occurred. Cavalry is also reporting an opened date of XX/XX/XXXX, even though XXXX was collecting on the account in early XXXX. This creates an ownership and timeline conflict. Cavalry has not provided verification, chain of title, or documentation showing how they calculated the reported balance. I disputed the account, but Cavalry did not correct the inaccurate information.

A collection account is appearing on my credit report that has not been properly validated. I exercised my rights under the Fair Debt Collection Practices Act ( FDCPA ) by requesting verification of the alleged debt. The creditor or collection agency has failed to provide any legitimate documentation demonstrating that the debt belongs to me, that the amount is correct, or that they have the legal authority to collect it. Despite this lack of verification, the account continues to be reported on my credit file. This is a violation of the Fair Credit Reporting Act ( FCRA ), which requires that only accurate and verifiable information be reported. Reporting an unvalidated account is both inaccurate and misleading.

If you want to avoid getting dragged into a civil lawsuit where you may have to pay for damages, for something you did not even intentionally do, I suggest you delete the illegal collection accounts from my credit report today. You see, THE BUREAUS, has furnished a collection account on my credit report without validating this debt with me beforehand. In fact, the following debt collectors never sent me a dunning letter ( which is mandatory to validate a debt ) within 5 days of the accounts getting reported ( which is also the initial communication ). Therefore, the accounts listed below must all get deleted from my credit report under 15 USC 1692g. However, there is one way you can leave the items on my credit report unscathed. And in order to do this, you must produce proof a dunning letter was sent to my address ( within 5 days of the account getting furnished ).
