Based on a review of my account and submitted documentation to CMG Financial, I believe I am eligible for an escrow waiver, and I am prepared to take responsibility for the direct payment of property taxes and homeowners insurance. Grounds for Request : 1. Equity Position : My current loan-to-value ( LTV ) ratio is 57 %, which is below the 80 % threshold, based on the original appraisal amount of {$840000.00}. 2. Payment History : I have a stellar payment history with no delinquent payments over the 6-year life of my loan, as documented by my credit report provided to you on XX/XX/XXXX with no late payments reflected.

Because XXXX did not provide me confirmation, proof of payment, or any written notice that this disbursement had been made, and because the countys public records continued to show my tax installment as unpaid for more than ten days following Cenlars alleged payment, I was forced to pay the same {$4000.00} directly to XXXX XXXX on XX/XX/XXXX, to prevent delinquency and protect my VA-guaranteed property from lien risk XXXX On XX/XX/XXXX, I filed a formal CFPB complaint regarding this duplicate payment and XXXX failure to provide proof that its disbursement had been received and applied by the county. The payment posted with an effective date of XX/XX/year>, as confirmed by my transaction history. On XX/XX/year>, XXXX reversed the payment, coding it as Misapplied Funds, and placed the {$3000.00} along with {$310.00} in escrow funds into a suspense account, resulting in a total suspense balance of {$3300.00}. No explanation for the reversal was provided to me in writing at that time. The {$3000.00} principal curtailment sat in the suspense account from XX/XX/XXXX through XX/XX/year>, a period of XXXX days.

That averages roughly XXXX complaints per month over 8 months, an unsustainable burden for any borrower and an unreasonable one for a deployed servicemember with limited telecommunications access. On XX/XX/XXXX, I submitted a deferment request via secured email. CMGs agent acknowledged receipt on XX/XX/XXXX, and requested additional documentation. I provided my military orders the same day. CMGs own response to Case XXXX, dated XX/XX/XXXX, acknowledged that the additional documentation requested was not required under the guidelines for a California Deferment , and that this caused a delay in processing. CMGs deferment approval was granted XX/XX/XXXX, effective XX/XX/XXXX through XX/XX/XXXX, covering principal and interest payments for that entire period. XXXX confirmed in writing that updates would be provided via secure email due to my inability to receive telephone calls during XXXX.

I am filing a complaint regarding a serious data handling and servicing issue involving my mortgage servicer, CMG Home Loans. For several months, I have been attempting to correct inaccuracies on my Form XXXX ( XXXX XXXX XXXX ). Despite repeated outreach, the company failed to provide a correct form in a timely manner. On or about early XX/XX/year>, while attempting to resolve this issue, the company sent me a Form XXXX belonging to another borrower. This document contained that individuals non-public personal financial information, including full name, property address, loan number, loan balance, mortgage interest information, and the last XXXX digits of their Social Security number. This constitutes an improper disclosure of sensitive financial information to an unauthorized party. I raised this issue immediately with the company. In their response, they characterized the incident as human error and stated that it occurred outside of their standard processes.

Every substantive request I submit in writing is deflected with a form response directing me to call XXXX. CMG refuses to resolve any issues through the written secure message system I am using to contact them, despite my explicit and repeated written requests for written responses. When I submitted a formal written request regarding an escrow insurance substitution, CMG directed me to a third-party company rather than responding as my loan servicer. I explicitly asked CMG to answer as my servicer. They did not. I am XXXX overseas, and calling a U.S. number requires international dialing at significant personal expense. CMG is aware of this and refuses to reimburse these fees.

I am currently unable to make an additional principal-only payment on my mortgage loan through CMGs online platform. The system does not allow me to process a principal-only payment electronically. At this time, the only method available to submit a principal-only payment is by calling customer service. As I am XXXX XXXX, making these calls requires international dialing, which results in out-of-pocket international calling fees. CMG has not provided any alternative method for me to submit a principal-only payment without incurring these additional costs. This effectively forces me to pay extra money simply to reduce my loan principal. I do not believe it is reasonable for a borrowerparticularly a XXXX servicememberto incur international fees in order to make a voluntary principal-only payment.

I am filing this complaint regarding inaccurate credit reporting and payment handling issues caused by CMG Banks internal servicing transition from CMG Loans to CMG Home Loans. I contacted CMG in XXXX after noticing our loan was not appearing on our credit report. During that call, I was informed that the loan had been transferred from CMG Loans to CMG Home Loans. I specifically asked whether payments needed to be sent to a different address or system and immediately updated my billing information based on CMGs instructions. Unbeknownst to me, my XXXX payment in the amount of {$2000.00} was returned due to CMGs internal transition instead of being forwarded or credited to the new servicer. I was not notified of this return in a timely manner. As a result, my XXXX payment was applied to XXXX, and my XXXX payment was applied to XXXX, creating an artificial delinquency through no fault of my own.

in regards to previous complaint filed XXXX : Rebuttal to Company Response ( XXXX # XXXX ) I am disputing the servicers response. The servicer has provided copies of " short pay '' letters dated XX/XX/XXXX and XX/XX/year>. I maintain that I never received these letters, nor did I receive the original XX/XX/year> escrow analysis. The servicers defense is logically inconsistent : Lack of Proof of Mailing : Producing a PDF from a computer system is not legal proof of delivery. Under RESPA ( 12 C.F.R. 1024.17 ), the servicer must actually " deliver '' notice. I request the servicer provide the official mail logs or a " certificate of mailing '' for these specific dates to prove they were ever placed in the XXXX XXXX Contradictory Behavior : The servicers letters state they " can not accept short payments, '' yet they accepted my XXXX and XXXX payments in full. By doing so, they reinforced my belief that I was paying the correct amount.

CMG continues to minimize its admitted servicing failure while refusing to fully remediate the financial harm caused by withdrawing funds during my approved military deferment. My deferment was confirmed through XX/XX/year>, and principal and interest were not contractually due. Despite this, CMG drafted {$4800.00} on XX/XX/year> and applied it as a standard installment while I was XXXX overseas. This was not a harmless system oversight. It was the collection of funds during a protected deferment period. CMG has failed to confirm that my principal balance has been restored to the correct amount as of XX/XX/year>, failed to confirm that no excess interest was assessed or capitalized, failed to provide a corrected escrow accounting, and failed to confirm that no adverse credit reporting occurred. Instead, CMG attempts to shift responsibility by stating I did not draft a XXXX payment.

In XX/XX/XXXX, we experienced a temporary hardship due to a mass layoff involving my wifes employment in the immigration sector. XX/XX/XXXX : We immediately contacted CMG Financial to seek a loan modification or forbearance due to this temporary issue. Every time we sought help, the file was placed under a XXXXday review, which halted all progress. XXXX XXXX : We received a letter approving a modification, but it was unacceptable as it required a large balloon payment/lump sum of roughly {$19000.00}, which we could not afford. I am submitting this complaint because CMG failed to honor an approved military mortgage deferment and improperly billed and collected payments that were specifically deferred while I was on XXXX XXXX. On XX/XX/XXXX, I submitted a request for a military deferment and provided my XXXX orders. CMG acknowledged receipt and later confirmed that I was approved for a military deferment effective XX/XX/XXXX through XX/XX/XXXX. CMG explicitly stated, including in a written response to a prior CFPB complaint dated XX/XX/XXXX, that this deferment applied to principal and interest payments only and that I was still responsible for monthly escrow payments during this period. Despite this approved deferment, CMG issued a mortgage statement dated XX/XX/XXXX, demanding a total payment of {$4800.00}, which included principal, interest, and escrow. My mortgage loan was recently sold to CMG Home Loans. My mortgage payment is {$2800.00}. Every month, XXXX XXXX XXXX ( through my online banking service ) mails the mortgage company a check for {$3000.00}. {$2800.00} goes towards whats due, and then the remaining balance is supposed to be applied towards my principal ( {$190.00} ). Ive been doing it like this for YEARS. Now that CMG Home Loans is servicing my mortgage, they have taken my last XXXX mortgage payments ( XX/XX/XXXX and XX/XX/XXXX ) and they are processing my payments as late so they can keep {$140.00} as a late fee. For example, Bank XXXX XXXX mailed my XXXX mortgage payment on XX/XX/XXXX. CMG Home Loans is saying they didnt receive my payment until XX/XX/XXXX ( 10 days later ). Theyve done this now twice, XXXX mortgage payments in a row. I did a XXXX way call today between XXXX XXXX XXXX and CMG Home Loans ( spoke with XXXX ) to try and fix the situation and get what they kept as late fees back.

The second payment was received by CMG on XX/XX/XXXX. Both payments were made by check. As of today, neither check has been deposited or negotiated, and the payments have not been properly credited to our mortgage account. We have confirmed with our bank that both checks remain outstanding and have not cleared. We also attempted to resolve this matter directly with CMG by phone, but we were unable to speak with a representative who could address the issue or confirm the status of the payments. We are concerned about potential late fees, incorrect account status, and possible negative credit reporting due solely to CMGs failure to process payments that were received on time.

I was informed that escrow analyses in Florida are performed only on an internal annual schedule and that a borrower-requested escrow analysis can not be initiated. Despite providing updated insurance information, CMG has not reviewed or adjusted my escrow account and will not confirm whether corrections can be made prior to the scheduled XXXX analysis. I am requesting a review of my escrow account for accuracy, written confirmation of the escrow analysis timeline, and adjustment or refund of any escrow overpayments, consistent with RESPA requirements.

I bought a home in XX/XX/XXXX and took out a mortgage that was acquired by CMG Financial in XX/XX/XXXX. CMG Financial transferred my mortgage to CMG Home Loans effective XX/XX/XXXX. On XX/XX/XXXX I contacted CMG Home Loans and requested a mortgage recast. On XX/XX/XXXX I received the recast instructions via XXXX Mail, including instructions on where to wire funds. On XX/XX/XXXX I wired {$380000.00} to CMG Home Loans, which represented more than 68 % of my outstanding principal balance. On XX/XX/XXXX the CMG online portal continued to list my principal balance as {$550000.00} which was the balance before I made my substantial principal payment. I called CMG and spoke to a couple of people before I reached XXXX in the XXXX XXXX. XXXX explained to me that the recast process took some time. I would receive an agreement to modify the terms of the mortgage that I would sign and return.

When I called on XX/XX/XXXX, I was transferred to multiple different people, they tried and failed to find the email that I had sent, and then they hung up on me while I was on hold.

On XX/XX/XXXX we requested to recast the loan on our new property with CMG XXXX XXXX We received the recast wire instructions via XXXX on XX/XX/XXXX. We wired {$450000.00} to CMG XXXX XXXX on XX/XX/XXXX. CMG received the funds on XX/XX/XXXX. CMG advised us that we would be required to make our full house payment of {$4600.00} for XXXX and XXXX of XXXX. CMG didn't remove the PMI until XX/XX/XXXX. Our recasted payment due on XX/XX/XXXX is {$1300.00}. If the payment is received by XX/XX/XXXX there is no penalty. I tried to make a payment using the CMG payment portal on XX/XX/XXXX, however the amount they want us to pay is incorrect at {$1600.00} and we are unable to use autopay. We tried to contact them however they were closed. I will try to reach them on Monday XX/XX/XXXX to correct this.

I am filing a complaint regarding my mortgage servicer, CMG Home Loans, related to improper mortgage servicing on Loan Number : XXXX ( CMG Case Number : XXXX ). Without my consent and without any prior written or verbal communication, CMG Home Loans initiated or modified an escrow account, which directly caused an increase in my monthly mortgage payment. Had I been notified, I would have immediately provided proof of fully paid property taxes and continuous homeowners insurance to prevent escrow from being started or adjusted. My original monthly mortgage payment was {$2500.00}. In XXXX, CMG increased my payment to {$2900.00}, and beginning XXXX and continuing thereafter, my required monthly payment has been {$2800.00}. These increases were implemented without advance notice, consent, or a written explanation. I have never missed a mortgage payment and have never missed any property tax or insurance payment.

I am in the middle of starting my own business, and was in process of purchasing a gas station. Previously I was under a special forbearance from XX/XX/XXXX to XX/XX/XXXX, and paid the account in full on XX/XX/XXXX. I now am under a second special forbearance on XX/XX/XXXX. My account is now current. on XX/XX/XXXX XXXX Mortgage reported my account being XXXX days past due, even though it is not. This action has caused me about {$5.00} million in damages from the sellers pulling out of my gas station deal, and the loss of application on a XXXX XXXX loan and a XXXX loan, and now being unable to pay employees. When I asked for rapid escalation, a letter of correction, and for a resolution... the response was for me to provide CMG a court summons for that information on a recorded call.

I called XX/XX/XXXX CMG loss mitigation department told me that they have not finished the update in the system to reflect the modification as of yet, told them my monthly payment on the website portal for the loan was reflecting incorrectly for the monthly payment and the escrow shortage. I called made my XXXX payment of {$3200.00} as agreed upon per my modification.
