Debt collection· Attempts to collect debt not owedMO

Im filing a complaint against " CONTRACT CALLERS INC '' because they are reporting a collection account ( original creditor listed as XXXX XXXX, account # XXXX ) that is completely unverified. I never gave permission for them to report anything to the credit bureaus. After I was notified of this collection, I immediately requested proper validation. But they didnt provide anything, no signed agreement, no breakdown of the amount theyre claiming I owe, and no proof they have the legal right to collect this debt. Thats a direct violation of 12 CFR1006.34 ( b ) ( 5 ) of Regulation F, which says collectors must provide full debt verification when the consumer requests it. They also failed to give me a fair opportunity to dispute it, violating 12 CFR1006.34 ( c ) ( 4 ) ( i ). Even though they didnt validate the debt, they still went ahead and reported it to the credit reporting agencies. That is both deceptive and illegal under the Fair Credit Reporting Act, specifically 15 U.S.C.

I recently became aware of a past-due balance on my XXXX XXXX account and immediately began making payments to resolve the debt. Since that time, I have reduced the outstanding balance from {$1100.00} to {$190.00} and am continuing to make consistent payments toward the remaining amount. However, despite my active efforts to bring the account current, the balance was reported to collections and has since appeared on my credit report. I had planned to contact XXXX XXXX to notify them of my payments and ongoing resolution prior to the account being transferred, but the collection reporting occurred during this process. As I am actively working with the original creditor to resolve the remaining balance, I am requesting that this account be reviewed for accuracy and that the collection reporting be reconsidered or removed to reflect my current payment activity.

I disputed an alleged debt with Contract Callers, Inc. and requested lawful verification. In response, the company provided only a billing statement and a final bill, which did not establish consumer authorization, service delivery, accuracy of the balance, or authority to collect. In its response, Contract Callers , Inc. admitted that verification of the debt remains pending and has not yet been received from the creditor. Despite this admission, the company maintains the account in a reportable status and asserts that reporting is permissible while verification is incomplete. Additionally, Contract Callers , Inc. has not demonstrated that it is properly licensed or authorized to collect consumer debt in the State of New Jersey as required by the New Jersey Consumer Finance Licensing Act ( N.J.S.A. 17:11C-1 et seq. ). Public licensing records reviewed by the consumer do not reflect active New Jersey authority to collect debt.

I dispute the accuracy and completeness of this collection tradeline. The furnisher has repeatedly failed to provide competent evidence of legal standing/authority ( ownership/assignment or placement authority ) for this specific account and has only sent a generic statement that I owe the original creditor. Because the furnisher can not substantiate the basis to report this account, it is not verifiable. Under 15 U.S.C. 1681i ( a ) you must conduct a reasonable reinvestigation, and under 15 U.S.C. 1681i ( a ) ( 5 ) ( A ) you must delete information that can not be verified. Continued reporting also violates the requirement for maximum possible accuracy under 15 U.S.C. 1681e ( b ). Please delete this tradeline, or provide the results and procedure details required by the FCRA.

Please see the attached letter from the Bureau stating it is insufficient and why. They still stated there was no letter I could request and their letter was approved by their lawyer and they can not change any language. They also stated their timeline for a deletion letter was still over 30 days out and they can not change that or send one sooner.

I am filing this as a new complaint regarding Contract Callers Incs continued reporting and collection of an alleged debt without having validated the obligation, in violation of the Fair Debt Collection Practices Act ( FDCPA ) and the Fair Credit Reporting Act ( FCRA ). In a prior CFPB complaint ( No. XXXX ), Contract Callers Inc admitted that they do not currently possess documentation sufficient to validate the alleged debt and that they are awaiting additional information from the alleged creditor. This admission confirms that no validation has been produced to date. An initial validation notice does not constitute debt validation under 15 U.S.C. 1692g ( b ). Once a consumer disputes a debt in writing, a debt collector must cease all collection activity, including credit reporting, until proper validation is provided.
