XXXX XXXX XXXX has called me, my mother, and my ex-husband 's daughter multiple times to collect a debt. I asked them several times to only contact me, as they obviously have my number, yet they continued to harass my mother. Further, when they attempted to verify my identity, they asked me " Is your name XXXX XXXX? And is XXXX the last four of your social? '' Anyone could have said yes. This is not the correct way to verify my identity. XXXX de XXXX admitted to calling all numbers that have ever been associated with me, and using this line of questioning to confirm it was me. If the number had been given to someone else, or anyone could have lied and said yes, and now my personal information is being given out to strangers. She was extremely hostile towards me when I attempted to explain why she should ask me identifiable information, rather than simply having me confirm it.

I obtained a line of credit through CreditFresh, and the repayment terms quickly became unmanageable due to the high fees and the structure of the required payments. I contacted the company multiple times to request assistance or a hardship option. Still, I was either told no adjustments were available or given limited information that did not resolve the issue. Despite my attempts to communicate and stay current, I was unable to keep up with the payments, and the balance continued to grow. Because I can not afford the amounts being claimed and have been unable to obtain meaningful relief from the company, I am submitting this complaint so the matter can be reviewed.

I am submitting this complaint regarding my line of credit account with CreditFresh due to concerns about excessive and unclear fee practices. I took out a line of credit and have been making consistent payments toward my balance. However, I have been charged repeated billing cycle fees that appear disproportionately high compared to my remaining balance. For example, I was charged approximately {$63.00} in fees within a short billing cycle on a balance just over {$1100.00}. Despite making payments, a significant portion appears to go toward fees rather than reducing the principal. The structure of these fees was not clearly understood at the time of agreement, particularly the frequency at which they are applied and the total cost of borrowing over time. The impact has made it extremely difficult to make meaningful progress toward paying down the balance. I am requesting the following : 1. I am a resident of North Carolina and obtained a line of credit through CreditFresh. Although this product is presented as a line of credit, the fee structure results in an extremely high effective interest rate. I am currently making payments of approximately {$500.00} per month, but only about {$60.00} is applied to principal, with the remaining amount going toward fees. This structure makes it very difficult to reduce the balance and creates a cycle where most payments do not meaningfully lower the amount owed. North Carolina has strong consumer protection laws and restrictions on high-interest and payday-style lending. The structure of this account appears to function similarly to those prohibited products, using fees instead of traditional interest. I am concerned that this lending product may not comply with North Carolina law and that the cost of the loan is excessive and not reasonably transparent in practice.

What was not made clear to me at the time of origination was that the effective annual percentage rate on this account would exceed 100 %. I am a New Jersey resident, and New Jersey caps consumer loan interest at 30 % APR for non-bank lenders. CreditFresh is using XXXX Bank, a XXXX bank, as a vehicle to charge interest rates that would otherwise be illegal in my state. This is commonly referred to as a rent-a-bank arrangement, and it is my position that CreditFresh is the true lender on this account, not XXXX Bank XXXX CreditFresh markets the product, originates the application, services the loan, and retains the economic interest. XXXX Bank exists in this transaction solely to provide a workaround to state usury laws.

I am filing a complaint regarding CreditFreshs failure to properly disclose dailyaccruing charges, inconsistent payment demands, and misleading statements made at the time I opened the account. My balance is increasing daily, which indicates that a dailyaccruing fee or interestequivalent charge is being applied. I requested that the company show me where in the signed agreement any daily interest rate, daily fee, or daily accrual method is disclosed, and the company was unable to locate or provide this information. When I opened the loan, the representative stated multiple times that no interest would accrue and that my payments were fixed based on the principal amount. This is inconsistent with the current behavior of the account. The agreement states that my monthly charge would be no more than {$280.00}, but the company is now demanding {$310.00}, which exceeds the maximum disclosed payment amount.

I never received the required initial written notice before this account was placed on my credit report, in violation of FDCPA 809 ( a ). After discovering the account, I requested proper debt validation more than 30 days ago, including the name of the original creditor, a valid account number, an itemized balance, documentation proving my legal obligation to pay, and proof that CreditFresh has the authority to collect and report this debt. No validation has been provided.

I had a line of credit account with CreditFresh ( Account # XXXXXXXX ), originated by XXXX XXXX. I fully repaid the principal and closed the account, with no outstanding balance. Upon reviewing my documents, I discovered a serious violation of the Truth in Lending Act ( TILA, 15 U.S.C. 1601 et seq. ) and Regulation Z. The Truth in Lending Statement provided to me on XX/XX/XXXX, includes only a tiered " Billing Cycle Charge '' table and completely omits any numerical Annual Percentage Rate ( APR ). Federal law requires clear and conspicuous disclosure of the APR for open-end credit so consumers can understand and compare the true cost of borrowing. This missing disclosure prevented me from appreciating the effective annualized cost, which exceeded XXXX % on my {$1000.00} draw based on the charges applied. I paid a total of {$700.00} in Billing Cycle Charges ( finance charges ) despite making all required payments on time and working to pay off quickly to minimize costs.

They requested a down payment with an additional payment plan, of which I have provided a copy which also includes their company information. They called my wife and other family members, as well as threatened to contact my employer. Most payments are applied to recurring billing cycle fees rather than principal, causing the balance to grow despite consistent payments. On XX/XX/year>. I paid off my loan in full ( {$2000.00} ). Apparently, there was a payment of {$120.00} processing on XX/XX/year>. When I made the payment, the {$120.00} got returned to my bank for some reason ( CreditFresh claims it was because of insufficient funds, but I just paid the loan in full ). On XX/XX/year> I tried to make a withdrawal to cover some minor expenses but when I logged on to my account, that option was not available and it said " Please call us to restore your account ''. I called, wondering why my account was locked, and they told me that because my account was in delinquent status when I tried to make a withdrawal, their system flagged my account with fraud and I am unable to make any withdraws for three months. I just paid off the entire loan .. and they continue to ask me for the {$120.00} and tell me that if its not paid within 30 days it will affect my credit.

I have a debit card which works at, quite literally, every other in-person and online business I purchase from or pay bills to ; there are no exceptions to this, save one. CreditFresh is the ONLY company that can not process my debit card. There is nothing amiss with the card, as I have verified with my bank, multiple times. I have called CreditFresh numerous times ( very numerous ) and have been reassured many ( many ) times that this will be addressed. It has not been. I am getting daily e-mails from them, stating that I have not paid my bill. I have done all in my power to pay my bill. I have one checking account. I have one debit card. There is nothing else. That's all there is. They are threatening to report me to the credit bureaus despite my many attempts to pay and my many interactions with their ( useless ) representatives. I am at my wits ' end. This is not a me problem. This is not my bank 's problem. This is not my debit card 's problem.

When I asked the purpose of the call, he stated that I was involved in a breach of contract but refused to identify the alleged creditor or provide any additional details. I advised the caller that I would not verify my address without being informed of the nature of the call. The caller responded that he was viewing my address information online and began listing alternative addresses associated with me. When I again requested an explanation, the caller raised his voice, instructed me to be quiet, and told me not to interrupt him. At no point did the caller disclose that he was a debt collector or that the call was an attempt to collect a debt, stating only that this is not a sales call, which appears inconsistent with 15 U.S.C. 1692e ( 11 ).

I took out a {$1700.00} line of credit with CreditFresh. After making monthly give or take payments of {$200.00} for a complete year the balance is lowering a tiny bit. Payments are pulled from my checking account every 2 weeks. When looking at my account I notice a {$85.00} in fees labeled as billing cycle charges. With only {$13.00} applied to the principal balance. As of today XX/XX/year>, I have paid CreditFresh roughly {$2300.00} on a {$1700.00} applied amount. This loan product is predatory situation. CreditFreshs practices are deceptive and unfair to consumers. Making it very difficult to pay down the principal / balance. The account is continuously generating fees creating a endless financial setbacks. The fees and the payment structure are not clearly explained of approval. I.E, loan length and amount with interest.

I revoked automatic payment authorization on my CreditFresh account and requested a payment structure that would meaningfully reduce my principal balance. CreditFresh confirmed in writing that my biweekly minimum payment of approximately {$150.00} applies only about {$22.00} to principal and approximately {$130.00} to fees. I requested a payment modification, fee reduction, or repayment-only option because this structure does not reduce my balance and creates a cycle of fees. CreditFresh responded in writing that they are unable to manually modify payments or stop billing cycle fees and directed me to their Truth in Lending disclosure instead of offering a resolution. I am willing and able to pay my balance, but I am disputing a payment structure where the majority of each payment is applied to fees and not principal. I attempted to resolve this directly before filing this complaint.

I took a personal loan of XXXX from www.creditfresh.com ( XXXX XXXX ) XXXX XXXX in XX/XX/year>. It was explained to me by phone that payments of XXXX were to be made biweekly. Then the woman that I was speaking with read a disclosure very fast in which I couldn't half understand what she was saying ( I do believe the phone call was recorded. ) And then I had to e-sign documents. The XXXX deposit was then places into my XXXX XXXX XXXX checking account. As I went on making these XXXX biweekly payments and, reviewing my statements each payment I noticed that of the XXXX I pay bi-weekly only XXXX of it goes towards the principle balance. When I spoke to someone to ask what would happen if I wanted to pay the loan back in full, they told me I'd have to pay XXXX. They automatically withdraw payments from my bank without my authorization every two weeks which now has my bank account overdrawn over XXXX and I'm behind on my loan payment on top of it.
