In late XXXX, the account began showing unauthorized and fraudulent charges, which I reported to XXXX multiple times. Despite those reports, XXXX did not properly investigate or resolve the fraudulent activity and continued to assess interest and fees on disputed charges. The account was charged off in XX/XX/XXXX with a balance of approximately {$34000.00} and later sold to Midland Credit XXXX XXXX XXXX XXXX XXXX a collection lawsuit and obtained a default judgment on XX/XX/XXXX. The judgment was entered procedurally and did not involve judicial review of the accuracy of the balance or the unresolved fraud disputes. After judgment was entered, XXXX immediately initiated bank garnishment.

I am filing a complaint against Midland Credit Management ( MCM ), also known as XXXX XXXX XXXXXXXX XXXX XXXX XXXX, regarding violations of the Fair Debt Collection Practices Act ( FDCPA ). On XX/XX/XXXX, I sent a formal cease and desist letter to Midland Credit Management instructing them to stop all communication with me regarding any alleged debt. This request was made in writing and should have been honored under federal law. Despite this, I have continued to receive collection calls. I recently spoke with a debt collector, MIDLAND CREDIT MANAGEMENT XXXX XXXX, who refused to provide any information about the alleged debt. This debt can not possibly be valid because I have never had any account with the original creditor. My credit history is clean, and I have never had any unpaid debt. Despite my efforts to provide documentation proving that this debt is not mine, they have refused to acknowledge any of the evidence I submitted. I have spent considerable time attempting to resolve this matter, but all my efforts have been ignored. I believe this behavior is unfair, misleading, and may violate my rights under the Fair Debt Collection Practices Act. The only way they said they could help me was if I provided my home address, which I believe is inappropriate and abusive, especially since I am the XXXX contacting them to resolve the issue.

In XXXX, I received by mail a letter created on XX/XX/XXXX by XXXX XXXX claiming that a credit card ending in XXXX was taken out in my name. The letter stated that I was delinquent in paying off a debt of {$6800.00}. It consisting of {$6500.00} in principle and {$230.00} in fees. Not once had I received any notification of this debt or documents for a repayment schedule. The letter claims this debt was sold by XXXX to Midland Credit Management for collection. Midland Credit Management claims that I am responsible for paying this debt. Doing some research into this letter showed several red-flags for fraudulence on it. First, the letterhead has a slight shadow underneath it showing that the XXXX logo had been pasted on the paper. Second, the balance shows the amount of {$6800.00} instead of {$6800.00}. Third, the letter had not been signed or notarized.

The Bill of Sale did not identify my account, Exhibit A was blank, the Citi Notice of Sale was generic, and the XXXX statement did not prove ownership or liability. No contract, no itemized accounting, and no chain of title were provided. Despite my dispute, Midland continued collection activity and continued reporting this account to the credit bureaus. The balance they report does not match XXXX records. They also ignored my arbitration election and my Cease & Desist notice.
