Exeter finance in previous responses said they dont have to honor any settlement yet in contract my wife said that it says that there may be a dispute between me and the finance company and any further action of any kind outside of a dispute with Exeter waives all rights, now it is on file that Exeter said they dont have to honor any settlement and before that they said that the problems were not their problems that me the customer brought to them over the phone which is part of the legal binding contract which they waived by telling me that the issues were not there problem and to go back to the dealership before I even filed a complaint, which they have to honor a settlement because they forfeited the contract making the contract void which is waiving their rights in a breach of contract.

My auto loan with Exeter Finance had a XXXX term and reached its contractual maturity date on XX/XX/XXXX. The original loan amount was approximately {$10000.00}. I have made consistent monthly payments of approximately {$280.00} since XXXX and have made over XXXX payments, totaling approximately {$17000.00}, which is significantly more than the original contract amount. Despite completing the loan term and paying well over the original balance, Exeter Finance is still claiming I owe approximately {$3400.00} and has continued collection efforts, including threats of repossession. I requested validation of this debt through a certified letter, including the original signed contract, full payment history, breakdown of interest and fees, and a clear explanation of how the remaining balance was calculated after the maturity date. It has been over XXXX days, and I have received no response.

And still owe XXXX, and that makes no sense to me and very shady seeming. Especially since they refuse to let me have a copy or see my contract online.

The monthly note was {$360.00}. XXXX months payments equal to {$2100.00}. InteresXXXX charged was {$1700.00} Principal paid was {$390.00}. How can we owe more than we borrowed? This is sub prime lending. I was unaware sub prime lending was even legal and I was not made aware of this when the auto was purchased. Please help me settle this. Exeter lending is taking advantage of people and should be stopped. Thank you.

Exeters own Statement of Account dated XX/XX/year> for account XXXX does not provide account-specific proof that this account was ever included in bankruptcy. It reflects the account and a total outstanding balance of {$0.00}, but the bankruptcy language in that document is generic conditional boilerplate, not evidence that this particular account was included in any bankruptcy proceeding. A generic disclaimer, internal coding issue, automated system issue, vendor issue, or bureau translation issue does not make false bankruptcy reporting accurate.

On XX/XX/XXXX, Exeter Finance LLC transmitted a four-page Payment Extension Agreement offering to extend XXXX scheduled payments originally due XX/XX/XXXX and XX/XX/XXXX to XXXX/XXXX/XXXX and XXXX/XXXX/XXXX, respectively. This agreement advances the loan 's maturity date from XXXX/XXXX/XXXX to XXXX/XXXX/XXXX and, by Exeter 's own written admission, imposes an estimated additional cost of {$1700.00} on the consumer, increasing the projected final payment from {$6300.00} to {$8100.00}. This constitutes a material modification of a consumer credit contract governed by the Truth in Lending Act, 15 U.S.C. 1601 et seq., and its implementing regulation, Regulation Z, 12 C.F.R. Part 1026. Exeter issued this modification agreement without providing any of the redisclosures required by federal law.

I am filing a formal complaint against Exeter Finance for deceptive payment practices, refusal to provide written confirmation of account changes, and technical failures. My monthly payment is {$710.00}. I have repeatedly requested that any amount paid above this total be applied 100 % and exclusively to the PRINCIPAL BALANCE. I explicitly refuse the 'Paid Ahead ' status. Currently, the banks system incorrectly applies overpayments as pre-payments for future months, which does not reduce the principal balance immediately and allows interest to keep accruing on the full amount. I want my extra money to work toward debt reduction now, not as a credit for future months. I also refuse to split my monthly bill into XXXX separate payments, as this is a tactic for the bank to receive funds earlier without providing any real benefit to me.

The vehicle was towed in XX/XX/XXXX. Vehicle was sent to auction prior to the " Notice of Intent to Dispose of the motor Vehicle '' was generated. Fees were paid and vehicle could not be found for XXXX days. Since then, Exeter Finance has charged a fraudulent {$460.00} key fee, despite auction records proving no key was made. Exeter ignored messages and letters disputing the amount for over a year. On XX/XX/XXXX, Exeter marked the account as 'Closed/Written Off ' with this fraudulent balance included. A new collection agency, XXXX XXXX XXXX, which violated my rights by leaving a detailed voice message with an acquaintance ( case number XXXX ). They claimed to own the account and I have served them a formal dispute that was received via certified mail on XX/XX/XXXX. Under the Rosenthal Act, this legally stays all collection for XXXX days. Despite this, Exeter has re-emerged as of the XX/XX/XXXX harassing me with calls to collect the written-off balance.

I originally submitted a complaint with the protection bureau and the Exeter XXXX said they will not honor, so if it is a contract and not a financing loan then why does it have on the paperwork that says, amount financed? Also dont I have a right out of a contract with a vehicle that has N/A marked for condition of head lights, also the dealership said there was no sold as is so the contract tells me other wise. I have a right of my contract especially when the papers I got the day of purchase said the last reported mileage reading on the car was XXXX miles yet the original owner only drove XXXX miles a year so where are the other XXXX something XXXX miles? Exeter finance accepted the deal with the dealership that lead to our contract. I have been lied to by Exeter and the dealership multiple times and they just lied to the XXXX XXXX.

I have talked with several individuals at Exeter finance to get an understanding of how the payments are applied to the interest and principle of the loan. They have stated that they are unable to give me a breakdown of how the payments are paid. I have been paying on the loan since XXXX and the balance has only gone down by {$2000.00}. When I look at the statement online, there are several instances that the principle has not been paid for 6 months at a time. They continue to tell me it is because of late charges and interest meanwhile I am paying {$75.00} over the minimum payment.

EXETER FINANCE LLC : I purchased a vehicle XXXX years ago costing {$32000.00}. Over the course of XXXX and a XXXX years i paid on time everytime $ XXXX a month. My insurance kept going up and had reached $ XXXX so unable to pay that i went down to liability. Few months later i end up totaling the car, having the means to make it right that same day i called Exeter financial with an offer of {$15000.00} to pay off the {$2000.00} left on the vehicle along with some for any interest. They proceeded to tell me they do not negotiate. So i continued to pay my note on time every month on top of the new note from the car i had to buy to get back and forth to work. Up until i could no longer handle both payments. Which they then sent me an offer to pay 25 % of the cost of the vehicle. Since they do not negotiate i ignored that. They then came offering 15 %, i ignored that then they closed the account and charged of the whole {$32000.00}. Then offered 5 %.

Exeter Finance is reporting an account on my credit report as a profit and loss write-off with a balance of {$20000.00} and a charge-off date of XX/XX/year>. Concerned about potential identity theft, I checked the XXXX data breach settlement website and confirmed that my personal information had been compromised in the large-scale XXXX breach . I also filed an identity theft report with the Federal Trade Commission ( FTC ). After discovering the fraudulent account, I disputed it and requested documentation from the company showing that I am responsible for the debt.
