I attempted to make my regular mortgage payment for XXXX, but I was unable to do so because I could not access my online account and/or was otherwise prevented from processing the payment. I was ready, willing, and able to make the XXXX payment, but Fay Servicing prevented me from doing so through its systems and handling of the account. I was not refusing to pay. I was actively trying to make the payment. I borrowed {$35000.00} on my paid off home in XXXX. During my time of paying on it my loan was sold to 4 different mortgage companies. Before Fay Servicing it showed I owed {$19000.00} left to pay off. When Fay Servicing took it over in XXXX they added a charge of {$11000.00} showing after 17 years of paying now I owed {$30000.00} plus the doubled my mortgage payment. I filed for loan modification but they didn't lower it. So I filed hardship modification mitigation in XX/XX/XXXX. During that time I sent 3 applications at different times per request and was told I couldn't make any payments until modification. I was in touch with them. Once again I filed application XXXX XXXX. For the XXXX time, Fay Servicing has not timely paid insurance premiums from escrow and we have had to pay out of pocket. Fay is charging us for escrows, holding our funds and not paying premiums timely. Sometimes to the point of insurance policy lapses due to nonpayment and others while sending forced placed insurance notices to us.
We paid our last house payment. Then a deferred balance and a recoverable corporate advance balance was charged since I was at the end of my loan, it showed up in my portal as the new balance. I asked for information on these. They sent me a letter stating the recoverable corporate advance balance was paid by my prior servicer and then that was removed. I was happy about that. Then I was waiting for the breakdown information for the deferred balance. I have called and emailed 50 times and am getting no where. Then all of a sudden the recoverable corporate advance shows back up on a statement. I am beyond frustrated!!
I have tried on many occasions to set up a payment plan. This company does not want to work with me. I can make an extra payment a month probably for XXXX or XXXX months maybe less to catch up, I have over XXXX dollars to put towards what I owe. The Company called me and asked me what are my intentions, and I said XXXX keeping my home and I have at the time XXXX to put towards what I owe. The female on the phone stated I owe actually XXXX dollars and will have a reinstatement letter sent to my home. I get the letter and it says I need to pay over XXXX dollars to have it reinstated. There was corporate advance fees, I called them to ask them to explain this and no one has called me back or left a message. It was not fully responded to with explanations that made sense or lacked complete explanations ; in addition Fay Servicings refusal to correct my credit history with errors made solely on their end. When my loan was recently transferred to Fay Servicing from XXXX I had a half payment that was transferred to Fay. I was told it would go to a XXXX account until I made the other half payment then it would apply to my note. The problem is they did NOT tell me that it would go to principal after so many days. I'm going to describe the most recent incident from an application i submitted in XXXX that to this day was not addressed. I was told repeatedly that there were 2 pages missing ( pages 3 and 4 ). I repeatedly returned the documents via first class mail and email. Finally a representative acknowledged receipt and informed me that my request would be submitted and I never heard back. I proceeded to refile the bankruptcy i defaulted from loss of job and transportation after over 2 years in the bankruptcy. The mortgage Co never attempted to assist or never responded to my continued request for a modification or mortgage assistance. They are horrible. While in the process of refinancing in XXXX of XXXX, my title company requested a payoff from my current VA mortgage holderthe VA for my Partial Claim, which they hold the lien on. Then when XXXX assumed the mortgage in XXXX or XX/XX/year>, all of a sudden my mortgage payments increased and now I am receiving escrow analysis just about every other month stating that I have a shortages. Each time I applied, Fay acknowledged that my household is experiencing a financial hardship but stated that my spouse and I either lacked sufficient surplus income for a repayment plan or were not eligible for payment deferral due to delinquency requirements set by the investor. The bank changed servicing company to Fay servicing company. This bank received the payment on the 15 via electronic payment with a credit card. We did the registration and made payment on the account as instructed. this was done on the XXXX of XXXX. I starting receiving phone calls and letter that payment had not been made. I am delinquent with my mortgage by a few months after a car wreck left me in a wheelchair. Fay Servicing , LLC improperly handled insurance proceeds by depositing a check that they received for endorsement only, for damage to my primary residence in XXXX, Maryland. After a covered loss, my insurer issued payment for repairs. The multi-party check was endorsed by XXXX and sent to Fay Servicing, which placed the funds into a restricted escrow account on XX/XX/XXXX. I am submitting this complaint regarding Fay Servicing, LLCs mortgage servicing practices and its failure to provide a complete and reconciled loan accounting. Despite multiple written requests, Fay Servicing has not provided an accounting that explains how payments were applied over time, how default interest and monthly payment amounts were calculated, or the basis for fees and corporate advances assessed. Instead, Fay Servicing has repeatedly provided un-reconciled payment histories that do not address these issues.
