I am filing this complaint because a background screening company has failed to provide my legally required Full File Disclosure under the Fair Credit Reporting Act ( FCRA ), despite confirming receipt of my request, receiving all requested identity documentation, and later stating that the disclosure was completed. On or about XX/XX/2025, I received an adverse action notice from an employer stating that a background report prepared by this company was used in whole or in part in an employment-related decision. Under FCRA Section 609 ( d ) ( 15 U.S.C. 1681g ( d ) ), I am entitled to receive a free copy of the consumer report used in that adverse action. I submitted a written request for my Full File Disclosure by Certified Mail in early XX/XX/2025. On XX/XX/2025, the company emailed me confirming that they had received my certified-mail request and advising that additional identity verification documents were required to process the disclosure request.

I previously disputed these records, but First Advantage failed to verify or correct them, violating FCRA 607 ( b ) ( duty to ensure maximum accuracy ) and 611 ( duty to reinvestigate disputes ). I've had issues in the past whenever I apply for jobs and a background check is completed because it lists an inaccurate record. That record shows that I had a felony or misdemeanor from the Oklahoma XXXX XXXX XXXX XXXX in XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX and the case date is listed as XX/XX/XXXX. The case file is XXXX and before this my background check would also list a different inaccurate charge from the XXXX XXXX XXXX XXXX XXXX XXXX State of Oklahoma which that case number is XXXX. I've looked at the official court documents of these cases and the individual charged for both of them has the same first name, last name, and birthday as myself. I have never been to jail or have been in trouble with the law besides minor speeding tickets.

To Whom It May Concern, I am submitting this complaint because a consumer reporting agency has included criminal background information on my report that is older than seven years. This information is being reported without my consent and in violation of the Fair Credit Reporting Act ( FCRA ) and Texas state laws regarding background reporting limitations. Recently, I obtained a copy of a background check that was run on me, and I discovered that criminal records from more than seven years ago were included. These records should not legally be reported for employment purposes in the state of Texas when they are older than seven years ( unless they involve specific exceptions, which do not apply in my case ). I did not authorize the release or reporting of this outdated information. Because of this inaccurate and unlawful reporting, I am experiencing negative consequences that are affecting my employment opportunities and causing significant stress.

I have an immediate job offer that requires a clean background check to be completed by XX/XX/2025. The continued reporting of this legally expunged conviction is preventing me from starting work and is costing me wages I desperately need. First advantage refuses to verify start and end dates for companies I worked for over 5 years ago, and my most recent previous employer. It is putting a hold on this current job opportunity because they can't seem to do their job and verify employment with previous employers despite me providing w2s for all jobs. I was told my background check went through yesterday, only to receive an email today saying they want me to provide these start dates. I thought background checks companies were supposed to find this information with the information I provide. Such as w2s. Names. Employer information. I might as well be getting paid to do their job. If I lose this job because they can't do theirs I will be seeking a lawyer.

First Advantage, a consumer reporting agency, disseminated a background check report to XXXX, a prospective employer, on XX/XX/year>, which included a criminal conviction from XXXX XXXX. This conviction was subject to an order of expungement, legally effective on XX/XX/year>. The reporting of this expunged record is contended to be in contravention of applicable expungement statutes, specifically N.J.S.A. 2C:52-1 et seq., which mandates that once an expungement order is granted, the arrest, conviction, and any proceedings related thereto are deemed not to have occurred. Consequently, the inclusion of this expunged information in a background check report after the effective date of expungement may constitute an impermissible disclosure of sealed records and could potentially violate the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681 et seq., particularly concerning the accuracy and permissible scope of information reported by consumer reporting agencies.

First Advantage reported an eviction linked to a case involving " XXXX XXXX. '' This is incorrect. The case was not an eviction it was a XXXX XXXX case, which I confirmed by obtaining a certified disposition directly from the courthouse. I have provided this documentation to First Advantage multiple times. I filed a dispute with First Advantage the same day the denial occurred. Since then : They have not provided me with a full copy of my tenant screening report, despite multiple written requests. They have not corrected the false information, even after receiving certified court documents. They have not provided any meaningful investigation or response beyond generic replies. They continue to report false information that is preventing me from securing housing.

After 2 months of waiting for my split sample to be tested, I called them to find out what was going on. After being put on hold several times and on the line for close to an hour the lady says the XXXX would call me the next day. Well the XXXX does call the next day and tells me the split sample was tested a month ago, and it took them another month to get me the results. She stated if I had any further questions I need to consult with my employer, and before I could ask any more questions she hung up on me. I ordered the test results to see for myself and it shows the test was received verified and reported all on the same day I called, the day before. If they tested the sample two months after the original test it would have been degraded therefore do not trust their results.

I have been in my home 23 years, I have an XXXX + credit score. I have 2 paid for cars, I have 3 banks, and I own my own business, very minimal debt .. like XXXX dollars. I have TSA security clearance and I have not had so much as a traffic ticket in 17 years ... and I cant get a job at XXXX... LoL! yea right.... This company is reporting false information or have someone else with the same names report. The Law says I can sue for this company doing this. This company needs to get the information needed by the right person for the right application or service needed. I do want this company investigated because I know they have done this to more people than me. Thank you.
