I was sued and not properly informed. I found out that the XXXX courts got alternative delivery proposal approved. They left a summons on my old address door that showed personal and loan information. The new resident got in touch with my old landlord and he got me in touch with them. then they lied to the courts when they did this to manipulate the courts for garnishment.

I am submitting this complaint regarding an alleged remaining garnishment balance being pursued by Gurstel Law Firm that appears inaccurate and has not been validated despite multiple written requests. Timeline of Events : XX/XX/XXXX Wage garnishment began through my employer pursuant to a judgment totaling {$1500.00}. XX/XX/XXXX through XX/XX/XXXX Garnishment payments were withheld from my wages and remitted by my employer. Total payments made toward the judgment equaled {$1700.00}, exceeding the original judgment amount. XX/XX/XXXX My employer received a new garnishment notice from Gurstel Law Firm claiming an additional balance of {$520.00}. This was the first notice I received indicating any remaining balance. Prior notices had been sent to an address where I have not lived for over XXXX years.…
I sent an email to Gurstel Law Firm disputing the amount of a debt they are trying to collect. I submitted the dispute within 30 days and received a huge packet of documents the original creditor sent them. None of the paperwork validates the amount they are asking for, which I believe is wrong because I was making payments on the account before it closed. The balance sheets they provided have an amount higher than what theyre asking for, which also makes me believe not all of the payments I made got accounted for. I sent two additional emails to Gurstel explaining the paperwork I received from them doesnt validate the amount but have not gotten another response. Ive now found out they are suing me for this disputed amount.

When contacting Upgrade Account, having a BALANCE still due and being inaccurate, the representative keeps on giving me XXXX Number to settle the debt, and XXXX is saying they transferred the debt to Gurstel Law Firm to contact them, Gurstel law Firm says my case is closed and contact the original creditor, I keep getting run- arounds and no solutions being made. Dear Gurstel Law Firm, I am writing to formally request both verification and validation of the alleged debt you claim I owe, in accordance with my rights under the Fair Debt Collection Practices Act ( FDCPA ), Section 809 ( b ). Verification and validation are distinct legal concepts, and I demand that you provide both. Verification is the process of confirming whether I actually owe the debt, as referenced in Chaudhry v. Gallerizzo, 174 F.3d 394 ( 4th Cir. 1999 ). According to Blacks Law Dictionary, verification is defined as an averment that the party pleading is ready to establish the truth of what he has set forth. The examination of a writing for the purpose of ascertaining its truth ; or a certificate or affidavit that it is true. In McDonald v. Rosengarten, 134 Ill. 126, 25 N.E. ( 1890 ), the court explained that verification involves the " confirmation of the correctness, truth, or authenticity of a pleading, account, or other paper, by an affidavit, oath, or deposition.…
Gurstel Law Firm , P.C . sent letters and made multiple phone calls attempting to collect a debt supposedly owed to XXXX XXXX XXXX between XXXX of XXXX through present. I had made multiple attempts to get validation on the debt, as I do not owe it. They failed to due so each time. They were then sent a cease-and-desist order. Despite the cease-and-desist they continued to contact me until we went to our first hearing in court. They were ordered to do an investigation by the judge in XXXX of XXXX. This has been delayed 4 times now due to them being unable to provide any documentation to validate the debt. They also recently, again despite the current cease-and-desist, sent me yet another letter dated XX/XX/XXXX, received XX/XX/XXXX. I have submitted a motion to dismiss to the court for this reason, but XXXX XXXX XXXX XXXX. has continued throughout this time to contact me, delay, and fail to provide any documentation that validates the alleged debt to the court and myself.
XX/XX/year> I called to pay the amount that was mailed to me so that I can be done with this. It took me more than 2 months to save the {$3000.00} that the XXXX said I needed to pay. When I called they Gurshel Law Firm debt collector employees said that I needed to pay {$4400.00}. This has gone on for way too long and they keep doing this. I have called to try and pay multiple times and they always say something different. The lady I spoke to threatened me with wage garnishments. I got really upset because I called to pay not to be threatened. That it when the supervisor got on the phone. He did not mention the wage garnishment. I always feel like they want to keep me in this XXXX loop. This needs to stop. I am going to start looking for legal counsel to sue for financial XXXX and XXXX XXXX This is still going after XXXX years.
To Whom It May Concern, I am submitting this complaint to report violations of multiple federal statutes in connection with the furnishing and reporting of information related to the above-referenced account, allegedly originated by XXXX XXXX XXXX XXXX, with Gurstel Law Firm acting on its behalf. # # # Inaccurate Furnishing of Consumer Report Information Pursuant to 15 U.S.C. 1681a ( 2 ) ( A ) ( i ), a consumer report does not include information solely as to transactions or experiences between the consumer and the person making the report. I have had no direct transactional or experiential relationship with Gurstel Law Firm. Therefore, any reporting of payment history, charge-off status, or debt-related information by or through Gurstel Law Firm lacks a lawful basis and is inaccurate by definition. Further, 15 U.S.C.…
I'd like to thank Gurstel Law firm for their willingness to resolve this issue under CFPB complaint XXXX. From their responce arises a secondary complaint under this case number. In Gurstel 's response, they would have you belive that I had two debts with XXXX XXXX. Gurstel alleges that I resolved one of debts, but not the one they were seeking legal remedies for. It should be noted that from the receipt I received from Gurstel ' s website, only one debt was listed. If Gurstel 's allegations are alleged to be true, it would mean Gurstel pursued a judgment on a debt that I was not aware of, and was not given an opportunity to dispute the debt in the following ways : 1. Date account was open 2. Account ownership 3. Amount of debt 4. Whether or not the account held discharge status Prior to the judgment, I only received one demand letter which was on the debt I resolved. It's my belief that in Gurstel 's confusion, they neglected to afford me the right to dispute this debt.
I am filing this updated complaint because XXXX XXXX, the credit bureaus, and now a third-party law firm ( Gurstel Law Firm , P.C . XXXX are reporting and attempting to collect on inaccurate, unverifiable, and inconsistent information. The original creditor can not validate the accounts, XXXX did not validate the debt, and the credit bureaus falsely marked the XXXX account as verified. This complaint includes new evidence : XXXX deleted one XXXX account but left another related account on my report, proving the data associated with this debt is inconsistent and unverifiable. XXXX. XXXX XXXX received my validation request but never validated the debt. I mailed XXXX XXXX a debt validation letter. It was NOT returned, proving XXXX received it.…

defaulted on agreed amount in XX/XX/year>. Asked for help but no offer was given. I then forgot about the account and 5 months later I am being served with a garnishment. I never received mail about the default to include a certified letter about being sued. The letter that they sent was in regular mail with their court filings. When I try to call and settle the account the only offer they are willing to do is 10 % of the initial owed of XXXX which the original balance was XXXX.
I reached out to this law firm today because I have been waiting on some type of male communication from them. I had received a call from the law firm a couple months ago or even a few months ago and they have requested to speak to myself, but by my maiden name which I had not been going under for the last XXXX years. Due to the increased rate of scams going on, I opted not to verify any personal information if they could not provide me with the correct name that I would be going under. They stated that because they could not verify my information over the phone that they would continue to try and contact me by mail. Please note that I have never received anything from them by mail and have still not received anything from them by mail after the phone call. I did however, reach out to them multiple times trying to make contact to see if there was any follow up or if there was anything I needed to do but received no communication from them whatsoever.…

I am writing to file a formal complaint against Gurstel Law Firm regarding persistent, aggressive, and improper debt collection practices that I believe violate the Fair Debt Collection Practices Act ( FDCPA ). Gurstel Law Firm has contacted me repeatedly about several debts they allege I owe. Despite my attempts to dispute and request documentation, they have failed to provide verification or any supporting records. Instead, they have continued their collection efforts, often with multiple representatives contacting me independentlyeach unaware that I had just spoken to someone else. This indicates poor internal communication and creates a pattern of harassment. Additionally, despite my dispute, Gurstel Law Firm proceeded with legal action. The court date was changed without notifying me, resulting in a judgment and subsequent wage garnishment. I was denied the opportunity to appear in court or defend myself, which I believe is a serious procedural issue.…
XXXX XXXX XXXX is trying to collect a debt that originated from XXXX XXXX Bank. What is troubling is that I have not been provided with debt validation and they seem to be trying to collect the wrong amount. I had 2 credit cards issued by XXXX XXXX Bank that was charged off due to illness. The credit limits were between {$600.00} and {$750.00}. XXXX is trying to collect {$1200.00}

Just today XX/XX/year> knock on my door with a loud bang demanding I come to the door. Its was my XXXX XXXX said they were a debt collector. This is the third time and XXXX of my neighbors is a witness. I will give her name at a latter time. Also they come bye when XXXX not home like they are law enforcement. And contacting me by mail over and over it been 2 months this been going on. As im permanent XXXX.
I was contacted by Gurstel Law about a debt from XXXX. I was a XXXX in XXXX therefore the debt can't be mine. The validation sent to me was for complete different years and dates. Their contact letter is almost a legal document due to the nature of if I hadn't responded they could have entered a default judgement against me. I believe they send out wrongly represented debt letters in hopes of getting unexpected people to not respond.

After receiving a detailed report from XXXX XXXX XXXX, I read that this is a debt that started back in XXXX and was sold to XXXX XXXX XXXX XX/XX/XXXX. I called Gurstel Law Firm PC on XX/XX/XXXX to offer a settlement amount. I left a voicemail and they never returned my call. I believe they never called me back because they want to continue on this horrible path of threatening to garnish my wages. I would like to settle and cancel this once and for all. This company thrives on causing people fear and XXXX, keeping threats ongoing as long as possible and they are not proactive in trying to resolve these debts. I have called twice already trying to settle this with them but they do nothing to resolve this. I have also lost days of work to go to court and I could never find where the hearings are being held. They mail threatening court documents that mention that they can have this continue for 10 year with the signature of a judge yet nothing offering to put an end to this.…
This is complaint against Gurstel Law Firm. I already filed same complaint against XXXX and XXXX XXXX. Gurstel Law firm was representing XXXX XXXX who are debit collectors that purchased loan, I have no contract with them or know who they are. In XX/XX/XXXX, my original lender, XXXX XXXX XXXX XXXX ( XXXX ), issued IRS Form 1099-C reporting that my personal loan was canceled for {$3900.00}. The IRS accepted this 1099-C filing on XX/XX/XXXX, confirming the debt was treated as discharged for tax purposes. Despite that cancellation, XXXX or its affiliates later transferred or sold the same account to XXXX XXXX XXXX, which hired Gurstel Law Firm P.C. to collect through litigation. XXXX and Gurstel filed XXXX XXXX Superior Court case No. XXXX and obtained a writ of execution ( EJ-130 ) dated XX/XX/XXXX. This writ attempted to collect the exact account that had already been reported to the IRS as discharged.…
My recent interactions with Gurstel Law Firm concerning an alleged debt {$4500.00} Today, I received a letter from Gurstel Law firm stating the correct balance I owe, which is {$2400.00}. The letter also clearly stated that if I needed alternative arrangements or wished to make a payment or propose an offer, I could contact their office and that they would be happy to work with me. However, when I previously contacted their office via email, I was told that they would only settle for {$3900.00} and that I owe more on the balance. During that communication, your representative was unwilling to discuss alternative arrangements or accept a reasonable settlement. Following this, I called the agency ( Gurstel Law firm ) and spoke with XXXX XXXX. I explained my situation and referenced the letter I received, which I had also attached to my previous email. XXXX XXXX was extremely rude, refused to consider my settlement offer, and abruptly ended the call after only entering a dispute.…
