LoanCare sent me a letter about a month ago with instructions on how to set up a mortgage payment. I went on their app, created a payment for my first installment, then set up the auto pay draft so that it would come out every month on the XXXX, when the amount was due. This past Friday, XX/XX/XXXX, the LoanCare bank withdrew 2 months worth of mortgage payments. I called on Monday, XX/XX/XXXX to resolve this with their team ; which they informed me that I was indeed charged 2 month 's of mortgage. They then proceeded to tell me that I needed to provide proof that I've paid them 2 month 's worth of mortgage even though they confirmed the payments from my account have processed. They then explained that my request would be received and handled within 3-5 business days, and once confirmed they would process a paper check to be mailed back to me which would take 10-15 business days ( XXXX weeks in total ).…
Company : LoanCare , LLC Loan Number : XXXX Complaint : I am submitting this complaint regarding incomplete and inconsistent information provided by my mortgage servicer, LoanCare , LLC, concerning the ownership, transfer history, and authority over my mortgage loan. LoanCare has identified the XXXX XXXX XXXX XXXX ( XXXX ) as the owner of my loan and has also referred to XXXX in its capacity as trustee. However, they simultaneously state that : * There is no trust associated with the loan * There is no Pooling and Servicing Agreement or governing instrument * No assignment of the Deed of Trust has been recorded At the same time, LoanCare claims the loan is part of a specific pool, yet can not provide documentation supporting this structure. Additionally, LoanCare has stated they are unable to provide information related to prior servicing or transfers, limiting their responses to only what was forwarded to them.…
I submitted a Qualified Written Request ( QWR ) to LoanCare requesting all documents, records, and information related to the mortgage account being reported, including the complete loan file, original note, deed of trust or mortgage, payment history, servicing transfer records, escrow history, default and foreclosure records, correspondence logs, account ownership information, and all documents relied upon for reporting to the consumer reporting agencies. Because this account is disputed and associated with identity theft, I also requested records showing how my identity was verified and the basis for attributing this debt to me. To date, I have not received a complete and adequate response. The failure to provide requested records while continuing to report derogatory mortgage and foreclosure information is harmful and prevents me from fully disputing inaccurate information.
This company has been amazing to me first and foremost. I'm not out to bash destroy or make them look bad, feel like I did everything according to my trial payment plan for XXXX, XXXX, and XX/XX/year>. I've made the XXXX trial payments the first XXXX were made with out any trouble! Went to make the last one was which was still made on the last day of the month as the contract states. My mortgage payment is fixed at {$1100.00} per month until XX/XX/year>. However, beginning with my monthly statements, LoanCare increased my payment to approximately {$3400.00}, and later around {$1700.00}, then up again to around {$2000.00}, without giving me a clear or proper explanation. LoanCare later stated the increase was because they paid my property taxes on my behalf through escrow. This is incorrect. I lost my job. Never missed a payment in XXXX plus years. They gave me a 3 month forbearance. I'm still unemployed. They were supposed to automatically review my loan for modifications without me needing to tell them too. Thats the FHA guidelines for anyone over 90 days delinquent or anyone coming to an end of a forbearance. I talked to them last week and I asked them to do it. I messaged them asking to apply for it. They're supposed to get back to me telling me they received it request in 5 days. They haven't. And they're supposed to have the review done in 30 days post request. I still don't know if they got my request.
Loancare took over my mortgage in XX/XX/year>. The reassignment of deed is filed in the wrong county ( XXXX XXXX, should be XXXX ) and they never released the lien in XX/XX/year> when we paid the loan in full with a refinance. I am currently about to close on a heloc and the loan cares lien still exists on my home making it impossible to close.
I was accepted in the hardship assistance program with LoanCare around XX/XX/year>. I made XXXX 's payment and thought I enrolled in XXXX 's auto payment. When I logged in to check on the status of my mortgage, it said I couldn't pay anything online. I called and they said I missed XXXX 's payment and was kicked out of the hardship assistance. I called LoanCare and they said " oh hi, you owe {$25000.00} today how would you like to pay that? '' instead of asking the purpose for my call. When I explained to XXXX that I just want to make a payment and get caught up, they said they couldn't accept 1 months payment and I was 7 months late ( which is not true, I was in the hardship program ). LoanCare denied my application, stating that I do not qualify because I have made fewer than XXXX payments from the date of loan origination. This determination is inaccurate. Around XXXX of 2025 They repeatedly called my cell. I asked them to stop and had to fight them to do so. Evenetuall ythey stopped. Than randomly on XXXX They called me again trying to collect a debt. Well, there is a recorded satisfaction in the XXXX XXXX XXXX 's office Doc # XXXX states paid in full now there is also an Assignment recoded on XX/XX/year> from LoanCare XXXX XXXX # XXXX and continues to assert a balance and attempt collection. I sent a Notice of Error and cease and desist via certified mail ( receipts pending ), but LoanCare failed to reasonably investigate and provide inconsistent information. This is the second complaint that I have had to file against this company through the CFPD. My mortgage was sold to them and they have miscalculated my escrow. They paid my insurance company upfront, and after that I switched to a cheaper insurance provider. They then paid the new company and left me with an escrow shortage, which I completely understood. After my insurance company refunded me, I added {$2000.00} to my escrow on XX/XX/XXXX along with my mortgage payment of {$1900.00}. Since then my mortgage has jumped from {$1900.00} to {$2700.00}, with {$1300.00} going into escrow. By the end of the year, I will have paid {$15000.00} plus the {$2000.00} I added, making it {$17000.00} JUST in escrow. There is no math that can be performed where that makes even a bit of sense. I am submitting this complaint regarding the credit reporting of my mortgage account serviced by LoanCare. In XX/XX/year>, a payment on my mortgage account was reported as late. This occurred due to an unintentional error where the payment was submitted from an incorrect account that did not have sufficient funds, while the intended account did have sufficient funds available. Once I became aware of the issue, I promptly corrected it and brought the account current by making consecutive payments in XX/XX/year>. Since that time, I have continued to make all payments on time. Prior to this, I maintained several years of consistent on-time payment history with no prior late payments. This was a one-time isolated incident. My mother got a phone call saying I missed a mortgage payment. My mother XXXX XXXX is not on my loan through Loancare Servicing company. They gave her all my information.
