I am disputing a loan issued through Mariner Finance that was used to finance a XXXX water softener installed in my home in XX/XX/year>. Since installation, the system has repeatedly failed to perform as represented. The water is not consistently softened and continues to have odor issues despite multiple documented service complaints and repair attempts with XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, Florida ). Due to the continued nonperformance of the system, I requested cancellation of the agreement and removal of the equipment. XXXX has not honored this request and has refused to retrieve the equipment. Because this loan was arranged through the vendor for the purchase of this product, I am disputing the validity of the financing associated with this transaction. I have requested that Mariner Finance place the account in dispute status while the vendor issue is resolved.

At the time of sale, I was verbally promised XXXX months no-interest financing by the contractor XXXX XXXX representative. I agreed to move forward with the project based on those specific terms which was from Mariner Finance. However, the loan that was ultimately processed does not reflect the terms that were presented to me. The financing agreement differs from what was clearly explained prior to signing. Additionally, there were concerns during the signing process, including being asked to re-sign documents through XXXX, which raises further concerns about whether the terms were properly disclosed and agreed upon. I believe this situation involves misrepresentation and potentially deceptive sales practices, as I relied on the information provided to me in good faith when agreeing to the financing.

Although, Im currently making loan payments. I have refinanced in the past. The regional manager XXXX had my XXXX credit pulled, and my score was XXXX, but didnt approve the refinance. So, I attempted to make a debit payment online, and discovered for the first time ever the make payment button was red. Next, I attempted to pay through the phone automated system, and my payment was denied. Eventually, I reached a representative XXXX in Texas, and was advised my account was locked. My account is paid in advance for more than XXXX months, and I need to continuously make payments online. The regional manager XXXX did not inform me, that he was locking online, and phone automated access to make payments.

During the sales process I was encouraged to enroll in the program, and financing was presented as part of the signup process. I did not clearly understand that I was applying for a loan. I believed I was simply enrolling in a business program. I later discovered that a loan had been issued through LendingPoint for approximately {$9800.00} with aXX/XX/XXXXinterest rate, resulting in total payments exceeding {$18000.00} over time. Took out a personal loan with a lien against our car. Was unable to repay entire loan. The company then " sold the loan and all rights and interest to it ''. They did not remove the lien. The debt collector the creditor sold the loan to took us to court. We argued that because they sold the loan the lien shouldn't exist either. The judge agreed and ordered that we could sell or transfer the title and that the original lien was no longer valid. We called the original creditor to ask them to remove the lien. They told us no. That they legally owed the lien until the debt collector reported 95 % of the debt repayed. There is nothing in the sale contract that states that they still have the right to hold a lien. This is a clear violation of law and they're using it to strong arm consumers. We informed them that they sold the debt, title and ALL interest in the contract and that a judge stated the lien was not valid. They had us email the court paperwork to their legal department.

I am submitting this complaint regarding Mariner Finance , LLC and their refusal to properly investigate and remove a fraudulent account from my name. I reported to Mariner Finance that an account in my name was opened fraudulently. I did not open, authorize, or benefit from this account. I disputed the account and provided information supporting my claim of identity theft. On XX/XX/year>, Mariner Finance sent me a letter stating that their investigation was complete and that they were unable to verify fraud. They stated the account would no longer be reported as disputed to the credit reporting agencies and that I remain responsible for the debt. I believe Mariner Finance has failed to conduct a reasonable investigation as required under the Fair Credit Reporting Act ( FCRA ). I requested that they review the documentation used to open the account, including the original signed contract, application information, IP address records, and any identifying details.

I was approved for a personal loan with Marinaer Finance. I was approved online for a loan of {$1000.00}. I have all the messages and I called yesterday XX/XX/year> to confirm. I set an appointment with a loan XXXX and when I did I asked her again? If she was sure it was % XXXX approved. I asked her what I needed and she swore just me!!!! I got there at XXXX she asked if had a debt card. She was going to have the funds deposited on to it. I didn't have XXXX, I could use at the time. She said it was ok, because she was just going to print the check. Then she asked her coworker or XXXX to look it over. The woman she asked then tells her to that I needed to use my Deed for my Mobile Home as collateral. This is a violation. I was very angry and I told them they were falsely misinformed about civil rights. I walked out and when I tried to file a complaint at the XXXX XXXX website, the agent I spoke with was also extremely rude towards me.

During that call, after I stated it was not a good time to talk, the representative attempted to discuss my delinquent auto/title loan account and stated that if I did not make a payment the account would be sent to attorneys for wage garnishment. This statement appeared intended to pressure me while I was at work. On XX/XX/year>, Mariner Finances repossession agent, XXXX XXXX appeared at my workplace. The agent entered the dealership and spoke with XXXX of my sales employees. He asked for a finance manager to turn in a repo he had done for us and asked employees to locate me by first and last name, disclosing that my vehicle was also up for repossession.

The account was charged off in late 2023, yet Mariner Finance continues to update the balance and delinquency status into 2025. The tradeline reflects the account as written off while still reporting it as past due, which is contradictory. Additionally, partial payments made prior to charge-off are not accurately reflected in the reporting. A charge-off is a one-time accounting event. Continuing to update a charged-off account with rolling delinquency and balance changes is misleading and XXXX constitute re-aging. The reported balance has not been clearly itemized to explain post-charge-off changes. I disputed these inaccuracies through the credit reporting agencies. Despite this, Mariner Finance has continued to furnish the same inaccurate information without correction or explanation.

During this time I requested numerous settlement offers. The branch closed abruptly and I was no longer able to make payments. However they have continued harming my credit. I finally after months of trying, got in contact with someone who told me my account was now {$7000.00} and was still interest bearing. However when an account to charged off and becomes a judgment interest is no longer accrued.
