I signed up with National debt relief in an effort to improve my credit. After a year of being told that I was building up a " savings account '' that would be transferred to my debt after settlement. After reading many negative online reviews for this service. I called to then cancel my service. I am filing this complaint regarding National Debt Reliefs handling of my account and what I believe to be a material misrepresentation of a payoff amount. During a recorded phone call with a National Debt Relief representative in XX/XX/year>, I requested the total amount required to fully close out my account. I asked multiple times whether the quoted figure represented the final amount necessary to be completely finished. I was led to believe that it did. I stopped my payments, my credit is now destroyed, and I still have debtors I originally informed NDR about. My 27 months is almost up and there's no way that they gave me the correct deposit and monthly payments, XXXX had hired their legal team option, but they didn't get the info I was sending to them about being sued. They have done nothing about the lawsuit against me. They asked me to sign another contract with the debtor that is suing me. I am a client of National Debt Relief ( NDR ). On XXXX, NDR collected a negotiation fee of {$1300.00} and {$82.00} on XXXX for my XXXX account ending in XXXX. This fee was collected without my consent and in direct violation of the FTCs Telemarketing Sales Rule ( TSR ) regarding advance fees. An automated AI/computerized system called me with a settlement offer, which I explicitly rejected. However, the system incorrectly recorded my response as an acceptance. Despite my immediate notification that I did not approve this settlement, NDR has refused to refund the fee to my Dedicated Savings Account. Instead, they are attempting to hold my funds as a 'credit ' for future services. Per the TSR, a debt relief fee is not earned until a settlement is reached, the client has expressly authorized it, and at least one payment has been made. None of these conditions were met. So I called canceled credit sage and contacted my bank to get a refund, it is still in the process. He claimed to be Debt consolidation and had all of my information but how I cute them thanks to XXXX, if I asked him for his ID number to verify the it was legit. I contacted National Debt Relief to negotiate and settle payments with 7 creditors but only 2 has been paid off since XX/XX/year>. They settled for XXXX and the other XXXX. I have paid National Debt Relief XXXX for the past 2.5 years. I am currently paying them monthly to pay only two creditors who National Debt pay one creditor XXXX and the other XXXX monthly. I am disappointed that 4 other creditors are sitting on the program who has not been contacted.
I am submitting this complaint as a follow-up because National Debt Reliefs prior response did not resolve the issue or provide restitution. National Debt Relief charged me fees before providing a completed, valid settlement agreement in accordance with the Telemarketing Sales Rule ( 16 CFR Part 310 ). Approximately 2 to 3 months ago I reached out to National Debt Relief actually I was trying to apply for a loan and was redirected to them and signed a contract with them that went against everything they told me to write down that they were providing the services for.
