A collection account was reported to my XXXX credit report by Nationwide Capital Services on XX/XX/year> for {$820.00} ( original amount {$500.00} ). I have not received a written notice from Nationwide Capital Services explaining my right to dispute and how to request validation. I have difficulty with verbal communication and can not resolve this by phone, so I attempted to contact the collector by email to dispute and request validation, but the email address I tried was not valid and my message bounced. I asked the original lender ( XXXX XXXX ) to provide a working email for the collector, but I still do not have a working email contact. I am requesting a proper written validation notice and a written method to dispute/validate, and that the account be marked as disputed and corrected as appropriate.

A consumer installment loan was originated by XXXX XXXX to a New Jersey resident. The Truth-in-Lending disclosure on the loan agreement states an APR of 218.1667 %. Under New Jersey usury law, the maximum legal interest rate is 30 % for consumer loans. I believe this loan may be void or unenforceable under New Jersey usury law as it exceeds that cap by over 600 %. I dispute that any amount is legally owed on this account. XXXX XXXX subsequently sold this account to Nationwide Capital Services without prior notice to the consumer. The account was reported to XXXX on XX/XX/year>. The consumer was not notified of the sale until XX/XX/year>, after the account had already been reported to the credit bureau. Nationwide Capital Services has engaged in collection activity ; however, I did not receive a written validation notice within five days of initial contact as required under the Fair Debt Collection Practices Act ( 15 U.S.C.

I am here to file a complaint against Structured Settlement Collection/ NATIONWIDE CAPITAL SERVICES LLC . There has been multiple violations of my consumer rights from this company. First of all, the agency has provided XXXX inconsistent and conflicting information regarding the amount owed. I was given XXXX separate balances. One of {$700.00} and another of XXXX. This has caused not only confusion but it makes it diffuclt to verify the legitimacy and accuracy of the debt. They also have not sent me any form of formal letters in the mail about this. I only got a formal letter on my email AFTER asking for proof. Second, I have experienced repeated and excessive phone calls from XXXX different women that I consider to be harassment. The frequency and persistency and tone of these ladies voices has cause an unnecessary amount of stress to me. " XXXXXXXX XXXX '' tone became extremely aggressive and threatening. The company call me from numerous phone numbers with my area code. I picked up once because my phone does not pick up unknown numbers but a voicemail was left for me and I listened to it. I am not used to debt collectors and how they work but the way they were describing the trouble I am in and that I was being sued by a company from a loan from 2024. Structured settlements told me that I would need to put down a downpayment and that the next day I would have to start making payments. When I told the lady I do not have anything to put down as of yet she said she will wave the fee for the down payment but I would have to add a card on file. They called me again, this time saying " I'm currently conducting an audit on your file in our office. And some of the notes kind of put you in a negative light. I wanted to give you an opportunity to respond on your own behalf and let me know if there's anything you would like me to take into consideration before turning in my recommendation.

On or around XX/XX/year>, I contacted a representative of Nationwide Capital Services and formally requested validation of an alleged debt being reported on my credit file. During that call, the representative confirmed that written validation would be provided and sent to me via email. As of the date of this complaint, I have not received any validation documents, itemization, or supporting evidence regarding this alleged debt. Despite the absence of validation, the account continues to be reported to the credit bureaus as an open account with a balance of {$1000.00}.

The account was sold to a collection agency, Nationwide Capital Services, who reported me owing {$980.00}.. I learned of this company after it was reported to the credit bureaus. I have sent many letters to Nationwide Capital Services or Structured Settlement or whatever they call themselves since XXXX of XXXX. Nationwide either ignores the letters or outright refuses to respond. None of the letters have received a reply. I received a call from a representative on XX/XX/XXXX, and the representative insists that I make agreements or concessions on the phone. There seems to be a nefarious tactic here where if a person insists on written communication, Nationwide outright refuses to communicate or becomes evasive. I asked the rep that I require a commitment from Nationwide in writing that this collection account will be deleted from my account when the account is paid in full. She was evasive and made many excuses, including that the person who has the ability to send emails is out of office.

I am filing a complaint against National Credit Services LLC regarding an alleged debt they claim I owe. This account originates from a loan with an APR exceeding 400 %, which appears to be a predatory lending product. I am a resident of Georgia, where payday lending and excessively high interest rates are heavily restricted or prohibited. I formally requested validation of this debt, including proof of licensing to lend and collect in Georgia, a complete chain of assignment, and documentation showing how such an excessive interest rate complies with applicable laws. The response I received did not provide sufficient evidence to validate the debt under the Fair Debt Collection Practices Act ( FDCPA ). Additionally, the company continues to attempt collection and/or report this account to credit bureaus without providing adequate validation, which I believe may also violate the Fair Credit Reporting Act ( FCRA ).
