I took out a personal loan on XX/XX/year>. The loan was for {$3000.00}. I discovered that the rate was 159.33 % on loan number XXXX. I reside in TX and the maximum rate is 12 % At the end of the loan, I would have paid {$5300.00}. This is not an installment loan. It is a payday loan. The company asks you when you get paid and then your payment due dates are set around that unless you request a different date. I am deeply concerned that I have been subjected to predatory lending practices. I am requesting that the CFPB investigates the actions of this lender as this payday loan should be void. I am also seeking relief from further collection activity related to this loan.

I received a {$1400.00} loan with an APR of 159.79 %. North Dakota law caps consumer loan interest rates at 36 % unless the lender is properly licensed. Opportunity Financial , LLC ( OppLoans ), which services and controls this loan, is not licensed in North Dakota. Although XXXX XXXX Bank is listed as the lender, OppLoans performs the primary functions of the loan, including servicing, payment processing, and customer interaction. This indicates a true lender structure designed to bypass state interest rate limits. I have paid a total of {$1600.00} toward this loan. However, only {$390.00} was applied to principal, while {$1200.00} was applied to interest. In at least XXXX instance, 100 % of my payment was applied to interest and {$0.00} to principal.

On XXXX XX/XX/year> I received a call from XXXX, I answered and the person said can I speak to XXXX I said who is this and they stated let me get your information first before I go further, the person did not disclose or tell me they was Opp Loans. They did not tell me this until getting my information. The male on the phone was very disrespectful and rude when I told him I disputed the debt and I wanted debt verification in writing and proof that he had the legal right to collect this debt. He kept using an abusive tone and saying what proof, what proof, we don't have to proof anything your name is on this loan. He threatened me with charging more interest every day and threatened me with a 3rd party debt collector. He was very abusive toward me with the tone and manner of his voice. I asked him multiple times to mail me verification or proof he had the right to collect on this debt, he refused and said he wasn't going to go back and forth with me and hung up.

They currently take a payment from me of {$66.00} every week when I get paid. They stated they do this as they want the payments from your paycheck from your employer. I have placed stop payment on them as I have found illegal terms of this loan and dispute it. When I applied for the loan they advertised their self as XXXX XXXX, when disputing this they stated they are operating under a XXXX Bank in Utah. I disputed that the interest rate in Virginia for unlicensed lenders such as there self is 12 % under usury law, they stated they are following Utah Law as they use XXXX bank. They are charging 178.29 % interest.

In XX/XX/XXXX, I requested and was granted a one-time payment extension, with the understanding that the missed payment would simply be added to the end of the loan term. Since that time, I have made all required payments on time and remain current on the account. However, when I contacted OppLoans this week to ask why my remaining balance was still {$1600.00} despite the listed maturity date of XX/XX/XXXX, I was informed by a representative that the entire remaining balance consists of interest related to the single extended payment from XX/XX/XXXX. This explanation is concerning because I was originally told that the missed payment would be moved to the end of the loan. Instead, OppLoans appears to have charged interest on that payment for nearly two years without ever providing me with an option to repay the extended amount directly.

I have tried to dispute this multiple times to no avail so I will wait out this process because I can not pay something I know. The problem that I have I feel Comfortable letting this stay on my credit report but what I do not like is this company keep changing dates that the account was closed the first time it was supposedly closed was back in XXXX but now Im looking and the account was now closed on XX/XX/XXXX I do not believe a company should be allowed to keep switching dates around to try to hurt people which is exactly what they are doing this is fraud. they need to remove this from credit report immedaitely are stop commiting fraud

I have been unemployed and looking for work since last XXXX ( XXXX ). Prior to that I was struggling financially and requested hardship and settlement information from the company. They denied to offer me any settlement or hardship assistance at that time and told me my account needed to be charged off. I called again today, informing them of my hardship and asked for a one time settlement to close the account. They refused my offer and said they would not lower my settlement offer despite having already paid back the full amount borrowed. The company has predatory interest rates that take advantage of people in hardship, and then tell them their account needs to be charged off before they'll even offer any settlements. I borrowed {$1200.00} I have already paid back the full {$1200.00}. The settlement is all interest, which has left my balance remaining at {$890.00}. The APR is predatory at nearly 25 %.

I get paid monthly ( commision based income settled on the XXXX of each month ) Repayment was to start on XX/XX/XXXX. The lender set my account on bi-weekly paments and auto-pay in error. I immediately called them and canceled both auto-pay and bi-weekly payments. Opploans agreed to their error and sent me an acknowledgement email to that fact. Here is the problem, they are alleging that the payment was to commence on XX/XX/XXXX. If that would be true, that would make the XXXX payment due 12 days after funding. That is not what I agreed or discussed. They allege I agreed to this on a recorded call. This is not true. I have emailed them and made my position clear that I will not commence payments until XX/XX/XXXX and demanded they correct their record to not reflect me as past due. The refuse. In an abundance of caution, I have limited communication to email only.

After deciding against refinancing the loan in XXXX of XXXX, I have been unable to access my payment portal for my open loan, I can only see information for the canceled refinance. I can access contracts and view payments, but there is no way for me to make a payment or change payment information. I have called several times to get this fixed. At first the only affect of not being able to access the portal was that I was unable to make extra payments to pay the loan off faster because my loan was automatically drafted from my bank. When I changed banks, I tried again to get help accessing my portal. I tried in XXXX, XXXX, and XXXX when I received emails that my payment was returned ( because I changed banks ). I called again today which is XX/XX/XXXX because I received notice that I have been reported to the credit bureau for non payment. I was told today that there was no correspondence noted in their system since XXXX.

I provided sensitive information such as my name, address, income details, and possibly my Social Security information, and I do not feel confident that my data is being properly protected. I called to make a payment on XX/XX/year> since I knew my autopay payment would decline. I was hospitalized all that week and was unable to update my payment information in time so I called in to make a payment to ensure it wasnt late. The money was taken from my account but today I got an email that both the autopay and my payment were reversed and my account was past due. The first person I spoke with wouldnt help me at all. I called my bank and they confirmed it was not reversed. I called Opploans back immediately and spoke with someone else who did tell me that it was an error in their system. HOWEVER they would not reverse the additional interest accrued on my missed payment. These crooks are already illegally charging me over 150 % interest and then are no help and take even more money from me. They need to be investigated.
