I am filing a complaint regarding an alleged debt being collected by Penn Credit Corporation. I have received collection notices regarding toll charges tied to license plates and/or a vehicle that I no longer owned or possessed at the time the charges were incurred. The collector is attempting to collect a balance of {$2700.00} without providing sufficient proof that I was responsible for the vehicle at the time of the alleged tolls. XXXX XXXX XXXX, the previous electric utility provider I had in Arizona, filed a collection against me WITHOUT informing me that I had an outstanding bill. I moved out of the state and they did not generate the bill until long after I had left. I did not learn of the collection until I applied for a mortgage. Upon learning, I quickly called and paid the bill in XXXX of 2024. I was told that it would NOT affect my credit score. It did. I have not missed a single payment in my entire life. Not once. This collection dropped my credit score down to XXXX, resulting in us not being able to afford the higher payment we were quoted for a mortgage. I disputed it with all three credit bureaus and those are pending currently. I am making this complaint before I sue them. I work as a compliance officer for a bank, and can not believe a utility company is permitted to do this to someone.

They have still failed XXXX remove the claim from my credit reports XXXX have not provided any of the requested information XXXX date. This has resulted in my XXXX XXXX dropping from over XXXX XXXX around XXXX, all while I am attempting XXXX purchase a new automobile.

XXXX XXXX started harassing me last year when they sent me unpaid toll violations dating back to XXXX of 2022, including time when I was in a hospital. They sent me several notices over the course of the first few months of last year until the fall stating that I had been running tolls that took place while my vehicle was out of commission. Every date mentioned was on the same date every month for a period of XXXX months or so. I still obliged and paid in full using their online portal. After I did that- not even a month later- I received ANOTHER request to pay for a ANOTHER license plate after I voluntarily relinquished my car just to avoid any more fees. They called me and told me that I had to pay THAT DAY, THAT THEIR Client - XXXX XXXX was in the office and wanted an answer that day. For all dates they claimed I violated, they attached accommodating fees for notices I NEVER received by mail.

I am filing this complaint regarding a debt collectors failure to properly respond to my dispute in accordance with the Fair Debt Collection Practices Act ( FDCPA ) and applicable consumer protection laws. Penn Credit Corporation is attempting to collect a utility debt on behalf of XXXX XXXXXXXX XXXX XXXXXXXX despite the fact that this alleged account was previously identified as identity theft and permanently blocked and removed from my nationwide consumer reporting agency disclosures pursuant to 15 U.S.C. 1681c-2 ( a ). XXXX XXXXXXXX XXXX XXXXXXXX received actual notice of my identity-theft status when the consumer reporting agencies transmitted the identity-theft block and removed the tradeline, confirming that the account was fraudulent and derived from compromised personal identifiers. The service address Penn Credit relies upon is not an address I have ever resided at or authorized service for and is itself a fraudulent address resulting from identity theft. Notwithstanding this actual notice at the creditor level, Penn Credit initiated new collection activity using the same compromised identifiers and treating the matter as an ordinary consumer debt.

During the call, they discussed details about the debt ( cost ) and asked her to verify my personal information, including my address and phone number. My grandmother is XXXX and has XXXX XXXX, and she was not able to meaningfully verify this information. I believe this is a violation of the FDCPA because debt collectors are prohibited from disclosing or discussing debt information with third parties other than the consumer, the consumers spouse, or the consumers attorney. They also may only ask for minimal location information, not verification of identity details, which they unlawfully attempted in this call. I am requesting that the CFPB investigate this practice by Penn Credit and take appropriate action.

Please take into account that I never received a debt validation notice.
