I am filing this complaint regarding Pennymac Loan Services and their failure to reimburse me after a confirmed escrow servicing error. Pennymac previously used an incorrect parcel ID on my mortgage account and paid property taxes for the wrong property for two years. After escalation, they corrected the issue and issued payments to the correct parcel. However, due to the urgency of selling my home, I personally paid the XXXX property taxes out of pocket on XX/XX/XXXX, to avoid any delay in closing. The XXXX XXXX XXXX Collector has confirmed the following : My personal payment was successfully applied to my account. Pennymacs payment was returned on XX/XX/XXXX because the taxes had already been paid by me. Despite this, Pennymac has not reimbursed me for the out-of-pocket payment I made to resolve their error. I have already contacted Pennymac and provided all documentation, and I allowed reasonable time for resolution.

XX/XX/XXXX/ XX/XX/XXXX -- XXXX phone calls were made inquiring about my MUD taxes, which were billed via a third party that XXXX XXXX hired this year out of XXXX. Each time, I was told the taxes would not be paid by PennyMac. The third time I called, I was even told that they'd be doing an Escrow analysis and my mortgage bill would be dropping down to around {$2800.00} per month as opposed to the current {$3100.00}. Once my XXXX county property taxes were paid, but the MUD taxes weren't paid -- and as the deadline to pay was approaching -- I did pay the MUD tax. XXXX days later, PennyMac also paid the MUD taxes from my XXXX account. Since XX/XX/XXXX, I have been in contact with PennyMac via messages and phone calls -- and they still have not refunded my property tax. They even completed an investigation and admitted they owe the taxes, but they said they can not pay them until the XXXX agency refunds them the money.

We disclosed from the beginning that we had an existing FHA loan. The lender reviewed the distance between the two properties and advised that it met relocation requirements. Based on that guidance and the written pre-approval, we proceeded with application fees, appraisal, termite inspection, and other purchase-related expenses. We were actively moving toward closing, including receiving detailed information from the lender regarding our required down payment and final funds needed to close. The seller completed repairs to the home in preparation for our purchase. In reliance on the lenders approval, we also began arranging our housing transition and provided notice to our apartment complex. Approximately eleven days before closing, we were verbally informed that the loan could not proceed due to FHA eligibility related to the existing loan an issue that had been disclosed from the beginning.

I was in the XXXX in XXXXXXXX XXXX XXXX I was trying to make my mortgage payment and PennyMac loan services would not take a payment online nor over the phone. They told me I can only wire a payment or go to XXXX XXXX. Because of the time difference I couldn't go to XXXX XXXX and I was force to pay by wire transfer. Due to the time difference in the XXXX and the XXXX, I made the payment on XX/XX/XXXX. The payment was on time but didn't post because of the time difference and PennyMac posted on XX/XX/XXXX. I had spoken to PennyMac and they assured me this wouldn't be a problem and not only that I had made a payment the week before through XXXX that they rejected and I didn't know because it was an ACH. This is completely unfair for them to report this on my credit report as late when they severely limited my options for paying even thought I had the money.

I was sent the application for mortgage relief and asked them at that time about the process and if it would impact my credit negatively. I was informed that the process is to submit the application and to not make any payments on the account while my application is in process. I was informed that during the process my account would be reported as " paying under a partial of modified payment agreement. '' It was represented to me that if my application was approved that my payments would not be considered late as they would add them onto the end of my mortgage. The plan was approved in XXXXXXXX XXXX XXXXXXXX. I discovered in XXXXXXXX XXXX XXXXXXXX that they had reported my account as past due in XXXX and XXXXXXXX XXXX XXXXXXXX. I would not have considered this as an option if I had been made aware that this would be the result of an approved forbearance.

In the process of trying to get this information, I found that they are also charging PMI erroneously. The loan to value ratio has NEVER required PMI. I was trying to refinance my VA loan with PennyMac and was given initial disclosures that didn't not include any property taxes except the XXXX. I am a XXXX percent XXXX vet and in the state of Texas this entitles me to not paying any property taxes. Pennymac is now saying that until my XXXX exemption is approved then they would have to escrow my taxes causing my mortgage to go up and cause a financial hardship. If this would have been disclosed when we initially called we would not have proceeded. At this point we no longer wish to proceed with PennyMac as they seem to bait and switch and take advantage of Veterans. We would like PennyMac at their expense back out any credit hits we have received from our credit as we feel they were dishonest. Once this has been completed then we will look to refinanen else where. Please see the attached initial disclouses that were provided by PennyMac and the ongoing emails.

Subject : Incorrect Credit Reporting Due to Servicer Error and System Outage I am filing a complaint regarding inaccurate credit reporting by PennyMac Loan Services related to my mortgage account. I had been successfully enrolled in automatic payments for an extended period of time and had never missed a payment. However, PennyMac removed my autopay due to what their representatives acknowledged was a system error on their end. Because I spend a significant portion of time outside of the United States, I rely on autopay to ensure my mortgage payments are made on time. After the autopay was removed without my knowledge, a payment was missed. PennyMac attempted to contact me by phone, but the call was filtered by a spam blocker and no voicemail message was left. Once I was eventually reached and informed of the issue, I immediately brought the account current. After resolving that issue, I attempted to set up payment again.

In XX/XX/XXXX, my mortgage payment with PennyMac was reported as 30 days late. My mortgage payments had been set up on automatic payment for years with a perfect payment history. Around that time, my bank account was changed, which caused the automatic payment to fail without my immediate awareness. As soon as I realized the issue, the payment was corrected and the account was brought current. Since the account opened in XX/XX/XXXX, I have maintained nearly XXXX years of consistent, on-time payments, and this is the only late payment on the account. My payment history reflects approximately 99 % on-time payments. I contacted PennyMac and requested that they review the situation and consider removing the single late payment as a goodwill adjustment due to the autopay failure and my otherwise exceptional payment history. PennyMac declined my request and stated they do not provide goodwill adjustments.

Despite several prior responses from PennyMac, the company continues to provide explanations that are incomplete, internally inconsistent, and unsupported by the escrow ledger or disbursement history required to verify their claims. To clarify the matter, the dispute involves three separate categories of funds. - First, borrower reimbursement for funds paid out of pocket. PennyMac failed to disburse my homeowners insurance premium from escrow even though sufficient escrow funds were available. Because of this servicing failure, I was forced to personally pay {$300.00} to XXXX XXXX to prevent cancellation of my insurance policy.

When I read him the Federal Garn- St. Germain Act that prohibits calling a mortgage for transfer to a trust he the said that they transferred my trust to the a new loan in XX/XX/XXXX. But they refused to close the XXXX loan.

I am trying to move this foreclosure along so I can move on with my life but 14 months of no payments, 8 months since the notice of default, and still XXXX update, no sale date, its just sitting there. I call weekly and get the same response. No sad date has been scheduled and no additional information available. They have been delaying this 8 months now and it hurts me more than anything. They have no urgency or no rush to sale the home. They have XXXX reason for the delay. A foreclosure in CA should never take this long. The property has been vacant for 15 months.

PennyMacs own online portal confirms a current balance of {$0.00} and reflects a last payment received on XX/XX/XXXX. PennyMac reported to all three credit bureaus in XX/XX/XXXX that the account was closed, transferred, and sold to another lender. I never received any written notice of a servicing transfer from either PennyMac or XXXX XXXX XXXX XXXX as required under RESPA Section 6, 12 U.S.C. 2605. I discovered the transfer entirely by accident. I contacted Pennymac regarding late fees that accumulated on my mortgage account. In a previous phone conversation with a Pennymac representative, I was informed that once I brought my account current, I could call back and request a review to have the late fees waived. Based on that information, I worked to bring my account up to date. After doing so, I contacted Pennymac again to request the waiver of the late fees as previously discussed. However, the company refused to remove the late fees despite the prior information provided to me by their representative. Recently, while reviewing the situation more carefully, I also realized that my contact information may not have been properly updated in their system for some time. Because of this, I may not have been receiving certain notifications or communications regarding my account. Despite bringing my account current and following the instructions given to me by the company, Pennymac declined to review or waive the late fees.

In early XX/XX/2025, I contacted my mortgage servicer, PennyMac Loan Services, regarding transitioning from a forbearance to a loan modification. During the week of XX/XX/XXXX, I spoke with four separate PennyMac representatives to obtain clear and accurate information regarding the credit impact of proceeding with loss mitigation. On my first call, the representative provided fast-paced, scripted information that was difficult to understand. I repeatedly asked for clarification. I then asked a direct question : whether I had until XX/XX/XXXX to pay the arrears amount of {$9100.00} and whether my account would not be reported late to the credit bureaus before that date. The representative confirmed that was correct. To ensure accuracy, I called back the same day and spoke with another representative, who again confirmed that my credit would not be impacted and that I had until XX/XX/XXXX to resolve the arrears.

Pennymac incorrectly reported that i was made late payments between the months of XXXX of XXXX. When I made payments during that time. They are refusing to take them off and also denying that they lied to me about any of their process of deferment and loan modification would impact my credit. I was told multiple times on the phone that it would not, however the transcripts I got have been trimmed and are not complete. The portion that proves they lied to me has been edited out. The conversation just ends on the recording, its cut off. Mind you it took them over XXXX days and repeated phone calls to get the transcripts. They lied multiple times about where it was at in the process and when I would be getting them. Not only that I was lied to about having a " meeting set up '' with XXXX of their executive team members. And the first envelope i got did not even include the cd. All of this is after months of phone calls trying to get to someone that could actually answer my questions.
