My mortgage company Planet Home Lending LLC has misapplied funds from payments, charged incorrect late fees, and is not taking necessary action to remedy these problems, but is instead requesting that I make an additional payment even though my payments are up to date. XXXX. Payment Misapplication On XX/XX/XXXX, I made a mortgage payment in the amount of {$2100.00}, for the month of XXXX and another on XX/XX/XXXX in the amount of {$1700.00} for the month of XXXX which have been confirmed as withdrawn from my bank account ( documentation previously provided ). This payment has not been properly applied to my loan balance. As a result, I have been incorrectly assessed late fees, which I dispute in full. XXXX. Escrow/ Property Tax Error XX/XX/XXXX I notified my mortgage company that my account was to be updated to remove property taxes from escrow effective XXXX. This correction has not been reflected in my balance or payment amount.

I am filing a complaint regarding misapplied mortgage payments. On or about XX/XX/year>, I sent 5 cashiers checks in the amount of {$760.00} each to cover multiple monthly mortgage payments. I clearly designated the payments to be applied to specific months, and I also have receipts showing each individual month paid through XX/XX/year>. The company received the funds but only applied a portion of the payment correctly. The remaining funds were incorrectly applied toward principal instead of being applied to the designated monthly payments. As a result, my account is currently showing a payment due for XX/XX/year>, when it should reflect that I am paid through XX/XX/year> with no payment due until XX/XX/year>. I have contacted the company multiple times over the past month to resolve this issue.

Summary : Planet Home Lending issued a Loan Estimate on XX/XX/XXXX, showing {$0.00} payoffs and {$32000.00} cash. A title search dated XX/XX/XXXX, had already revealed a {$23000.00} HUD lien. Despite this knowledge, the lender omitted the payoff. I learned about it one day before closing when the Closing Disclosure arrived showing my cash reduced to {$9100.00}. On XX/XX/XXXX, I exercised my right to rescind on the lenders own Notice XXXX XXXX XXXX XXXX form, stating in writing that I was misinformed. The lender has not honored my rescission. They have not returned my money. They have not released the lien. I am now being held to a 30 year, 11.625 % loan for {$9100.00} in cash that I was told would be {$35000.00}. '' I rescinded three times : on the lenders form ( XX/XX/XXXX ), by email ( XX/XX/XXXX ), and by DTPA notice email ( XX/XX/XXXX ). Planet Home Lending has taken no action to reverse the loan.

I am filing this formal grievance due to Planet Home Lendings refusal to release or disburse the insurance proceeds in a reasonable manor that XXXX XXXX issued to them after catastrophic fire damage to my home. My insurer, XXXX XXXX, has agreed to pay under Claim # blank totaling {$360000.00}, intended solely for the repair and restoration of my home. Despite providing the necessary documentation and on XX/XX/year> received proceeds in the amount of {$260000.00} from XXXX XXXX, ( XXXX XXXX will release the balance once they see that the repairs are underway ) Planet Home Lending has withheld these funds and will only disperse a maximum of {$20000.00} at one time, which must be followed up by an inspection that takes a minimum of a month for them to process due to all of their Policies and Procedures. My contractor is not opposed to inspections.

After XXXX years of marriage I went through a divorce where I was awarded the home from my ex husband. The house was several months behind on the mortgage. Through the courts proceedings, due to us having XXXX children together my ex husband was suppose to pay half of the mortgage. After months and months of not receiving anything I was unable to make these payments off of my salary. Due to not wanting to lose my home I applied for the modification program which took XXXX XXXX for approval. When I finally got approved the company sent me documents to sign with several errors. I immediately called and the customer service rep agreed that there were errors with the numbers and he fixed it on his end. I waited to receive new documents and after a month I did not so I called back to let them know I never got new documents and the customer rep stated I had to reapply. But since I did not sign the error documents they had sent my house information to their foreclosure attorney.

I am filing a complaint regarding my mortgage escrow account and an escrow shortage identified by my loan servicer, Planet Home Lending. According to the escrow analysis performed effective XX/XX/year>, I was informed that I had XXXX days ( until XX/XX/year> ) to make payments toward the escrow shortage before a new escrow analysis would be required. Since receiving that notice, I have made payments toward the escrow shortage, including a payment of {$1000.00} in addition to my regular monthly mortgage payments. I contacted Planet Home Lending to notify them that I had made payments toward the shortage and requested that my escrow account be adjusted accordingly. However, I have not received confirmation that my escrow shortage has been updated to reflect these payments.

My mortgage servicer has engaged in a continuous, multiyear pattern of unlawful payment handling, suspense manipulation, and false delinquency creation beginning no later than XX/XX/XXXX and continuing through XXXX. These violations occurred before, during, and after my XXXX XXXXXXXX bankruptcy and have caused significant financial harm, credit damage, and wrongful delinquency status. The earliest documented violation occurred on XX/XX/XXXX, when the servicer drafted my payment via XXXX and applied {$0.00} to my loan, placing the entire payment into suspense. This was a full periodic payment that the servicer initiated themselves. They failed to credit it, left the due date unpaid, and immediately created a false delinquency. This is a direct violation of Regulation Z, Regulation X, and the CFPBs mortgage servicing rules. On XX/XX/XXXX, the servicer drafted my payment again and applied it 35 days late, despite it being an XXXX draft.

I am an XXXX XXXX servicemember with a VA home loan serviced by Planet Home Lending. My mortgage is currently in forbearance due to the government shutdown. Despite this status, Planet Home Lending has restricted my access to my online mortgage account because my loan is not current. This restriction prevents me from reviewing my account balance, statements, payment history, and upcoming payment obligations. Denying access to my mortgage account directly impacts my ability to properly manage my loan and make timely payments. In addition, I am unable to access my Form 1098 mortgage interest statement for tax purposes because access to my account portal has been restricted. As a result, I do not have the documentation required to accurately complete my taxes. Furthermore, I have submitted mortgage payments by check and have not received confirmation that the payments were received or how they were applied to my account.

We received an FHA trial modification and paid as directed. The modified payment was {$3500.00}. The lender then advised that they were adding {$1100.00} to payment based on an escrow shortage. We then asked for a breakdown of the escrow charges both verbally and via email. There was a discrepancy between the tax information on the county website and the amount charged by the lender. We requested the reason for the difference and were ignored. The email was not answered or reviewed at all and on the XXXX call asking for an update the representative sent the receipt explaining the difference was due to solar panels financed through the state. We then called the lender and requested a longer spread for the escrow, as {$1100.00} is a large increase and the modification review determined that {$3500.00} is affordable. I called the lender today to get a status update on this request and I was verbally told that we were denied. I asked for this decision in writing, I was told no.

The company is well aware of what happened and this should be considered XXXX. I lost my job because my XXXX XXXX XXXX from XXXX so I spoke to Planet Home Lending about a forbearance agreement after I had done a ton of research on my own about the process and spoke with agents with their XXXX department numerous times about the process and the repayment process. I did not want to do anything to affect my credit score as I had worked really hard for the past XXXX years to get my credit score up. I was told that if it did it would only be a small amount and probably not at all so long as I was current before the forbearance period and after the forbearance period. Before I agreed I spoke with them XXXX last time and discussed the repayment options available and their XXXX explained to me which options would be available and how that processed worked. I then told her which option I would choose for repayment.

The mortgage account reported by Planet Home Lending is inaccurately reporting a XXXX late payment for XXXX 2026. I made multiple attempts to make my payment, but the lender was experiencing servicing and system transition issues that prevented them from properly accepting the payment when I attempted to pay. During a recorded phone call, their representative informed me that my account would not be reported to the credit bureaus unless it reached 60 days past due. Despite this representation, the account was reported as 30 days late after only 30 days. This reporting does not accurately reflect the circumstances and has unfairly damaged my credit score. I am requesting that the XXXX late payment for XX/XX/year>2026 be investigated and removed or corrected, as the reporting occurred earlier than what was communicated by the lender and while I was actively attempting to make the payment. In addition, I previously tried to authorize another person to make a payment on my behalf.

After this unexplained increase, my account began showing partial payments, suspense or unapplied funds, late fees, and delinquency reporting starting around XX/XX/year>. I dispute whether the company properly communicated the new payment amount, properly applied my payments, and properly assessed late charges and negative reporting. I believe any reported delinquency may have resulted from servicing errors. I have requested in writing the account statements, payment history, escrow records, late fee history, internal notes, call logs, and documentation supporting any negative reporting.

There was an error at closing where the parcel was not split properly. Due to this error, the mortgage company, Planet Home, did not pay the tax bill. The parcel error has been corrected, and Planet Home will still not pay the updated tax bill. Customer service has refused to return MY escrow money so we can pay it. When we try to tell them we are running out of time to pay it, they say it's " in review. '' It's been " in review '' for over a month now.

Last year i switched insurance companies to save money. I switched to XXXX. My new insurance was supposed to be {$2300.00}. My mortgage company paid them {$12000.00}. I got a refund check for {$7000.00}. I called and was told it was just an ovverage and mine. I went to do taxes this year and saw my escow was - {$6000.00}. I called my insurance wand was told planet Home made a mistake and over paid them. I never received any correspondance about their mistake. Now i see my mortgage company is planning on paying {$7000.00} in XXXX to my insurance but my insurance is only {$2300.00}. I have emailed them twice and called numerous times. Ive asked for escrow analysis. They havent given it to me. The math doesnt add up. None of this makes any sense. I called my mortgage company, Planet Home Lending, on XX/XX/XXXX and their tax department started to process the payment. Planet Home Lending then completed an escrow analysis. I received a copy of this analysis on XX/XX/XXXX. This analysis stated that I will have a shortage of {$2800.00} in XX/XX/XXXX ( when my property taxes are due ). I called Planet Home Lending on XX/XX/XXXX to discuss their error. Planet Home Lending advised me that there was no error and that I am responsible for the projected shortage. I explained that the projected shortage is because my escrow account would be charged for my property taxes ( {$3100.00} ) twice in a 12 month period ( XX/XX/XXXX and XX/XX/XXXX ) and was told that I am incorrect.

In the late spring of XXXX, I had to leave work temporarily to go on parental leave. During that time, I fell behind on my FHA mortgage serviced by Planet Home Lending. I applied for loss mitigation and was offered a partial claim. I executed and notarized the documents and timely returned them as of XX/XX/XXXX. I even made my next mortgage payment in XXXX of XXXX. After I made the payment, I checked my online portal and noticed that my payment was not properly applied because the website was saying I still owed mortgage payments as of XX/XX/XXXX, which should have been covered by the partial claim. I called Planet Home and was told that the partial claim paperwork was cancelled/not approved. I checked the land records and saw that the secondary loan with HUD ( partial claim ) was, however, recorded, but that it was misdated by Planet Home for XXXX ( as opposed to XXXX ).

Also, if I thought I would not be able to do so, call the last week of XXXX and they would see what could be done. I told him that I could make one payment on XX/XX/XXXX, when my SSA check is deposited. Late that day I spoke with XXXX id XXXX, and he gave me the same information.

We recently satisfied our loan balance in full with Planet Home Lending on XXXX by refinancing with a different bank. Planet Home received that payment in full on XXXX per the letter they sent us dated XXXX. On XXXX they auto debited a payment from our checking account. We called on XXXX to dispute and get a refund. We were on the phone for over 4 hours in total trying to get resolution, we were told the payment had not posted on their end so there was nothing they could do and advised us to do a stop payment on our end with our bank. They advised it would take up to 30 days for us to get a refund. Our bank could not do a stop payment because they transaction already went through. So we started a dispute but that too would take time. On XXXX we called Planet Home again. They informed us that the payment was received on their end and did clear but they were still requiring proof from us that it was debited from our account- they requested a bank statement.

They subsequently Approved our enrollment. We got a letter affirming the Action would start soon in XXXX. Our XXXX Payment, we assumed, would be the First Budget i.e, bi-weekly one. We were startled to see an Advance Payment come out of our Bank Acct on XX/XX/XXXX ; with another one due to be Deducted on XX/XX/XXXX ; and future ones to be made every 14 days. We have Never had this happen to us before with any other Mortgage XXXX!! Owned and paid on homes since XXXX!!! We will have made 3 Payments to this Lender ; All in Advance of Scheduled Due dates, in just the the XXXX Month of being Serviced by this Lender! Planet Home Lending wrongfully foreclosed on my home while my loss mitigation application was actively under review. Beginning in XX/XX/XXXX, I submitted multiple complete requests for mortgage assistance. Planet Home Lending accepted my documentation but never issued a written decision, denial, or notice of appeal rights. I did not receive any notice of foreclosure sale, acceleration, or opportunity to cure. I learned of the foreclosure months later through a third party. On XX/XX/XXXX, Planet Home Lending acknowledged receipt of my written inquiry regarding these servicing errors. As of XX/XX/XXXX, Planet Home Lending has failed to provide a substantive response within the time required by 12 CFR 1024.35 and 1024.36. The foreclosure resulted in substantial equity loss, destruction of rental income, and severe credit harm. I am requesting CFPB enforcement action and written corrective relief.

Planet alleged fraud and participation in a debt elimination scheme without providing evidence, documentation, or addressing discrepancies reflected on my IRS transcripts associated with my loan. Planet failed to identify the reporting entity responsible for IRS Cancellation of Debt entries appearing under its name and did not explain duplicate or corrected entries. Instead of addressing the substance of my inquiry, Planet relied on speculation, mischaracterizations, and threats, which is inconsistent with fair servicing standards and CFPB expectations.

The mortgage servicer acquired servicing of the loan and later determined that flood insurance was required. However, the servicer did not provide written notice of the flood insurance requirement until months after acquiring the loan. Upon receiving the notice, the borrower obtained compliant flood insurance within the XXXX cure period required under federal law. Despite timely compliance, the servicer has attempted to force-place flood insurance and assess premiums for periods prior to providing notice and during the statutory cure period. This includes retroactive charges for time before notice was issued and before force-placed insurance could lawfully be applied. Federal law permits force-placed flood insurance only after proper written notice and expiration of the XXXX cure period. Any retroactive assessment for periods prior to those requirements is improper and illegal.

I got a new insurance XXXX in XX/XX/2025 and requested the services to update my escrow. They sent me XXXX escrow analysis, XXXX with a $ XXXX annual insurance premium which brought my monthly payment to $ XXXX. After calling and explaining that I should no longer be charged the XXXX premium since I have my own insurance they sent me an updated analysis with the $ XXXX premium removed and my updated annual insurance premium of about $ XXXX and total monthly payment of $ XXXX. We are now near the end of XXXX and my payment is not showing correct. I have called and emailed with no resolve. I need my payment correct ASAP with no negative impacts to my credit history. I should not be responsible to make a $ XXXX payment.

I am submitting this complaint regarding ongoing mortgage servicing errors by Planet Home Lending, specifically the misapplication of payments, improper use of suspense funds, and inaccurate delinquency reporting. Over an extended period ( more than one year ), I have made multiple mortgage payments that were received by the servicer but not applied to principal and interest. Instead, Planet Home Lending repeatedly placed funds into an unapplied/suspense account, reversed previously applied payments during escrow rebuilds, and left monthly installments technically unpaid even though sufficient funds were tendered. As a result of these servicing actions : My loan continues to show as delinquent despite payments being made. Late charges have been assessed due to the servicers payment application decisions. Very little principal has been reduced, despite substantial payments made. Funds held in suspense have not been applied to cure the oldest unpaid installment.

I lost my job due to a labor force reduction in XX/XX/year>. I later obtained new employment in XX/XX/year> but was forced to leave that position due to an immediate and medically necessary XXXX. As a result of these documented hardships, I fell behind on my mortgage beginning XX/XX/year>. In XX/XX/year>, I proactively contacted Planet Home Lendings Loss Mitigation Department and submitted a complete loss mitigation application to prevent foreclosure. I complied with all document requests and provided verification of income loss, medical hardship, employment separation dates, and my subsequent offer letter.

I previously submitted a CFPB complaint against this servicer regarding my loan payoff and escrow funds. Although that complaint was closed, the servicer has still not provided the documentation I have repeatedly requested specifically, a complete escrow account history, which I am entitled to under RESPA. Despite multiple requests over several months, the servicer has only sent me what appears to be a loan transaction ledger, not the escrow account history itself. This ledger does not show actual escrow account deposits, disbursements, balances, or the escrow analysis for XXXX. It also does not include the XXXX county property tax bill or any documentation showing how much was actually paid from my escrow account for property taxes after my homestead exemption was applied. I sold my home in XX/XX/XXXX. Throughout the year, the servicer continued collecting escrow funds based on the prehomestead exemption tax amount from XXXX.

Following property damage, my insurance carrier issued proceeds for required repairs. The servicer required the funds to be endorsed and placed into escrow but then unreasonably delayed releasing those funds, despite inspections showing repairs were substantially complete ( approximately XXXX % ). Due to the servicers delay, I was forced to pay contractors out of pocket to continue required repairs. These delays directly impacted my ability to maintain timely payments. During this period, the servicer issued a Modification Offer Form ( MOF ) that expressly stated the missed payments would be paid or capitalized as part of the modification. I acted in good faith, continued repairs, and requested reinstatement/modification based on the servicers own terms.
