I am filing this complaint because Portfolio Recovery Associates ( PRA ) continues to report two accounts to the credit bureaus without proper validation and in violation of the Fair Credit Reporting Act and the Fair Debt Collection Practices Act. I requested validation from PRA via certified mail. PRA responded with generic, incomplete documents that do not validate the debt, including old billing statements and pooled purchase agreements that do not show ownership, do not provide a chain of title, and do not verify the accuracy of the information being reported. PRA is legally required to obtain and maintain accurate documentation prior to furnishing information to the credit reporting agencies. PRA has failed to do so. PRA continues to furnish and reverify inaccurate information with TransUnion and Equifax, despite being unable to validate the accounts.

A collection account is currently listed on my credit report without proper verification. I exercised my rights under the Fair Debt Collection Practices Act ( FDCPA ) by requesting validation of the alleged debt ; however, the creditor or collection agency has not provided any credible documentation proving that the debt is mine, that the balance is accurate, or that they are legally authorized to collect it. Despite the absence of proper validation, this account continues to be reported on my credit file. This constitutes a violation of the Fair Credit Reporting Act ( FCRA ), which mandates that all reported information must be accurate and verifiable. Reporting a debt that has not been validated is both misleading and incorrect.

I disputed two accounts reported by Portfolio Recovery Associates in XX/XX/year> and requested full validation. I asked for a signed agreement, chain of assignment, and itemized balance. The company responded but only provided limited documents that do not establish ownership or the accuracy of the amounts. One account is also time-barred, as the company stated it will not pursue legal action due to age. Additionally, the accounts are reported inconsistently across credit bureaus, with missing original creditor information on Experian. These accounts remain inaccurate and unverifiable, and I am requesting deletion.
I asked for an itemized breakdown of account. They say its a XXXX account but I can not find it anywhere or on my credit reports. They sent me paperwork of over all debt with 2 different account numbers which one was paid and the next had a total dollar amount with no break down. They then filed with court but didnt serve me or attempt to. Case was dismissed and they then filed after to have case dismissed without prejudice and case was dismissed again. I wouldnt have even known had I not been looking into something else. They continue to report it to my credit report even though I disputed the lack of information and then said they would sue me. Which I guess they filed so partly did.
This company has been violating my rights and they have not provided validation information. Under 12 CFR 1006.34 ( b ) ( 5 ) ; They have still placed a collection on my consumer report recently. I am very stressed out because this company is violating my rights Under 15 U.S.C. 1681s- 2 ( a ) ; Data furnishers are required to report only accurate and complete information. Reporting unverifiable or inaccurate data is a violation of federal law. This whole case has put immense pressure on me as it has effected my credit highly limiting opportunities for myself. On top of that - the company keeps harassing me through calls multiple times a day despite repeated displeasure conveyed from my end. 15 U.S.C. 1692g ( b ) of the FDCPA requires debt collectors to cease collection activities and provide proper validation of the debt when requested in writing within 30 days of initial contact. The accounts Ive referenced are 100 % inaccurate.…

They now have a law firm contacting me and threatening to file a lawsuit. I have informed them they failed to provide proof and informed them I filed a complaint with you-CFPB and to cease and desist, but they continue to send me written letters attempting to collect and file suit against me.

Hi, Systemic FCRA/FDCPA Violations & Willful Deceptive Practices I am filing this formal complaint against Portfolio Recovery Associates , LLC for a pattern of willful non-compliance with the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. XXXX, and the Fair Debt Collection Practices Act ( FDCPA ), 15 U.S.C. XXXX. Violation XXXX : Fraudulent Misrepresentation of Creditor Identity ( 15 U.S.C. XXXX ) The furnisher is willfully reporting false data by listing themselves as the " Original Creditor " on my credit file ( see attached evidence ). This is a factually false statement. Portfolio Recovery Associates , LLC is a third-party debt buyer. I never executed a contract with this entity. By masquerading as the originator, the furnisher is corrupting the data lineage and misleading scoring models to treat this junk debt as a primary financial obligation. This is a deceptive trade practice under the FDCPA intended to confuse the consumer and the credit bureaus.…

I am submitting this complaint regarding inaccurate and unverified information currently being reported on my credit file. After reviewing my credit report, I discovered that Portfolio Recovery Associates is reporting a collection account with a balance of approximately {$470.00} and account ending in XXXX. I disputed this account and requested validation of the alleged debt under my rights provided by the Fair Debt Collection Practices Act ( FDCPA ) and the Fair Credit Reporting Act ( FCRA ). Specifically, I requested documentation verifying the accuracy of the account, including : A copy of the original signed contract with the original creditor A complete payment history and itemized breakdown of the alleged balance Documentation showing the date of first delinquency Proof that Portfolio Recovery Associates has the legal authority to collect this debt Despite my request, the company continues to report the account to consumer reporting agencies without providing proper…
A third-party debt collector purchased the debt from the original creditor. The amount of the debt they sold is {$5500.00}. I had an agreement with the original debt collector for that amount only. I feel that the original debt collector sold the debt to a new debt collector as it shows on my credit report. So, by law it is null and void because I did not have an agreement with the new debt collector or sign no new agreement with the new debt collector. Now they are suing me for the amount due. Please help. I feel I do not owe the debt to the new debt collector, and I would like it removed from my credit report. Thank you
My name is XXXX XXXX, and I am writing to formally dispute a collection account erroneously assigned to me by Portfolio Recovery Associates LLC, which is negatively impacting my credit scores. I recently discovered that this collection account, numbered XXXX has been reported on my credit reports by XXXX XXXX XXXX XXXX with a current balance of {$2400.00}. However, this debt is not mine. I first became aware of this issue after noticing a significant drop in my credit scores. Upon obtaining copies of my credit reports, I found that my scores have plummeted to XXXX with XXXX XXXX with XXXX and XXXX with XXXX largely due to this erroneous collection account. This has caused considerable stress and has impeded my ability to secure necessary credit for personal financial needs. Under the Fair Debt Collection Practices Act ( FDCPA ), I have the right to dispute debts that are not valid. I am exercising this right and requesting immediate action to correct this error.…
I have reviewed your response and it does not resolve my dispute. You state that you purchased the account and that your records show my name and partial social security number. However, this does not constitute proof that I am personally liable for the alleged debt. This account was opened as a business credit account. You have not provided any documentation showing that I personally guaranteed this account or agreed to be personally responsible. To properly validate this debt, I require : - A copy of the original signed agreement or application - Documentation clearly showing a personal guarantee, if any exists - Full account statements from the original creditor - Proof of your legal right to collect this specific debt A summary of account data or business records is not sufficient to establish personal liability. Until such documentation is provided, I continue to dispute this account and request that it be removed from my credit reports as inaccurate.…
