I was living jn an apartment complex for over XXXX years. I was forced to move out XXXX of XXXX from the health inspection department because the apartment wasnt safe to lived in with my kids. They put a collection on my account XXXX of this year XXXX for a ridiculous amount over {$12000.00}. They charging me for things that come with wear and tear in a home that you have lived in over XXXX years. They didnt fixed anything since I moved in and the apartment wasnt up to date at that time. They charging me for months that I wasnt there because I had to move somewhere safe with my kids. Again I didnt get evicted I was forced to move out. They keep changing management company.

XXXX I received a letter for debt. i wrote them certified and ask to verification of said debt. thy sent back pictures and lease agreement that was old. I aslo have move out pictures. they said i skipped out during eviction process. they were changing managemnet and companies. I went into the office prior to moving and signed a move out letter with XXXX. they are trying to charge me for screens for which there were no screens upon moving in. maintenace brought me screens from the apartment next store that had been vacant for almost a year man name was XXXX. carpet cleaning for which carpets were cleaned. very well kept. light bulbs for which i have pictures of move out date and bulbs were in place. charges for cleaning unit and again pictures and video of these being done.tubs being resurfaced. the tubs were plastic and when i moved in they had painted the tubs with paint. so it started to peel immediately. they have changed managers and property owning companies at least twice.

To this date, the company has failed to provide any written documentation, a copy of the original lease agreement, or an itemized breakdown of the alleged damages/fees as required by the Fair Debt Collection Practices Act ( FDCPA ). I also have proof that although I handed XXXX XXXX the keys directly, on XX/XX/XXXX she called and asked for permission to enter the apartment to fix service request. I stated that I handed her the keys, I no longer live there and to fix whatever needs to be fixed. But had a proper walkthrough been done with me, which wasnt, this mistake wouldnt have been made. I have emails that the XXXX XXXXXXXX stated I wasnt charged, I have service request about water leaking and mold, I have pictures of water leakage and mold, and I cut service off to the apartment on XX/XX/year>. I also didnt receive my security deposit back when they had a legal obligation to keep that apartment habitable and didnt hold up their agreement.

Although I signed a lease agreement, I never took possession of the apartment and was never provided keys to the unit. The addendum states that this early termination fee is the agreed remedy for ending the lease early and that the landlord waives the right to seek additional rent beyond the month in which possession was retaken.
