I have disputed multiple accounts being reported and collected by LVNV Funding LLC and its servicer, Resurgent Capital Services, both directly and through the credit reporting agencies. These disputes were sent in multiple rounds, including disputes submitted through a third-party platform that generated and mailed multiple dispute letters to both the furnishers and the credit bureaus. Despite providing sufficient identifying documentation, including a copy of my identification and a bank statement, all XXXX credit reporting agencies XXXX, XXXX, and XXXX claimed they could not verify my identity. This is inaccurate and appears to have been used as a reason to avoid conducting a proper investigation into the disputed accounts. In response to my disputes, LVNV Funding LLC and Resurgent Capital Services provided Account Summary Reports that explicitly state they are not credit card or original creditor statements.

I believed this debt was included in the XXXX XXXX and the attorney also stated that any communication should be sent to them because of the automatic stay. The account was tied to an old address where I had not lived for well over a year, and I did not apply for it, use it, or benefit from it. I did not receive the notices, correspondence, or legal papers related to this account because they were sent to that prior address instead of my actual residence. I later discovered the account only after learning that wage garnishment had been pursued against me. After investigating, I reported the matter as identity theft to the XXXX XXXX Police Department. I also challenged the debt in court. The creditor, LVNV Funding LLC, failed to provide the documentation needed to prove that I opened or used the account, and the case was dismissed in XXXX XXXX XXXX XXXX.

XXXX removed and investigated, removed incorrect accounts with the Law but I have tried over and over and I feel at this point I am being targeted and not being treated fair under the laws that protect consumers. For the second time, LVNV has initiated legal action and garnishment without validating the debt. They failed to appear in court during the initial proceeding. I have not received any proof that this debt belongs to me, that LVNV legally owns it, or a detailed breakdown of the amount owed. Resurgent debt collection agency sent me an email that is not for me. It happens to be a collection for my mother that I did not know she had. She is still alive and I'm not sure how they got my email or why they would send me her info. It has the last XXXX of the account number, her first and last name, the amount owed and the collection ID number. The last I checked this was highly illegal. Please look into this. I wouldn't be surprised if this isn't the first time they've done this.

Due to their lack of communication providing me with the certification of all Debts they purchased from the original lenders and by not abiding by my cease and desist request, they are in violation of federal law.
