BACKGROUND : XXXX XXXX XXXX XXXX is acting as foreclosure counsel for RoundPoint Mortgage Servicing LLC ( servicer ) on behalf of the loan owner ( XXXX XXXX ) regarding Loan # XXXXXXXX XXXX XXXX Matter ID XXXX, secured by my primary residence at XXXX XXXX XXXX XXXX, XXXXXXXX XXXX XXXXXXXX. We initially sent a Qualified Written request letter on XX/XX/XXXX to RoundPoint Mortgage Serving LLC advising them that they were requiring escrow payments far in excess of the required amounts pursuant to XXXX XXXX They responded to the letter on XX/XX/XXXX reiterating that their calculations were correct. They ignored my position that their calculations monthly, did not take into account the required yearly analysis and instead, would be holding more than 3 times the escrow permitted by State and Federal Law. ( See XXXX XXXX XXXX XXXXXXXX XXXX and Federal RESPA regulations 12 CFR 1024.17 ) I then responded to that letter on XX/XX/XXXX indicating that they did not address the core question of them violating State and Federal law, but also suggested an amicable resolution to the issue in which I would resolve the issue and still provide a significant cushion which is still greater then allowed by law.

Fee Stacking. Since Roundpoint bought my mortgage, I have automatic payments turned on for the entirety of my account being with them. In XX/XX/XXXX I had insufficient funds in my account, at which point my payment was marked as incomplete. I made a one time payment to bring my account balance back to even. For whatever reason, Roundpoint mortgage turned my automatic payments off. I did not turn automatic payments off, roundpoint mortgage did. Because Roundpoint Mortgage turned my automatic payments off, my XXXX payment was not withdrawn from my account. They assessed a late fee. Again, I made a one time payment and brought my account back to even and I manually turned my automatic payments back on. I manually turned my automatic payments back on XX/XX/XXXX, prior to my XXXX payment being due. They did not withdraw the money from my account even though I had automatic payments turned on, and again, accessed a second late fee.

I am filing this formal complaint against RoundPoint Mortgage Servicing for violating RESPA guidelines and failing to rectify a massive escrow accounting error. Despite my formal " Notice of Error '' sent on XX/XX/XXXX, the bank has failed to correct my account. Furthermore, I have contacted the banks customer service department via telephone multiple times to resolve this issue. During these calls, I clearly explained the accounting errors, but the representatives refused to cooperate, ignored my evidence, and failed to provide any escalation or resolution. This lack of cooperation has forced me to seek assistance from the CFPB. In XX/XX/XXXX, the bank paid {$6500.00} in property taxes. On XX/XX/XXXX, I reimbursed the bank in full for this exact amount ( {$6500.00} ) via a manual payment. The bank received these funds but failed to apply them to reduce the escrow shortage, effectively double-charging me for the same tax bill through an inflated monthly payment.

Due to an escrow adjustment of approximately {$210.00} that occurred, XXXX incorrectly classified my payment as principal-only and held it in a suspense account rather than applying it as regular XX/XX/year> payment. This processing error caused my XXXX payment to appear as missed and XXXX submitted a negative comment on my credit report about XX/XX/XXXX. As a result, my XXXX XXXX dropped approximately XXXX points. I have maintained a perfect payment history for over XXXX years with no missed payments. On XX/XX/year>, I resolved the shortfall and asked to remove the negative comment due to the processing error by XXXX. On XX/XX/XXXX, XXXX reclassified my XXXX payment correctly. However, they have refused to request the removal of the negative mark from my credit report. On XX/XX/year>, I disputed this inaccuracy with XXXX.

Roundpoint mortgage has failed to send me an insurance check within a reasonable timeframe. They acknowledged receiving my check with packet containing all required information on XX/XX/XXXX and have a policy to send the check 5-7 business days later. I've attempted to get confirmation on when the check will be sent and have been unable to get a date on when the check will be sent. I am requesting the check for {$40000.00} be sent overnight to my address. If the check is not received to my home address by XXXX XXXX at the absolute latest my repair schedule will be unachievable and we will incur additional lodging expenses. I am requesting regulatory review of a 30-day delinquency reported by RoundPoint Mortgage Servicing in XX/XX/year>. This account had been on automatic payment for several years with a perfect payment history. During a transition to a new primary banking relationship, the automatic payment associated with the prior account was rejected after the account closure. Unfortunately, I was not immediately notified that the automatic draft failed. As soon as the issue was discovered, the payment was immediately remitted and the automatic payment information was updated. The account has remained current since that time. I requested a goodwill adjustment from RoundPoint but received a standard denial. However, the reported delinquency resulted from an autopay rejection during a documented bank transition rather than an inability or unwillingness to pay.

Mortgage servicer owed a {$140.00} refund for an escrow account balance. The servicer issued a check on XX/XX/XXXX, which was received and deposited thereafter. The check bounced and was unpaid by the bank. I contacted the servicer to inquire and was told that there was an internal account error with the way the check was printed and that the cashiering department stopped payment on the check. At that time, I requested that the check be reissued, and also sought reimbursement for {$20.00} that our bank charged us for the bounced check. My request was escalated. I called again on the week of XX/XX/XXXX and was informed that the request was approved and that the check was reissued that week, and included the additional {$20.00} reimbursement. As of XX/XX/XXXX, we still have not received the escrow refund or the additional {$20.00} reimbursement for the bank fee. On XX/XX/XXXX, I called and spoke with XXXX in the escalations department, who advised that I was misinformed previously.

Over nearly two years I made multiple written and verbal contacts with RoundPoint Mortgage Servicing LLC, spoke with numerous representatives, and submitted formal written requests. On XX/XX/XXXX, a RoundPoint representative named XXXX verbally communicated that my deed in lieu application had been approved subject to specific conditions including a cash contribution of {$11000.00}, immediate vacancy, broom sweep condition, and execution of a personal property release. I asked for a detailed breakdown of the {$11000.00} figure and specifically requested a callback before any denial was issued. RoundPoint never called back. The approval was subsequently withdrawn without written notice, without stating any reason, and without providing appeal rights in violation of 12 CFR 1024.41 ( d ).

A separate approval letter reflecting the terms of the workout is being generated and sent separately from this Evaluation Notice. '' I did not receive the letter and on XX/XX/year> at XXXX XXXX EST I called Roundpoint Mortgage to follow-up on the approval letter. The representative I spoke to stated that the letter was incorrect and that I was denied for the forbearance plan due to my property not being a primary residence. Roundpoint Mortgage had made no effort to notify me that my letter was incorrect, and after receiving my initial letter dated XX/XX/XXXX, I had already planned my finances around this written approval that was later rescinded without proactive notification.

I was in a Forbearance with my mortgage company, Round point Mortgage. By XXXX, I made my payment and my work has an assistance program where they paid for the 1 month I was behind. So my account should have been brought currant. Its not. I was told I never made a payment. Neither did my work. I was told I have to get proof of payment from my bank with account number, trace number and a letter basically saying it left my account of this day in this amount. So I did. I also asked my work to provide their information details ( I am still working on this, but they did in fact make the payment ) And nothing has been applied to my account. I sent all the information that was asked of me regarding my bank account and payment. I am working with the employee assistance program to get proof of payment as well. I paid XXXX on XX/XX/XXXX and my company I belive paid the remaining XXXX ( and some odd change ) in XXXX as well.

on XXXX XXXX XXXX I submitted an escrow cancelation request on XXXX XXXX I received a denial letter in the mail due to XXXX being less than 80 %. On XXXX XXXX I submitted a large principal payment to reduce my XXXX to less than 80 % and resubmitted the request. on XX/XX/XXXX. I contacted Roundpoint by phone on XX/XX/XXXX and was on hold for over XXXX minutes, and used the automated system to request a call back. No such call has ever been received. On XX/XX/XXXX I attempted to contact them through their hearing impaired chat multiple times but was met with a banner that said " no one is available now ''. On XX/XX/XXXX I sent several follow up emails with no response. On XX/XX/XXXX I sent another follow up email to every email address at roundpoint I could find requesting an update by the end of the day, it is now the end of the day and I have not gotten a response from them. We are going on over XXXX weeks with no response and no way to get ahold of the servicer.

We received an email from Roundpoint mortgage verifying that our loan was paid off on XXXX XXXX, XXXX. Our escrow balance as confirmed by Roundpoint was {$1800.00} the email also states a check will be issued within XXXX business days. The following are the details of the phone calls I have had with Roundpoint : XXXX. XX/XX/XXXX talked with XXXX said check mailed XX/XX/XXXX. XXXX. XX/XX/XXXX talked with XXXX said they would send another check. XXXX. XX/XX/XXXX talked with XXXX said check was mailed on XX/XX/XXXX. As I am sure you know per RESPA, mortgage companies are required to return escrow funds within XXXX working days. We are way past this point all I ever get from Roundpoint is the proverbial " the check is in the mail '' routine. Roundpoint seems to want to blame the XXXX, however, this is just an excuse. They could send the funds another way instead of first class mail which can not be traced.

In XXXX, I noticed that some of my payments were not applied to my loan and asked to have it investigated. All I got back was that I needed to call a number even though I communicated that I wanted written communication. Instead, I was approved for a loan modification that I do not remember applying to. I was given contact information for a person to which they never gave back direct communication after I faxed and emailed them about the situation. RoundPoint sent me paperwork for a permanent loan modification that I told them I would not sign until my account was corrected.

My home was damaged by the XXXX XXXX in XXXX in XX/XX/XXXX. My garage and fence were destroyed, the main structure remains standing. The main structure had significant smoke/ash/soot. I received {$38000.00} from insurance for the garage and fence damage. This money was released by Roundpoint Mortgage as it was under the {$40000.00} quick release amount. I subsequently received just under {$60000.00} for the remediation of the smoke/ash/soot damage to the main structure in XX/XX/XXXX. I provided them with the signed contract, the contractor 's affidavit, and the assessment of damage. They sent someone to do a required inspection for release of funds in XX/XX/XXXX. As the report stated the progress was 5 % complete, Roundpoint would not release any funds. This is despite the fact that the structure has been cleaned as per the contract and is well over 5 % complete. It is in fact only awaiting post-clearance test results to verify cleaning was sufficient.

I am facing an imminent foreclosure sale scheduled for XX/XX/year>. I have been in continuous communication with RoundPoint Mortgage Servicing throughout multiple hardships including XXXX job loss, subsequent unemployment, and the death of my father. RoundPoint repeatedly provided incorrect and conflicting instructions, including directing me to pursue a successor in interest process that was not applicable because the borrower is still living. I submitted loss-mitigation and hardship documentation multiple times and was repeatedly told documents were not received, despite resending them XXXX times and confirming delivery. I was recently instructed by RoundPoint to submit a new hardship application marked urgent and expedited, which I immediately did and copied multiple departments. After submission, I was told there was not enough time to review the application before the sale despite RoundPoints own delays and servicing errors. I have a minor child living in the home.

I switched insurance companies and needed to make a payment to escrow using the refund check from my old Insurance company. Per the instructions given on a call I made to RoundPoint in XXXX XXXX I made the payment on the app as instructed and made that payment direct to my escrow account. This payment was made to escrow on XX/XX/XXXX. I noticed in XXXX my payment went up by a few XXXX dollars so I called on XX/XX/XXXX to make sure everything was done properly and I was told they had no record of my payment even thought I can see the payment in my escrow on the app, I have a confirmation # from round point and I see the money coming out of my bank account and going to Roundpoint. The person instructed me to email servicing help and gave me the address. I asked if I could just email to the rep to ensure it got to where it needed but they said they couldnt do that so I emailed servicing help and received a message back saying they got my message.

Mortgage Servicing / Loss Mitigation Complaint We are submitting this complaint regarding our mortgage servicers handling of loss mitigation, failure to comply with RESPA and failure to disclose material loan modification terms. Background We were granted two prior forbearances in XXXX due to unemployment hardship. In XX/XX/XXXX, our hardship was resolved. One borrower is now employed and co-borrower is now receiving XXXX income. We notified our servicer in writing that we are able to resume normal monthly payments. We requested a payment deferral solely to address the temporary arrearage and escrow shortage without extending the loan term. Failure to Disclose Material Loan Modification Terms On XX/XX/XXXX, the servicer issued an approved trial loan modification. The letter listed only three reduced trial payments and stated that no lump sum was due. However, no permanent loan modification terms or final payment obligations were disclosed. This issue is a follow-up to a prior CFPB complaint regarding lender-placed insurance on our mortgage. While the servicer removed the lender-placed insurance prospectively, their response did not address mortgage overpayments that occurred due to delayed correction. The servicer confirmed that the corrected monthly mortgage payment effective XX/XX/XXXX is {$5400.00}. However, we paid {$5900.00} for both the XX/XX/XXXX and XX/XX/XXXX mortgage payments, amounts that included lender-placed insurance which has since been removed. Based on the corrected payment amount, this resulted in an approximate overpayment of {$1000.00} across those two months. The servicers response did not explain how this overpayment was applied or credited. We are requesting : A current escrow account statement showing the full transaction history, including insurance-related disbursements, refunds, and adjustments.

I had surgery and had a hardship with finances. I called my mortgage company who set up a forbearance plan. I did not receive mail regarding acceptance. I did get a letter saying they were canceling the forbearance due to no answer from me. I called, set up a new forbearance plan and did a verbal acceptance around XXXXXXXX XXXX XXXXXXXX. I then got phone calls about late payment, I called on XX/XX/XXXX and they have no forbearance on record. Going through notes and documents they were able to find the verbal acceptance and escalated to manager to be corrected. I was told to call back XX/XX/XXXX for an update. I just called and again, nothing is on file and I have to submit a new application for the forbearance program that I already submitted and accepted. My work also has send a form for them to fill out and send back due to they are wanting to help me bring my account current. They sent the form i believe its called vendor form so my work can add them to pay.

Per their own published policy, and in line with the XXXX XXXX XXXX XXXX, Section 8203.4 and the Homeowners Protection Act, the Private Mortgage Insurance ( PMI ) payments should have stopped being paid after the XXXX mortgage payment in XX/XX/XXXX, when the Loan-to-Value ( LTV ) ratio dropped below 78 % of the original loan value. As of this point the PMI has been paid out of my escrow account 5 times since then. I first reported this discrepancy to the servicer via phone on XX/XX/XXXX. On that call they directed me to fill out their PMI Removal Request Form ( url XXXX XXXX XXXX XXXXXXXX ) Later that same day I e-mailed them back stating that I did not believe this form to be necessary, as it ( A ) only addressed borrower-requested PMI removal, and ( B ) would legally make me required to have an unnecessary, lender-approved, up-front appraisal at the cost of $ XXXX $ XXXX, which does not apply to an automatic-PMI drop nor to a drop that is for an LTV based on Original Value.

I expect a swift response and the removal of this erroneous information from my credit report in accordance with the Fair Credit Reporting Act ( FCRA ). They reported to the credit agencies that I missed a payment, but I sent them all the proof that my bank account had enough money to cover {$710.00}, yet they didn't do anything. Round point said it's nothing they can do about it since they have already reported it. Round point reported in XX/XX/year> as unpaid. However, it wasn't until I received a letter from the credit bureau that it came to my attention. I called round point and they didnt fix it, nor did they notify me of what they had done, damaging my credit.

Escrow advances to be deferred {$4600.00} ( XXXX XXXX Taxes to be paid by XXXX by XX/XX/year>. C. Other outstanding amount to be deferred {$30.00} ( not sure what this is for ) D. Total past-due amounts to be deferred {$11000.00}. This figure is wrong, if you add " A '', " B '', and " C '' you will get {$12000.00}, not {$11000.00} ( See exhibit " XXXX '' ). The difference is {$940.00}. On XX/XX/year>, I paid {$940.00} towards the full monthly payment of $ XXXX amount of {$940.00} was put into " suspense '', as noted on my XX/XX/year> statement. E. Exhibit " A '' clearly states that based upon our review there is an escrow shortage of {$1200.00} and this will be paid over 60 months.

Late last year, I fell behind on my mortgage payments. I went onto the mortgage company app to make a payment and was unable to do so, at which point I called their customer service number and was informed that I was in pre-foreclosure. This was the first notification of any kind I had received stating this. During this call, I was advised of the amount owed and my options, and I was able to enter into a mortgage repayment plan to bring my loan current. I was having a hard time understanding the exact terms of the agreement, but I followed it to the best of my abilities and so far as I can tell, I made all of my payments as required by the payment plan. I even had to take a hardship payout from my employers XXXX ( k ) plan to make the first two payments. When I went to make the third payment, two weeks early remind you, I made an error and tried to draft the payment from the wrong bank account. That payment was rejected by my bank.

I am submitting this complaint about errors in the escrow analysis and handling of my mortgage escrow account. Since approximately XX/XX/XXXX, my mortgage servicer has repeatedly produced incorrect escrow analyses that understate my escrow balance and show an artificial shortage. In response to each analysis, I have independently reconciled my escrow account using the servicers monthly statements, and my ledger shows that the escrow balance should be higher than the amount shown in their analyses, often by approximately {$720.00} - {$750.00}. In multiple escrow analyses, the reported starting balance is significantly higher than the prior analysis 's ending balance. Additionally, several months show XXXX dollars deposited into escrow, even though I make escrow payments every month. If a deposit is truly skipped due to a rolling 30-day cycle, the next month 's deposit should be doubled to catch up.
