I was served with a foreclosure complaint on XX/XX/year> and have been working to reinstate my loan within the statutory reinstatement period. I received multiple reinstatement statements from the servicer reflecting inconsistent total amounts and unexplained fluctuations, particularly in attorney fees and corporate advances. These inconsistencies have made it difficult to determine the correct amount required to reinstate the loan. The reinstatement amount includes attorney fees of approximately {$2800.00} {$3000.00}. I requested an itemization of these fees ; however, I was only provided with a breakdown of court costs ( approximately {$1000.00} ). The attorney fees remain presented as a flat amount without any breakdown of services performed, dates, or time billed. These attorney fees are nearly equal to the past-due mortgage amount and appear disproportionate for the early stage of the foreclosure case.

They improperly marked my account delinquent, blocked my online payment access, XXXX charged unauthorized {$30.00} property inspection fees. I have spoken with Selene representatives on numerous occasions XXXX provided them with my approved XXXX XXXX forbearance documents multiple times. I also sent multiple certified Notices XXXX Error ( including on XX/XX/year> ) containing my forbearance proof. On recorded phone calls ( XX/XX/year> XXXX XX/XX/year> ), Selene verbally admitted my forbearance was active XXXX promised XXXX waive the {$30.00} fee.

Neither my attorney nor I have received any prior communication regarding this foreclosure action. I have not received any notice of default, amount owed, or any documentation outlining the status of my loan. Additionally, nothing has been posted on my property. Despite this, I have continued making monthly mortgage payments, which the company has accepted. I am also still able to make payments via phone using ACH. This raises serious concerns about the accuracy and legality of their actions. I have a new moprtgage servicer that stated I need to send in documents. I emailed the documents but I haven't received a confirmation. I have called repeatedly but have a hard time getting someone on the line. I would call and get a message stating that someone would call back the same day and I wouldn't receive a call. I finally spoke to a rep XXXX weeks ago that promised that I would receive an email with the requested info within XXXX business days. I still don't have the info. The rep also wasn't able to confirm the payment amount. They also haven't responded to my emails.

The request involved auditing the escrow accounts for accuracy due to numerous mistakes, such as incorrect balances, misallocated distributions, unpaid insurance, and unidentified or unreturned taxes across these XXXX accounts. After my initial call to Selene in XXXX 2026, during which time they were unable to provide any of the information I needed, I reached out to the broker. About a week later, my broker, XXXX, informed me that someone would be contacting me as per the owner, XXXX. On XX/XX/year>, XXXX XXXX from Selene reached out to me. I missed his phone call, but he also sent me an email. I replied to him, but did not receive a response. Following a few more conversations with XXXX, a manager from Selene contacted me on XX/XX/year>, to discuss my request. XXXX XXXX spoke with me and collected my information.

On XX/XX/year> Selene Finance gave me a modification deal, which was a trial period and it was supposed to be for 3 months of payments of XXXX until XX/XX/XXXX. Now the month is almost up they said I have to pay XXXX. They keep changing and putting my mortgage higher than I can afford. Im on XXXX and this is the second time Im complaining about them. I receive XXXX monthly. My grandson is XXXX and he receives XXXX. I have a lot of other bills to pay because Im raising XXXX grandchildren. I Im only allowed XXXX from that check, the balance has to go for his expenses such as food and other amenities. I need help because I keep falling behind because of them. XX/XX/year> from XXXX to XXXX, I spoke with a XXXX to get a payoff amount and make the final payment on a HELOC loan. He told me he would request a payoff amount and it would be mailed to me in 7 to 10 business days. This is an interest only loan and I asked to get the payoff and make the payment today so as not to incur more interest as I lost my job and took the money out of my IRA already to reduce my monthly expenses. It took an extremely long time to get a hold of someone live as it always does. This company bought my loan from XXXX who bought the loan from XXXX. XXXX was much worse than Selene as they continually posted my payments incorrectly and were impossible to work with but Selene obviously just collects money as they have no customer service at all! I should not have to pay any interest after this date. I paid what was posted on the website which is not the payoff amount. Payoff amounts are not available on the website.

XX/XX/year> our loan was bought by Selene Finance. We were going though some medical issues at the time and reached out to them for assistance. This took 5 months to complete. At that point they updated our payments and we were ready to start making them again. Our next billing cycle our payment jumped up about {$300.00}. After a month and several calls I was told that my insurance had gone up and that caused it. I checked with my insurance broker and swapped insurance companies to lower the rate. The first insurance company sent me a check, per Selene 's guidance I was to pay the new company with it and I could either put the remainder in the escrow account or use the remainder to pay the higher payment for the next year. They stated that putting in the account would not lower my payment being they only update the escrow once a year. So I kept the extra being I could not afford the new payment. In XXXX I received my bill for XXXX and the payment doubled.

After weeks of tracking this down with Selene, I went back to the owner, XXXX, to handle the refund that was automatically paid by my insurance company when the servicer ( Selene ) missed it. Selene never responded to my request with the proper information. XXXX said they would handle it, and now it is with XXXX, who did reach out on XX/XX/XXXX and knew nothing about this issue. XXXX said they would follow up on XX/XX/XXXX, and they did not. On XX/XX/XXXX, I was sent an email telling me it was handled per our conversation, and it was not. I emailed them back and left a message, and to date, there has been no response. I also sent a lengthy email asking for a point person to navigate this because the {$1200.00} for the insurance was sent to XXXX prior, with the proof of payment, so this wasn't paid twice. TO DATE NO ONE FROM XXXX HAS REACHED OUT TO ME IN ALMOST XXXX WEEKS.

Currently suing the lender Selene Finance for fraudulent Federal laws broken, involving my inheriting the property through a living trust, my living trust States all residues go to XXXX XXXXXXXX XXXX. the loan was previously with a company called XXXX XXXX XXXX and was sold illegally to our new lender Selene Finance who immediately is trying to foreclose without doing a proper accounting of funds missing from the previous lender, XXXX XXXX XXXX verified on a three-way call with our bookkeeper and myself, that the monthly mortgage statements did not add up correctly and has mathematical errors. According to the XXXX XXXX XXXX representative mathematically incorrect and that {$110000.00} was unaccounted for missing or not added in to the mortgage statements. XXXX XXXX XXXX promise to fix the issue sending it to upper level management support but never did instead within weeks sold the loan to Selene Finance with no accounting performed by either company.

Hello, I have sent the information several times for the Mortgage Assistance application, and this company can not keep track of the documents and has closed the file again. I have wasted time re-submitting the application, and then they just sit on it and are not willing to assist me in keeping the property. They have been very dishonest about reviewing the file and assisting me with the process. I was told in XXXX that once we receive all the information, they will create a trial payment plan for the mortgage, and if those payments are made, then they will have a payment schedule. I am not selling the property, nor will it ever be for sale. I need to know what are these trial payments will be so I can review this plan. I have yet to receive any information from this lender/servicer.

I never received my 1098 tax form for XXXX. I submitted an inquiry via email. They stated I needed to fill out a W-9 ( they never had asked me for previously ). I filled it out and sent it back to them. Three weeks went by with no response. I tried again via email with no response. On XX/XX/XXXX and XX/XX/XXXX, called the customer service number several times, waited on hold for ten minutes, then an automated message says it will hold my place online and call me when a representative is available, still no call back. They are out of compliance by not sending me a regulatory form I need to do my taxes. It is also concerning that there is no way to get in touch with customer service.

I requested investigation of specific servicing issues, including escrow history, servicing transfer and boarding records, whether mortgage life or credit life coverage tied to the loan existed or was ever investigated, whether any death-triggered claim was submitted after the borrowers death, payment history, and internal notes and logs. Selene did not meaningfully address those issues. Instead, after I filed a CFPB complaint, Selene responded by again asking for documents relating to my authority, even though Selenes own response attached my original email showing that I had already stated the Letters Testamentary were enclosed.

Instead, the response included limited records covering later time periods and did not address the escrow activity, balances, or transfers during XXXX, which remain central to my dispute.

After the borrowers death on XX/XX/year>, I acted in good faith to resolve the mortgage and confirm what protections applied, including mortgage life insurance connected to the loan. XXXX XXXX was the last known servicer handling the loan while escrow records still reflected mortgage life insurance, and that is the company the borrower had been paying. Servicing was later transferred to XXXX and then to Selene Finance. Once Selene took over, I was repeatedly asked for the same documents for months to prove successor-in-interest status, even after I had already provided them. I received different answers depending on who I spoke with, was never given a reliable point of contact, and received boilerplate letters that did not address the actual questions I was asking. Selene also falsely claimed that I had sent a cease-and-desist letter, which I did not send, and that false statement appeared to be used as a reason to avoid communicating with me.

I have an active homeowners insurance policy that has been in effect with no lapse in coverage. The policy meets the required coverage limits and lists Selene XXXX as the mortgagee. I have provided proof of insurance and the declaration to Selene XXXX multiple times. Despite submitting the required documentation and being told the issue would be resolved with XXXX business days, the lender-placed insurance has still not been removed from my account. Because of this error, my monthly mortgage payment has increased by approximately {$600.00}. This increase is solely due to the improper lender placed insurance. On XX/XX/year>, Selene Finance drafted a Notice of Default and Intent to Accelerate letter. I received the letter on XX/XX/year>. The following payments of {$1900.00} were made on XX/XX/year>, XX/XX/year>, and XX/XX/year>. Today, XX/XX/year> which is the last day to cure the default, I logged onto the website and it would not let me make another payment online. It told me I need to call XXXX. When I called XXXX his number I was given XXXX payment options : an AI payment option or the telephone payment option. In the traditional telephone payment option, I can not amend the amount to just the fees. It is asking for an entire mortgage payment. I have the remaining balance of {$920.00} to cure the default. I even tried to use the online chat to tell them specifically that I was trying to process my payment to cure the default on my loan. It then sent me to the " make a payment '' option which is now inactive on the website because I have future payments scheduled.

I am filing this complaint against Selene XXXX XXXX regarding an incorrect payoff calculation and their failure to correct a clear error despite numerous attempts on my part to resolve the issue. Selene XXXX acquired the mortgage note on my rental property at some point during the life of the loan. In XX/XX/XXXX, I had the tenant vacate the property and placed the property on the market for sale. Since the property was no longer generating rental income to cover the mortgage, my plan was to alternate mortgage payments between this property and another property I own so that neither loan would fall more than 30 days behind. Once the property was sold, I intended to bring the other loan current and resume normal payments. At the time, I was not aware that Selene XXXX had a clause in the promissory note stating that if a payment becomes 31 days or more past due, the interest rate increases from 4 % to 22 %, and they will not accept partial payments.

However, i have proof from the agency called XXXX XXXX XXXX that they sent the loan modification packet to Selene finance on XX/XX/XXXX at XXXX XXXX. I have the actual email confirmation along with the loan modification as provided to me by XXXX XXXX located at XXXX XXXX XXXX XXXX, XXXX, XXXX XXXX and their telephone number is XXXX. The bottom line is Selene finance has filed paperwork to foreclosure on my house and they are refusing to acknowledge that this modification packet was sent to them and this is a major violation under federal law. I know I have a strong case of violating federal law for still not getting back to me after 10 months.

After the prior complaint was closed, Selene issued a loan modification determination letter dated XX/XX/year> denying our request based on debt-to-income ratio. We appealed that decision and recieved a denial of that appeal dated XX/XX/year>. On XX/XX/year> Selene sent us a letter encouraging us to contact the company to discuss foreclosure alternatives such as repayment plans, temporary forbearance, or loan modification options that could help us remain in the home. We received both this letter and the appeal denial letter after office hours on XX/XX/year> and contacted Selene the following day as instructed.

On the last payment date they took {$1200.00}. I had no prior notice or explanation. I was forced to file a dispute through my bank. My loan # is XXXX. In reading numerous complaints about this company I see where a common practice is to add a second homeowners policy. I was never notified of this move. My home has continually been insured with XXXX XXXX with no lapse in coverage. In fact Selene pays the premium from my monthly payment. I am XXXX on a fixed income and can not afford this additional payment. The current payment of {$1100.00} and each subsequent payment in that amount will be available as per our agreement. If Selene refuses to the agreed terms we had in place they can take their payment ( s ) at any time.

My insurance company said that my policies have lapsed because payments aren't made although my account is escrowed. My payments also increased tremendously.
