Happened XX/XX/XXXX at XXXX. We told them to stop on text messages. This is not my number and they still skip trace to her I have absolutely no idea why. She is getting irritated and its causing me so much stress. They are harassing a XXXX XXXX XXXX woman when they most likely know its not me. I am filing a formal complaint regarding improper and unlawful debt collection practices by Shepherd Outsourcing USA ( or associated entity listed in the communication ). Or XXXX XXXX XXXX XXXX shown as current creditor On XX/XX/year>, an email was sent concerning an alleged debt belonging to XXXX XXXX. However, this email was sent to XXXX XXXX, who is not the debtor, has no legal responsibility for the account, and has not provided any authorization to receive information about this debt. This communication constitutes an unauthorized third-party disclosure of debt information and appears to be a violation of the Fair Debt Collection Practices Act ( FDCPA ), specifically 15 U.S.C. 1692c ( b ), which prohibits a debt collector from communicating with any person other than the consumer regarding a debt without prior consent.…
The actual problem is they sent an email to my mother, with the amount of the debt and who it was owed to. This directly violates my rights.they also sent a text to my mother about a different debt I owed that also had the amount and who it was owed to. If this behavior continues, I will be suing them.
Please see the attached Statement of Facts and Evidentiary Exhibits for the complete, documented timeline of violations. XXXX XXXX XXXX and XXXX XXXX are operating a mail-merge and compliance system that is dangerously incompetent. By blindly merging records based on a shared last name, from a letter explicitly stating a mistake has been made, they have weaponized the Complainant 's identity, compromised the Complainants credit report, caused the Complainant additional stress and labor required to correct the error, caused the Complainant to spend the additional time and labor required to report their incompetence to the relevant government oversight agencies, and severely compromised the financial and personal privacy of a Texas resident. Resurgents agent, Shepherd Outsourcing, utilizes an Automatic Telephone Dialing System ( ATDS ) without prior express authorization to systematically engage in predatory collection practices.…
I am disputing an erroneous debt for a XXXX XXXX XXXX account. In XX/XX/XXXX, I attempted to pay the full balance using XXXX third-party settlement checks ( totaling {$190.00} ) from a home equity loan. The creditor erroneously flagged these legitimate checks as fraud and closed the account instead of applying the funds, which prevented further payment. I have formally disputed this with the collection agency, XXXX XXXX, and the debt owner, XXXXXXXX XXXX, via email on XX/XX/XXXX, and again on XX/XX/XXXX. In both instances, I provided physical proof of the XX/XX/XXXX payments. Despite this, the companies provided a " validation '' response that intentionally omitted all account records from XXXX, XXXX, and XX/XX/XXXX, providing irrelevant statements from XXXX and late XXXX instead. They have failed to conduct a meaningful investigation into my proof of payment as required by the Fair Debt Collection Practices Act and Texas state law.…

Received a voicemail from someone claiming to be a process server ( stating if he couldnt reach me at home he was required to reach me at work and get my manager and supervisor to witness me being served I have this in a voicemail. ) but when I returned the call it went to a call center where they claimed to be a mediator for the original creditor. I was repeatedly taunted by the individual on the phone telling me how broke he thought I was, called me brokey several times. Told me that my credit would be ruined, and then began mentioning vehicle makes and models we have had registered in our name at one time or another and saying this is going to be fun as if they were threatening to take the vehicles. I am filing a complaint regarding a debt collection communication sent by Shepherd Outsourcing regarding an alleged XXXX XXXX Bank account now owned by XXXX XXXX XXXX. On XXXX XXXX, Shepherd Outsourcing sent a text message to a third party ( a family member ) disclosing my name, the original creditor ( XXXX XXXX Bank ), and that the account had been placed with a debt collector. This third party is not responsible for the debt, is not a co-signer, and was not authorized to receive information about my financial account. This disclosure appears to violate the Fair Debt Collection Practices Act ( 15 U.S.C. 1692c ( b ) ), which prohibits a debt collector from communicating with third parties in connection with the collection of a debt and from disclosing the existence of a debt. Additionally, this account is approximately four years old, and I have not made payments in over four years. Under New York law, the statute of limitations on credit card debt is three years.…

Sherpherd Outsourcing has contacted me via text message twice regarding a debt that does not exist. First XX/XX/year> at XXXXXXXX XXXX and again on XX/XX/year> at XXXX AM. They are employing scare tactics by using the phrase " we only have a limited time to work with you before we return your [ account ] to our client ''. I do have a Synchrony card, but I do not have an outstanding balance on that account nor have I ever been past due on that account. I checked directly with XXXX to confirm this. I have no outstanding debt for them to attempt to collect, and even if I did there would have been zero reason for Synchrony to not contact me directly.

At this time, no competent evidence has been provided to substantiate the debts, including but not limited to a signed agreement, itemized billing, or proof of lawful assignment. I am concerned that the collector may attempt to furnish inaccurate or unverified information to consumer reporting agencies prior to completing validation, which would violate the FDCPA and FCRA. I am requesting the CFPB require the collector to : XXXX. Cease all collection activity until proper validation is provided XXXX. Confirm that no credit reporting will occur absent lawful validation XXXX. Correct and prevent any inaccurate reporting I request written confirmation of compliance.
