I am disputing the handling of an auto loan payoff involving joint-payee checks issued by XXXX XXXX XXXX XXXX XXXX XXXX XXXX issued a payoff-related check payable to XXXX XXXX AND XXXX XXXX XXXX '' I mistakenly mailed the check, along with a personal check for {$180.00} to cover any excess, to Stellantis. For context, I have open auto loans with both Sellantis FS and XXXX XXXX for XXXX different vehicles. Stellantis negotiated ( cashed ) both checks. Stellantis then mailed me back a check only for the amount of my personal check ( {$180.00} ), while retaining the larger XXXX XXXX payoff check. Despite cashing the XXXX XXXX payoff check, XXXX XXXX has not applied the payoff to my loan, transferred the funds to the appropriate financer under XXXX ( XXXX XXXX ), and has failed to respond to my several requests to investigate. XXXX XXXX has also failed to respond substantively to my CFPB complaint and has not provided XXXX XXXX with the confirmation necessary to resolve the payoff.

On XX/XX/year>, I called the customer service number and advised the company that I wanted to settle on the car because the value is 50 % of the remaining loan and I can no longer pay the payments. The customer service representative asked how much was I offering for settlement. I offered $ XXXX, which is 50 % of the remaining balance. I explained to him that the car is valued at $ XXXX and I will pay it in full to satisfy the loan. He placed me on hold and returned to the call and asked if I could pay it in 7 days. I said yes, I need a letter to provide to the XXXX company for the funds. He said ok. We ended the call. I called back the next day inquiring about the letter. I was told that they are preparing it. I called again in Wednesday, and was told to give them until Friday. Today is Friday and I called to inquire about the letter, I was placed on extended holds to be advised that they want {$11000.00} to settle. I advised them that this is not what was discussed on Monday.

Prior to the repossession, I made attempts to bring my account current by paying the past-due balance. However, the company refused to accept my payment and did not provide a reasonable opportunity for me to cure the default. Despite my willingness and ability to resolve the delinquency, my vehicle was repossessed without proper cooperation or good faith effort from the lender. Which was over XXXX months of time in service. So, the XXXX service XXXX asked me to have the finance company sell the car bac to the manufacture because they could not promise me that it would not have issues again. When I did that the finance company picked up the car and sold it in an auction. I leased the car for XXXX with a XXXX rebate meaning that there was XXXX.

The insurance company is refusing to pay me directly because Stellantis Financial Services ( the leasing company ) claims they are the owner and only they are entitled to the money. I am the one who will suffer the actual financial loss when I trade in or sell the vehicle. The lease agreement should allow the lessee to pursue diminished value claims for damage that occurred during the lease term. I have already sent a formal demand letter to Stellantis, but they are blocking the claim. I am requesting CFPB assistance to compel Stellantis to either release the {$4000.00} to me or apply it as a credit to my lease balance.

Without my knowledge or consent, the dealership generated a second, forged contract dated XX/XX/XXXX, which inflated my payment to $ XXXX. When I confronted the dealership management about this forgery, they attempted to coerce me into signing a 'Waiver of Liability ' as a condition for correcting their 'error. ' I have a full audio recording of the dealerships employee who the manager sent out attempting to force this waiver on me in exchange for fixing the forged contract. And issuing a check. I refused to sign away my legal rights, and as a result, they have refused to rectify the fraudulent XX/XX/XXXX lease with Stellantis Financial Services ( SFS ). This fraud is causing me direct financial harm.

I am submitting a follow-up complaint regarding an unresolved issue involving an auto loan serviced by First Investors Servicing Corporation on behalf of Stellantis Financial Services . In response to my prior CFPB complaint, the company acknowledged that a servicing error occurred involving my mailing address. Specifically, an unnecessary Apt designation was added, which likely prevented delivery of the welcome letter and initial billing statement. Because of this error, I did not receive the normal billing notice required to establish the account and make the first payment. Despite acknowledging this error, the company has not provided a complete resolution. I requested that the first payment due date be adjusted to XX/XX/year> to reflect the lost billing cycle caused by their mailing error. This is a reasonable request intended to place the account in the position it would have been in had proper notice been provided.

During my lease financed through Stellantis Financial Services, the vehicle experienced a major mechanical failure that ultimately required a full engine replacement under manufacturer warranty. The issue began around XXXX or XXXX of XXXX, and the vehicle remained at the dealership for an extended period while repairs were performed. I did not receive the vehicle back until approximately XX/XX/XXXX, resulting in a loss of use for roughly three months. During this time, I continued making lease payments despite not having possession or use of the vehicle. Additionally, while the vehicle was in the dealerships possession for engine replacement and testing, it was driven as part of the diagnostic and repair process. As the lessee, I had no control over any mileage accumulated during this period. When the vehicle was returned to me, it had not been properly detailed and was returned with an empty fuel tank, despite being told it would be cleaned and refueled prior to pickup.

The repossession occurred after the first two lease payments were not processed because of an autopay setup error. When setting up autopay, I mistakenly entered a check from a bank account that had been previously closed due to fraud. This was an honest mistake during the initial setup and not an attempt to avoid making payments. I have an active and valid bank account and I am fully willing to immediately bring the account current. I have offered to pay all past-due payments, late fees, repossession costs, and any other reasonable charges necessary to reinstate the lease. I also received written notices regarding missed payments significantly later than the dates printed on the letters. Why was the lights flashing into our home woke up my grand my granddaughter shes XXXX XXXX from the way everything transpired I have witnessed statements from my neighbor stating that it was a public disturbance and that they think the tow truck driver flashing lights on my home once again the car was in visual. There was no need for the tow truck driver to have lights on when he didnt have a vehicle on the car on the tow truck.A. Illinois Vehicle Code ( 625 ILCS 5/ ) Repossession is allowed only after default, but it must be done without breaching the peace.

A check was overnighted to XXXX financial on XX/XX/XXXX and signed for at XXXX am according to the finance person at XXXX XXXX. Since XX/XX/XXXX I have received multiple phone calls, emails, and text messages stating that the loan was past due. I had called XXXX financial twice on XX/XX/XXXX and provided them an email that I received from XXXX XXXX at XXXX XXXX. The first rep that I spoke with told me that I needed to contact them and that I needed permission to trade in a vehicle. I leased a vehicle in XX/XX/2025 and enrolled in ACH auto-pay at account setup. In XX/XX/2025, an ACH auto-pay attempt failed. I was never notified of the failed payment by email, phone, or timely mail, and I was not provided any opportunity to address the issue before negative credit reporting occurred. On XX/XX/2025, I first learned of the issue through third-party credit monitoring alerts indicating that I had been reported XXXX days late. This was the first notice of any kind. I immediately logged into my account and paid the balance in full the same day. I contacted the companys customer service department on XX/XX/2025. During that call, the representative confirmed that Stellantis Financial Services does not notify customers when an ACH auto-pay transaction fails and acknowledged that no communications are sent for this type of error. The representative reversed all late fees associated with the incident and opened a case regarding my experience, acknowledging the issue.
