XXXX. I have never received any mail regarding this from Heights Finance. I received notice of the garnishment from my employer when they received the paperwork. At the bottom of page XXXX of document XXXX, it states that the CREDITOR MUST SERVE THE FOLLOWING DOCUMENTS ON THE DEBTOR AT THE TIME OF SERVICE OF THIS DOCUMENT ( XXXX, XXXX, XXXX, AND XXXX ). I have never received these documents from Heights Finance. I moved to XXXX XXXX in XXXX of XXXX. I changed my address and everything to make sure all my mail was sent to my new address. I feel like sending it to the wrong address is a tactic by Heights Finance to get courts to rule in their favor. XXXX. Wisconsin statute XXXX states that the debtor must be notified of the garnishment proceedings by the creditor. I never received any notice from Heights Finance until my boss brought me the original garnishment papers on XX/XX/XXXX and most recently XX/XX/XXXX. XXXX.

Despite this, the account continues to be reported as a charged-off account, which is inaccurate and misleading. On XX/XX/XXXX, I sent certified letters to both Covington Credit and XXXX XXXX XXXX XXXX requesting validation of the debt and correction of the reporting. I have proof of certified mailing. The companies failed to provide proper validation or correct the inaccurate reporting. Instead, the account continues to appear on my credit report in a way that negatively impacts my creditworthiness. Additionally, the debt was sold to a third-party collection agency, yet the original creditor is still reporting the account inaccurately. This creates duplicate and misleading reporting. This behavior violates the Fair Credit Reporting Act ( FCRA ) and the Fair Debt Collection Practices Act ( FDCPA ), as well as the bankruptcy discharge injunction under 11 U.S.C. 524.

When I made my XX/XX/XXXX payment on XX/XX/XXXX, I requested an account statement to be mailed to me with my balance and transaction history for the last 6 months. Every month I call in and make my payment on time and ask what my balance is and write it down. I never receive emails with any account info and have no online access to a portal and when I do receive mail from them, it only states that I approved a one time transaction of XXXX to be paid but never gives an account history or balance. My wife suggested I get a balance in writing since I have no real history beyond my scribbles on a notepad to protect myself and glad I did. We received our tax refund and decided to be positive and eliminate a bad debt. I called to pay the loan off on XX/XX/XXXX and was advised that the balance was nothing close to what I've been tracking and what was just sent to me. ( See attached file ) Told payoff was $ XXXX. I am filing a new complaint regarding Heights Finances handling of my auto loan dispute and materially inaccurate statements made by Heights Finance in response to a prior CFPB complaint. In XX/XX/2025, I purchased a used vehicle from XXXX XXXX after being expressly told in writing by the dealership that the vehicle had no transmission issues. The purchase was financed through a retail installment sales contract that was assigned to Heights Finance, making Heights Finance the assignee and holder of the contract and subject to all claims and defenses under the FTC Holder Rule ( 16 C.F.R. 433 ). Immediately after purchase, the vehicle exhibited serious transmission problems, including harsh shifting, delayed engagement, slipping, and unsafe drivability. The check engine light illuminated the day after purchase, and diagnostic scanning indicated transmission-related fault codes. I promptly notified the dealership and returned the vehicle for inspection.

I contacted heights finance because I saw them reporting on my credit and did not apply for any type of loan from them. I first noticed in may and had the dispute started the dispute and have yet to receive any information such as picture of the check that was signed who released the funds or who cashed it. Thy gave me information from my account that has no connection to me such as wrong phone number and wrong email, they only got the correct information because I called them and gave them my email. When I started the dispute I turned in a fraud packet the XXXX branch and had them note on my account I had done so. During my recent phone call they said they have yet to receive it yet it was on my account that I turned it in they also said it was scanned onto my account so they have a digital copy of it.

I had an automobile loan with Heights finance. I totaled my car and my insurance paid off the loan. I attempted to get another loan but due to my credit score, I was denied. This was after I sent over my pay information and other documents many times and was told I would be able to get a loan but after over a month, was told I could not. Then, the company mailed me a check for about {$1300.00} that I cashed. It was an agreement that I would pay it back in installments. I was able to make a few payments then lost my job. I worked with different people and gave Emailed proof. Their collections department kept calling me during this time, meanwhile the staff there told me they could get approval for me to refinance the loan. I have a recording of the collection call where the person was yelling at me and kept asking me what I did with the money and why did I cash it when she kept saying I purposely cashed it without any intention on paying it back.

Southern financial is willfully violating me as a consumer and federal law. They are harassing me for a debt I have told them was a result of identity theft because they had no authority to create any account nor permission to have my private information. Heights Finance includes an XXXX arbitration clause in their loan contract, but they have not honored it. I initiated arbitration as required, and Heights Finance failed to pay the required XXXX business fees. Despite their refusal to follow the arbitration clause in the contract, they continued to pursue court action and wage garnishment against me. I recently went back to court asking the judge to honor the arbitration agreement and quash the garnishment. At the hearing, XXXX XXXX representative stated that I have not made any payments since the garnishment began. This was completely false. I have had XXXX months of bi-weekly garnishment payments taken out of my paycheck, and the court records show this. Their representative also told the court that they attempted to contact me using an outdated address and phone number that were never on my loan application. Their false claims have harmed me financially and personally. I am being denied housing due to the ongoing garnishment.

Ive repeatedly contacted Heights Finance about falsely reporting a substantial increase in balance due, and they have not corrected it with all credit bureaus, which is causing my credit score to drop with all credit bureaus. This situation is causing emotional stress because this has caused me to get denied for credit, due to an outstanding balance that doesnt exist. Heights Finance is reporting an increase in balance owe of {$120000.00} and I only owe close to {$13000.00}. Ive even spoken to the credit bureau in which they told me to contact Height to have them send an update for the month of XXXX to clear this update and they fell to do that as well.
