Debt collector failed to validate debt under FDCPA I am filing this complaint regarding a debt collection company that contacted me about an alleged debt. I timely requested validation of the debt pursuant to the Fair Debt Collection Practices Act ( FDCPA ). Despite my request, the company has failed to provide adequate verification of the debt. Instead of properly validating the debt, they have continued collection efforts. This appears to be a violation of 15 U.S.C. 1692g I am requesting that the company : 1. Provide proper written validation of the alleged debt ; or 2. Cease all collection efforts and remove any negative credit reporting related to this account.

Beginning in XXXX, I disputed an alleged XXXX XXXX credit card debt with The Bureaus, Inc. in writing and requested lawful validation. I specifically requested proof of ownership or assignment of the account and account-level documentation showing the account is attributable to me. The company responded multiple times with letters providing only summary data fields ( such as dates and balances ) derived from its clients records, but did not provide ownership documentation, account-level records, or evidence establishing that the account belongs to me. Despite this, in a letter dated XX/XX/XXXX, The Bureaus stated that it had conducted an investigation, that the disputed information was accurate, and that its response met federal validation standards, citing multiple federal circuit courts without identifying any cases or explaining their relevance. The letter did not identify what documents were reviewed, who conducted the investigation, or how accuracy was determined.

I am filing this complaint regarding Bureaus, XXXX furnishing inaccurate, misleading, and incomplete information to consumer reporting agencies in violation of the Fair Credit Reporting Act ( FCRA ). Based on my credit report XXXX XXXX XXXX XXXX is reporting a collection account with ongoing monthly delinquency indicators extending well beyond XXXX XXXX at which the account should have reached a static status. The payment history reflects continuous delinquency rather than a fixed collection or charged-off status, which materially misrepresents the nature of the account and constitutes improper re-aging. Additionally, the account does not clearly or accurately report a verifiable Date of First Delinquency ( DOFD ). The credit report shows delinquency markers without identifying the initial delinquency date that led to collection placement, which is required for accurate and complete reporting under the FCRA.

This complaint is also my official request for debt validation to THE BUREAUS INC. My attached letter clearly specifies the documents that must be provided under the FDCPA : the original signed contract, proof of ownership or assignment, the purchase agreement, and a detailed accounting of the balance. By using the CFPB complaint system, I am making sure my request is documented, forwarded, and acted upon properly. Consumers have the right to full transparency, and I expect THE BUREAUS INC to provide complete validation. To further protect my rights under the FCRA, I am also requesting information to verify the accuracy and completeness of the account they reported to the Credit Bureaus : the Date of First Delinquency, the date the account was charged off ; and the date the account was acquired by or assigned to THE BUREAUS INC.

I am disputing the accuracy and validity of a collection account being reported by THE BUREAUS. The account was opened on or around XX/XX/year> and is reported with an open balance of approximately {$470.00}. I dispute this debt because THE BUREAUS has failed to provide proper validation proving that I owe the alleged amount and that they have the legal authority to collect and report this debt. Despite the account being marked as disputed by consumer, the company continues to report the account without providing verification of the original obligation, a complete payment history, or documentation showing how the balance was calculated. Additionally, the reporting appears inaccurate and incomplete under the Fair Credit Reporting Act ( FCRA ), as the account lists THE BUREAUS as both the original creditor and the collection agency, which is misleading. I have not been provided with evidence of an original contract, billing statements, or assignment of debt.

A collection account from The Bureaus , Inc. in the amount of {$310.00} was previously disputed and deleted from the consumers credit file after investigation. On or about XX/XX/year>, the credit bureaus reinserted this previously deleted collection account onto the consumers credit report. The reinsertion occurred without any written notice to the consumer within five business days and without providing proof of certification from the furnisher verifying the accuracy of the information prior to reinsertion. This action violates FCRA 611 ( a ) ( 5 ) ( B ) and Regulation V ( 12 C.F.R. 1022.43 ), which require certification by the furnisher and written notice to the consumer when previously deleted information is reinserted. The consumer was not notified by mail, email, or electronic alert and only became aware of the reinsertion by independently reviewing the credit report.

Subject : URGENT : Systemic FCRA/FDCPA Violations & Willful Deceptive Practices I am filing this formal complaint against The Bureaus, Inc. for a pattern of willful non-compliance with the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681, and the Fair Debt Collection Practices Act ( FDCPA ), 15 U.S.C. 1692. Violation 1 : Fraudulent Misrepresentation of Creditor Identity ( 15 U.S.C. 1681s-2 ) The furnisher is willfully reporting false data by listing themselves as the " Original Creditor '' on my credit file ( see attached evidence ). This is a factually false statement. The Bureaus , Inc. is a third-party debt buyer. I never executed a contract with this entity. By masquerading as the originator, the furnisher is corrupting the data lineage and misleading scoring models to treat this junk debt as a primary financial obligation. This is a deceptive trade practice under the FDCPA intended to confuse the consumer and the credit bureaus.
