I was granted a loan from Tower Loan in XXXX of XXXX. I have never missed a payment until XX/XX/XXXX. They give a five day grace period and I was one day late and they begin to harass me. My loan is due on the XXXX of each month and on the very next day, the phone calls start. Within the five day period, they called my parents and they are not authorized to do so. They even visited my home on two separate occasions. Their tactics to collect are against privacy and I want them to cease and desist all phone calls to my parents and they are not allowed to visit my home.

The envelope clearly displayed my full name and address and was visible to the public. This action exposed my personal information and potentially my debt status to neighbors and anyone passing by. I believe this is a violation of my privacy and may be a violation of the Fair Debt Collection Practices Act ( FDCPA ), which prohibits public disclosure of debt information. I did not give permission for home visits or for my information to be displayed publicly in this manner.

I am writing to formally express my dissatisfaction with the conduct of Tower Loan. Despite my account being current and having no outstanding issues, I received persistent, unnecessary phone calls from your XXXX office on a daily basis. This behavior was both disruptive and unwarranted. Due to the frequency and nature of these calls, I ultimately had to block your number to avoid further interruptions. I also found it highly inappropriate that your representatives contacted my workplace, even after I specifically requested that they refrain from doing so. There was absolutely no justifiable reason for Tower Loan to reach out to my employer, as my account was never delinquent. I am providing a record of all the calls I received to support my complaint. Based on my experience with various financial companies, I have found Tower Loans practices to be particularly unprofessional and distressing.

I am filing this complaint due to repeated failed attempts on my part to resolve a debt with Tower Loan prior to any legal or garnishment action being taken. After initially falling behind on the loan due to a loss of employment, I made multiple good faith efforts to communicate with Tower Loan and work toward a resolution. During that time, I specifically reached out and explained my situation, including that I had lost my job shortly after taking out the loan and was doing everything I could to stabilize financially, especially with a child on the way. Once I secured new employment, I again reached out directly to Tower Loan and informed them that I was now in a position to begin repayment and wanted to settle the account. During these communications, I was repeatedly told by a representative ( XXXX ) that the matter would be handled internally and that I would be able to resolve the debt without escalation.

Despite my efforts to obtain proper verification, Tower Loan has failed to provide sufficient documentation to support the legitimacy of this alleged debt. I have been a customer of Tower Loan since approximately XXXX and have taken out multiple installment loans, many through their " re-up '' ( refinance/renewal ) process. This practice has resulted in me paying thousands of dollars over several years while the debt cycle continued due to high precomputed interest, upfront fees, and add-on products that reset the loan terms repeatedly. I have paid Tower Loan at least {$10000.00} since XXXX alone, on an original loan amount of approximately {$4000.00} plus several re-ups of {$500.00} {$600.00} each that added further fees and interest. Despite these substantial payments well exceeding the principal borrowed plus significant interest the XX/XX/XXXX loan shows as {$3700.00} on my credit report, while the current balance is approximately {$2000.00}. I do not currently possess copies of the original loan documents.

Company is in violation of predatory lending and failure to disclose ballon payments and failed to report payments to decrease loan amount. I applied for XXXX with a payback amount of 2000 and once 90 days passed Tower Loans contacted me that my account has increased interest due to me paying future payments for 6+ months which the future payments weren't recorded on the account also. I am filing this complaint for violations of consumer protection laws and the Fair Credit Reporting Act ( FCRA ) related to inaccurate credit reporting and failure to investigate disputed information. Experian is reporting multiple negative accounts, including charge-offs, collections, and late payments, that are inaccurate, incomplete, and/or unverifiable. I formally disputed these accounts ; however, Equifax failed to conduct a reasonable reinvestigation as required under federal law.

I submitted a Servicemembers Civil Relief Act ( SCRA ) request to Tower Loan on XX/XX/year> requesting the required interest rate reduction to 6 % for a loan account currently charging 31.71 % APR. The request included notification of XXXX XXXX military service. As of XX/XX/year>, the lender has not adjusted the interest rate or provided confirmation that the loan is being recalculated under SCRA protections. The account continues to show a 31.71 % APR. Under the Servicemembers Civil Relief Act, creditors are required to cap interest at 6 % for qualifying debts incurred prior to XXXX XXXX and must forgive any interest above that rate. I am requesting that the lender immediately review the account, apply the 6 % interest cap retroactively, and refund or credit any excess interest charged.

I have a loan with Tower Loan located in XXXX XXXX XXXX I was behind on my loan because I have to miss work a lot due to XXXX XXXX. So on Tuesday XX/XX/XXXX I called and spoke with XXXX XXXXXXXX to make a payment of {$150.00} on my account and she stated that I needed to come by and pay I couldnt do it over the phone so I let her know I would try to come by the next or day and pay it. When I got home I had another check from Tower Loan in my mailbox so I deposited it in my account I was going to use it to catch up on the other loan but I had to wait a week before it actually settled in my account. On Friday XX/XX/XXXX XXXX XXXX called my husband who is only a reference on my account and told him I was behind on my loan and that I had cashed another check and aint paid the one I got and if it was her she wouldnt have gave me anything and that I tried to call and pay something over the phone but she wasnt about to take that I was gon na come in.

It is a live person that calls and asks to speak to " XXXX XXXX '' or a live person leaves a voicemail asking for me to have " XXXX XXXX '' contact them. I have spoken with them on 5 occasions, XXXX, XX/XX/XXXX, XXXX, XXXX and XX/XX/XXXX. Each time I call, I explain to them that I DO NOT know who XXXX XXXX is and don't know how I got associated with said person and that I have had my # for 25 years and could they take me off of their list. They assure me every time that they will remove me and apologize for the inconvenience, but they still continue to call. I have even reached out to law enforcement to no avail.

Despite this, Tower Loan and its attorneys have continued garnishment and are reporting outstanding balances to the credit bureaus. The balances being used include estimated totals and projected future interest and fees through XXXX, not the actual accrued amounts to date under the judgment. XXXX XXXX XXXX XXXX is enforcing the XXXX XXXX judgment, but enforcement and credit reporting must be limited to actual, accrued, court-approved amounts to date. I have requested a full, itemized accounting and confirmation that garnishment will cease if the judgment is satisfied to date. I am disputing the continued garnishment and inaccurate credit reporting based on projected/estimated balances and request immediate correction.

Both letters clearly displayed our full account number, along with specific debt and payment information. The letters imposed short payment deadlines and threatened a lawsuit and liability for court costs and attorneys fees, despite no lawsuit being filed or served and no lawful service of process occurring.

I do not wish to speak to them, as any conversation before I can pay the past due balance, is not productive in my opinion. The loan is through Tower Loan ( the Company ) and was made in Missouri. Tower Loan ( the Company ) contacted my family member, whom they do not have a business relationship with, via a cell phone, which they do not have consent to contact ( Possible violation of the Telephone Consumer Protection Act ). Tower Loan has repeatedly contacted third parties regarding my account. Despite having my direct contact information, the company contacted members of my former spouse 's family multiple times. Specifically, my former mother in law was contacted multiple times in succession, and another relative was contacted in a different state. These individuals are not responsible for my account. On XX/XX/year>, Tower Loan contacted my sister by phone and text message and disclosed my private loan information without my consent. They provided her with my account number and the exact amount of my debt. Initially, my sister was confused and she called them to find out what they were talking about. Then they let her know that the account and debt belonged to me and that she was listed as a reference on the loan application. During this call, Tower Loan representatives asked my sister whether or not I was working at school. She disclosed to then that she is only a reference for the application, and is in no way related to the debt and that they should contact me. They later contacted her again and stated that my tax refund could be used to settle the debt. I never authorized Tower Loan to discuss my account, debt amount, or personal financial information with my sister or any third party.

I have received at least two communications from Tower Loan, with payment details. However, I do not have a loan with Tower Loan, and never have in the past. It seems like a phishing attempt to me. I got an email on XX/XX/year> with the subject line " XXXX XXXX XXXX from Tower Loan '', body : " Please save the attached payment authorization for your records. '' I did not open the attachment so I can't say what's in it. I got another email on XX/XX/year> with the subject line " Payment Confirmation '', XXXX of the email is a photo graphic showing payment amount, a customer ID, and a Payment Ref #. The total amount paid is shown as {$190.00}. Both came from : XXXX As I've never had a loan with this company I don't know why they are contacting me. I don't have any transactions on any of my accounts matching this amount either. I don't know if the customer ID they have listed is real- maybe for another person? But it certainly isn't mine.

On XX/XX/year>, I delivered a written notice informing Tower Loan that my employer prohibits personal calls at my workplace and requesting that all workplace contact cease. Despite this written notice, Tower Loan has continued calling me at work multiple times During one of these calls, a Tower Loan representative explicitly acknowledged awareness of my request by stating, I know you dont like us calling you at work, but, and proceeded with the call anyway. These repeated workplace calls after written notice are disruptive, inappropriate, and coercive. My employer does not permit personal calls, and Tower Loan has been clearly informed of this.

I received a phone call from Tower Loans prior to my due date of XX/XX/year>, offering a skip a payment for the month of XXXX and was asked if I needed any additional holiday money, to which I responded that I did not need any additional funding, but I would like to skip a payment. The phone call concluded and I was under the impression that my XXXX payment would be skipped per the phone call and offer I received. I received another phone call offering the same skip a payment to which I replied that I had already received a call and would like to have my XXXX payment skipped. The following week I received another call saying my account was past due. I informed the employee that I had spoken with someone twice about skipping my XXXX payment, he apologized for the confusion on his end and said he needed some information to process the skip a payment. I answered his questions, thanked him for his time and hung up.

The phone just rings and rings nonstop. This was my experience in XXXX of XXXX, and my experience I had calling them XXXX, and also today XXXX. When I'm unable to reach this office, I look online to find another branch in Illinois. This online search typically leads me to The Tower Loan branch located in XXXX XXXX. I made a call to the XXXX branch today XXXX at XXXXXXXX XXXX XXXX time. I spoke with a lady who was very nice, explained the issue that I've been trying to call the XXXX branch to get information about upcoming payment but unable to reach them. This person then asked if I could hold on the line and she would call them and see if she got thru to someone. After a small hold, she came back on the line and stated " XXXX is calling you back right now '' I assumed XXXX was someone from the XXXX location.

When they would not lessen the monthly payment or lengthen the repayment time, I entered into a debt consolidate firm XXXX XXXX XXXX XXXX XXXX. When I informed them of this, they threatened to sue me, take control of my personal property and garnish my wages. They continue to call a personal friend and threaten her- stating this is a collection for me and she had better tell them what they need to know. This friend is now in trouble at her job. Im trying to repay atleast some of this loan. I offered to pay them {$200.00} a month instead of the full {$400.00} and was informed that was not acceptable and I had better figure out how to pay the full amount or they would take everything I have. This is causing me undo stress and the possibility of loosing my family and many friends do to the embarrassment this company is causing. They are going to get money.

My previous CFPB case was closed without a proper resolution, and the information reported by Tower Loan remains inaccurate, unverified, and harmful. I am reopening this matter because I have now filed a formal FTC Identity Theft Report documenting that this Tower Loan account does not belong to me and was not authorized by me. The purpose of this statement is to explain what happened, why the account is fraudulent, why Tower Loans prior response was incorrect, and why a new investigation must be completed. 1. Background I Do NOT Own This Tower Loan Account The most important fact is simple and undisputed : I do not own, and have never owned, the Tower Loan account that is appearing on my credit reports. I took out a personal unsecured loan awhile back with Tower Loan. I made every payment until I got laid off about two months ago and I recently just started back working. Unemployment wasnt enough to live off of so theyve since been calling me everyday wanting me to make a payment. I paid them enough to get me a deferral but it only stopped the harassment for a week. I have explained my situation to the branch manager but theyve threatened to file suit. I asked them repeatedly to cease and desist with the harassing phone calls and told them that Ive already spoken with a bankruptcy attorney but they insist that without a case number provided to them that they can continue to harass me until otherwise.

I deposited a check I received from tower loans. It was deposited at the atm. The next morning my account was closed. They suspected fraud. I went to court with the check issuing company and had my paychecks garnished. This was due to XXXX having the check and not releasing funds. I lost in court saying I had to pay it no matter what since XXXX seemingly has the funds. The stated My issue is with XXXX and I still owe them. I went to court for this so everything was legit. No fraud what so ever. I paid the loan off from the issuing company via garnishment but I never received any funds and they ( XXXX bank ) just say that they are still trying to verify the check. Its been 2 years. It happened in 2022. The last XXXX numbers of the checking account was XXXX. Please help me. I didnt do anything wrong.

This complaint is related to CFPB XXXX XXXX. XXXX. The companys response is incomplete, and additional information is being submitted. I am submitting this rebuttal because Tower Loans SCRA calculation is incomplete and does not comply with 50 U.S.C. 3937. Tower Loan limited its SCRA adjustment to a XXXX period between XX/XX/year> and XX/XX/year>. This is not how SCRA applies to preservice obligations. This loan was originated before I entered active-duty military service. Under SCRA, the creditor must reduce the interest rate to XXXX percent for all interest, finance charges, and fees that remained unpaid as of my active-duty start date. This includes any precomputed, unearned, or accrued interest that accumulated before I entered service but was still part of the loan balance at the time my military service began. Tower Loan did not recalculate any of this unpaid preservice interest.
