Additionally, the reported balance, charge-off amount, and original loan balance do not clearly reconcile. This account also resulted from a vehicle repossession. Because the vehicle was repossessed and presumably sold, the remaining balance should reflect a proper accounting of the repossession and sale. I am requesting documentation showing the repossession accounting, including the auction or sale amount of the vehicle, how those proceeds were applied to the loan balance, and a breakdown of any fees added after repossession.

In 2023 I financed a used vehicle through United Auto Credit. XXXX XXXXXXXX - Within less than a year of ownership, the vehicle began experiencing major mechanical problems, I called multiple times and made complaints to United Auto Credit advising the issues. including transmission failure, fuel pump. Because the vehicle was no longer reliable and the repair costs were extremely high, I voluntarily returned the vehicle. After the vehicle was surrendered, United Auto Credit reported a charge-off and a deficiency balance of approximately {$9500.00}. I have requested information explaining how this balance was calculated after the vehicle was surrendered and sold. Specifically, I requested documentation showing the sale of the vehicle, the auction sale price, and a full breakdown of how the remaining balance was determined. Instead of providing this information, the company sent a settlement letter offering to accept a reduced payment but did not provide the documentation requested.

Under the Servicemembers Civil Relief Act ( 50 U.S.C. 3937 ), any obligation incurred before military service must have its interest rate capped at 6 % for the entire period of military service, and any interest charged above 6 % must be forgiven, not deferred. Although the lender reduced my interest rate prospectively after my request, they have repeatedly refused to apply the adjustment retroactively and refund or credit the excess interest already charged. The lender claims the SCRA benefit applies only from the date of request, which is incorrect and contrary to federal law. The SCRA requires a full retroactive recalculation of the loan, including forgiveness and reimbursement of all interest charged above 6 % during my military service, regardless of the request date.
