I am filing a complaint against Upgrade , Inc. for refusing to open a billing dispute for a charge where services were not rendered. I used Upgrade to pay {$140.00} for a travel protection plan through XXXX XXXX XXXX. After purchase, I attempted to use the protection, but my claim was denied. I was informed that I was not eligible for coverage due to when the protection was added to my booking. This means the product I paid for provided no usable benefit at the time of purchase. I contacted Upgrade to dispute the charge, as this is a clear case of services not rendered. However, Upgrade refused to open a dispute and instead directed me back to the merchant. I also contacted the merchant ( XXXX ), and they refused to issue a refund, leaving me without resolution. I am requesting that Upgrade open a formal dispute and investigate this charge, as I paid for a service that I was not eligible to use and did not receive.

On XX/XX/XXXX at XXXXXXXX XXXX XXXX I returned a phone to XXXX XXXX. XXXX XXXX XXXX policy, the {$1100.00} refund went back to the original payment method, which was my Upgrade XXXX Card ( their credit/charge product ). XXXX told me they were having a system issue on XX/XX/XXXX, so the refund didnt post that day. The {$1100.00} finally posted to my Upgrade XXXX Card on XX/XX/XXXX at around XXXXXXXX XXXX XXXX At that point Upgrade told me I did not owe a balance, so the funds would be moved to my Upgrade Rewards Checking account by ACH. I was told the disbursement to my checking account went out on XX/XX/XXXX at XXXXXXXX XXXX XXXX, with an expected arrival in XXXX business days. From that point forward I received multiple different promises from Upgrade : that I would have the money by Friday, then Monday morning, then by close of business Monday, then within XXXX hours, and that the funds were in final processing and no further action is required.

Interest Paid {$170.00} - Due to personal circumstances I was unable to officially cancel my flight with XXXX until XX/XX/year>- the airline refunded the entire amount {$2100.00} back to upgrade.com - No one at upgrade was/is willing to take into account, or even acknowledge the fact that some things can not be determined after 30 days of taking out a loan, and want to keep free interest paid to them. They also claim that there are clear cancellation terms indicating that if you cancel within 30 days you would receive a full refund- which is not accurate or true. ( they should take a look at their terms and conditions online and go thru the purchase options before speaking on that ). Additionally it took more than one call to XXXX that my refund is " pending '' due to not having a bank account on file ( mind you that was never notified to me either ).

I had issues making the payment due to system issues but the final payment that posted and I received confirmation for was {$100.00}. On XX/XX/XXXX and XX/XX/XXXX, respectively, I received multiple emails confirming a booking and on XX/XX/XXXX ( XXXX ) I received multiple emails requesting that I make initial payments towards loan amounts of {$120.00} and {$180.00}. On XX/XX/XXXX ( XXXX ) I called the company ( customer care ) to request they look over and remove the accounts that were made due to system error. I also confirmed the payment of {$100.00}. I was informed that I should receive follow-up on Monday, XX/XX/XXXX. I did not receive follow-up Monday or Tuesday so I called again on Wednesday, XX/XX/XXXX to receive follow-up. I spoke with someone ( in collections ) who said they would escalate the issue and that instructed that I call back at XXXX XXXX.

The money was in the account so I contacted upgrade a XXXX XXXX XXXX. The money even though declined had been placed in a pending status. They said they knew about the error and was working to fix it. It's been seven days they have with held my money for a system error of their own. My bills now have late fees. I need my money. When I call or message them they just say they working to fix it. They have no time frame .after that they tried to charge me XXXX # for a transaction to XXXX XXXX the doesn't exist to XXXX XXXX I didn't make they said it was part of the error .they haven't put it back either. It's been seven days

On Tuesday, XX/XX/year> ; I applied for a personal loan from Upgrade. The loan amount was for {$36000.00}. While filling out the paperwork online and waiting for it to be accepted, I was sent out to another loan company with the message that my loan had not been funded but to try a loan from a partner company called, XXXX XXXX. I was surprised that I had not been funded as I had filled everything out thinking it HAD gone through. So, I went over to XXXX XXXX with the provided link from Upgrade and was funded by XXXX XXXX for {$36000.00}. A few days later, XX/XX/year> ; I got an email from Upgrade confirming my loan had NOT gone through ( email attached ). A day later, I discovered that not only had I been funded by XXXX XXXX but Upgrade HAD funded my loan so now I had XXXX loans and can not afford XXXX payments. I immediately panicked and started getting the funds together to pay the Upgrade loan back. I called Upgrade on XX/XX/year> ; to let them know what happened.

I called XXXX XXXX ( upgrade ) to find out if I can figure a way to resolve.I have been affected by a tornado hitting my home/ Health issues ( XXXX XXXX ) when I called, the only the rep only wanted to talk about disputing my many accounts that I mentioned to him that XXXX trying to resolve. Not a particular name of an account. He informed me to dispute the one I called him about and he could run a XXXX score credit bureau to see what can be disputed for {$1.00}. I was curious and asked him WHY he was doing this. He said he heard in my voice that I was in a bad situation and understood. I agreed. He made me feel good about it. After giving my debit card # he ran report and said that I believe there were XXXX accounts that had issues. I asked how that could be? He said something about data entry etc. He said he could dispute them all. I said that sounds good. He then informed me it would be either {$370.00} or {$370.00} to do this. I was confused.

I am filing a complaint against Upgrade , Inc. regarding improper handling of a billing dispute, continued negative credit reporting, and failure to provide account access. On XX/XX/XXXX and XX/XX/XXXX, payments of {$83.00} each were applied to my Flex Pay loan ( Loan ID XXXX ) for a flight purchased through XXXX XXXX. I did not board the flight and received no service. I contacted the merchant immediately and was denied any refund, credit, or rebooking. On XX/XX/XXXX, I submitted a formal dispute to Upgrade stating that the underlying service was not rendered. I clearly requested an investigation, suspension of collection activity, and reversal of charges. Upgrade did not conduct a meaningful investigation. Instead, on XX/XX/XXXX, they responded with a generic statement claiming they are not a party to the merchant agreement and directed me back to the merchant. Issue : Settlement not honored after payment / inaccurate credit reporting Account Number : XXXX Consumer Name : XXXX XXXX Complaint : In XX/XX/year>, I contacted Upgrade , Inc. regarding settlement of my account. During a recorded telephone conversation, I was explicitly informed by a representative that the company would honor the previously agreed settlement terms if payment was made. Relying on that representation, I sent payment directly to Upgrade via certified mail. The payment was received and deposited by Upgrade. I have proof of delivery and proof that the funds cleared. Despite accepting and negotiating the payment, Upgrade has refused to honor the settlement agreement and continues to report a balance on the account. I dispute this conduct. I made payment in good faith reliance on Upgrades recorded verbal confirmation. Accepting the funds and then refusing to honor the settlement is misleading and improper.

Subject : Formal Complaint Improper Credit Line Reduction, Lack of Notice, and Resulting Account Harm I am filing a formal complaint regarding the handling of my revolving credit account by Upgrade Inc . I was approved for a credit line of {$9000.00} and used the account in good faith. All transactions on this account were authorized and approved by Upgrade at the time they were made. I have made the payments required on time and have maintained the account responsibly. Without prior notice, my credit limit was abruptly reduced from {$9000.00} to {$500.00}. At the time of this reduction, my outstanding balance was approximately {$85000.00}. This unilateral action immediately placed my account in an over-limit status by more than {$8000.00}. These duplicate accounts reflect the same obligation but are listed more than once, and are different amounts. Resulting in unfair damage to my credit profile. The Fair Credit Reporting Act ( 15 U.S.C. 1681 ) requires that information furnished to consumer reporting agencies be accurate, complete, and not duplicated.

When the bag was returned, several critical items were missing, including : Social Security card Drivers license Debit card Passport These items were stolen while I was on the ship and out on the water with no cellular reception, making it impossible for me to receive alerts or take immediate action. I discovered the identity theft on XX/XX/year>, when I learned that a fraudulent loan in the amount of {$11000.00} had been opened in my name. In addition, over {$1200.00} was withdrawn from my bank account in connection with this fraudulent loan within the last month.

An Upgrade Inc line of credit account ( account number XXXX, opened XX/XX/XXXX ) was charged off in XX/XX/XXXX with {$650.00} written off. Upgrade Inc sold this debt to XXXX XXXX XXXX, as confirmed by the historical information on my credit report. Despite selling the debt, Upgrade Inc continues to report this account as a negative item on my credit report, which is a direct violation of the Fair Credit Reporting Act. Under FCRA 623 ( a ) ( 2 ), once a furnisher sells or transfers a debt, they are required to notify the credit reporting agency and update or delete the account accordingly. Upgrade Inc has failed to do this. They no longer own this debt, have no legal standing to continue reporting it, yet the account remains active and derogatory on my report under their name. Prior to the sailing date of XX/XX/year>, I cancelled the cruise due to safety concerns related to official U.S. Department of State travel advisories affecting the destination region ( XXXX ). After cancelling, I requested a goodwill accommodation from the merchant in the form of a future cruise credit. XXXX XXXX XXXX denied my request and later confirmed through the XXXX XXXX XXXX complaint process that they would not provide any refund or credit and would not reconsider the matter. Because the purchase was financed through Upgrade XXXX XXXX, I contacted Upgrade to dispute the transaction and requested that the financing company review the matter. Upgrade declined to conduct any investigation and instead directed me back to the merchant. At this point, the merchant has refused further communication and has clearly stated they will not reconsider the request.
