On XX/XX/year>, I started the refinance process with Upstart and the paperwork was completed on XX/XX/XXXX. On XX/XX/XXXX, a check was sent to XXXX ( the previous lender ) but the check hadn't arrived by XX/XX/XXXX so Upstart cancelled payment and issued a new check. Then the first check from XX/XX/XXXX arrived at XXXX on XX/XX/XXXX and they attempted to deposit it. It did not go through. The check from XX/XX/XXXX arrived and it was mailed to me since it didn't meet the new payoff amount. I worked with XXXX and had them agree to accept the XX/XX/XXXX check and the original payoff amount and I overnighted the check to them at my expense. Upstart canceled the XX/XX/XXXX check the afternoon after I mailed it to XXXX and issued a third check, dated XX/XX/XXXX. At this point, XXXX still holds the title and I have little to no confidence that Upstart will be competent. This has taken hours of my life, making near daily calls to get this straightened out.

This is annoying and has been going on since last yr. My information was used without my knowledge to apply for something at this company yrs ago. I didn't know until they started emailing me at business email address. I have asked them to remove the account and they refused citing legal jargon about needing to retain information. This has provided them the opportunity to violate the can-spam act over and over. I've asked numerous of times just to be told they'll put in a request to delete my email. As I accepted the loan term the message said I was approved, so I moved forward, only to get a message saying I was declined. This is deceptive practices and I want this hard inquiry of my credit ASAP.
