I had a house fire over a year ago. My insurance checks need to go through my mortgage company, XXXX. They deposited my final structure payment checks totaling {$110000.00}. The checks cleared weeks ago, and they can not find the money on their end. I owe contractors tens of thousands and cant move into my house until they are paid. Im now having to pay additional rent, as well as my actual mortgage. I also fronted all of our savings to try and prevent this. Ive spoken to my mortgage company multiple times in the last couple weeks and they havent been able to resolve it in a timely manner.

Per 12 U.S.C. 4901 ( 12 ), this value is fixed at the time of the transaction. Valon has repeatedly attempted to substitute a lower current Automated Valuation Model ( AVM ) of {$690000.00} to redefine my 80 % LTV threshold. Obstruction of the 80 % Cancellation Threshold : My Notice Concerning Private Mortgage Insurance ( Page 71 ) explicitly states my right to request cancellation when my balance is first scheduled to reach 80 % of the original value, which is {$610000.00}. I have a mortgage with Valon Morgage Servicing, and I have XXXX taxes due end of XXXX or early XXXX for the discount rates. I have enough balance in my escrow to cover all the taxes. Initially, I wanted to close the escrow account and pay the taxes myself. They kept saying they will process my request so I can get my refund to pay the taxes on time, but they never actually do it. Realizing there's not enough time left, I asked them to pay the taxes before closing my escrow. They said yes but still didn't do anything. Now they are using the excuse of transferring my mortgage to another servicer to justify their inaction. My mortgage on XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX ( Loan # XXXX ) was transferred to Valon Mortgage. After transfer, I was notified of an escrow shortage. Per Valon 's instruction by phone, I paid {$5100.00} to resolve the shortage in full. I confirmed this via email to Valon. My monthly payment should have dropped to {$3300.00}. Instead, I am now receiving notice that my escrow balance is XXXX and that I have a new shortage of {$4700.00}. My property taxes and insurance have not changed. I already paid the prior shortage in full. I believe the escrow balance from my previous servicer was never properly transferred to Valon, violating RESPA ( 12 CFR 1024.33 ) which requires escrow balances to be transferred and credited. XXXX confirmed that Valon had sent 2 checks to XXXX and said the most recent check had been issued over 2 weeks prior. I have previously filed Complaint XXXX and when the mortgage company responded that the complaint was closed without anyone seeming to do anything additional. This complaint should NOT have been closed as the issue has still not been resolved- the answer is NOT sufficient. I will need someone to contact me personally on this matter. Simply because a response has been received does NOT mean this matter should be closed. The mortgage company 's response merely passes the blame to someone else. I still do not know where the money that was sent electronically from my bank to pay my mortgage is. The mortgage company 's response alleges that the third-party bill payer requested the payment be returned. I have no idea where, when, how, or to whom the payment was returned. BOTTOM LINE : MY PAYMENT IS STILL MISSING, AND NO ONE KNOWS WHERE IT IS -- WHICH WAS THE WHOLE REASON WHY THE COMPLAINT WAS SUBMITTED IN THE FIRST PLACE. Valon Mortgage XXXX was my company that sustained a pattern of fraudulent billing practices, improper late-fees assessments and inaccurate credit reporting during approximately XXXX years I maintained a mortgage account with this company. Throughout my time with Valon Mortgage Inc, the company consistently delayed the processing of my payments in a manner that appears intentional. Regardless of when my payment checks were written whether XXXX month in advance, XXXX days,XXXX days prior or even on the contractual due date of the XXXX of the month, Valon consistently cashed my checks on the XXXX of each month, XXXX day after the expiration of the grace period. Each month I received a written notices from Valon claiming that payment had not been received the same day that the check was cashed. We had an ARM mortgage with XXXX XXXX for the last XXXX years. In this original ARM, we were due to go up from 2 % to not more than 4 % this XX/XX/XXXX. We recast the loan on XX/XX/XXXX, per letter that said the loan had been recast, XXXX we would be continuing with the 2 % interest rate. It has been XXXX days since my initial request for mortgage assistance. I have been denied deed-in-lieu, and the current short sale application ( which was submitted twice at their request ) remains unaddressed despite all complete paperwork being provided XXXX days ago. I have additional provided a reasonable purchase offer for the short sale, and I can not get a straight answer on the status of the offer approval or my application. Valon is sending money to insurers I am no longer affiliated with. Valon records ( on-line ) do not match what the Valon service people are writing. I asked about an escrow shortage : XXXX 's response attached. It is not valid, nor does it match Valon 's own records. XXXX did not receive and funds in XXXX or XXXX, XXXX. My XXXX plan is annual. XXXX to XXXX. Nothing was billed nor expected to be paid XXXX. My old insurer, XXXX, DID receive one check ( Not 2, as the Valon records indicate ) and appropriately refunded it to Valon. NO ONE seems to know where the XXXX, XXXX check is : XXXX says it was sent to XXXX. XXXX did not receive it. Valon records indicate it was sent to XXXX - XXXX is proving information indicating that it was not received. XXXX mortgage sold my loan to Valon Mortgage and ever since then this company wants to tack on extra fees XXXX here XXXX there. I just pay it cause I dont want to argue. I have never had a late payment on this mortgage even when I was going through a hardship I still made sure my house payment was paid first and foremost. I am now digging my way out of the hole I was in. I have been paying on this loan for about 8 years give or take and this isnt the first time this mortgage has been sold but it is the first time my house payment went up XXXX dollars. When I try to reset my password it says I haven't registered, when I try to re-register it says I'm already registered. On XX/XX/XXXX I asked Valon Mortgage to not pay XXXX XXXX since I was cancelling the policy and moving to XXXX XXXX. On XX/XX/XXXX, {$4700.00} was taken out of my escrow account and paid to XXXX XXXX. In XXXX, XXXX, Valon Mortgage put a stop payment on that check to XXXX XXXX. Those funds have not been returned to my escrow account. On XX/XX/XXXX Valon Mortgage also paid XXXX XXXX XXXX {$3500.00} and my escrow account is showing a negative balance. I pay {$760.00} monthly into my escrow account so if the {$4700.00} was in my escrow account, I would have a balance of {$3900.00} to cover XXXX property taxes in XXXX. Valon Mortgage is showing a negative balance of $ ( XXXX ). They are telling me I need to put the check from XXXX XXXX into my escrow account. I filed for chapter XXXX bankruptcy protection on XX/XX/year>. My mortgage company blocked online payment and mortgage management access when they received notice. In addition they are charging a {$610.00} chapter XXXX plan review fee on our statement. This feels like a punitive action. When I asked XXXX very straightforward questions, my request for a response was ignored and/or answered unclearly. I asked why the fee was being assessed, and when the online payment portal access would be restored. The XXXX question was completely ignored, the second was met with an ambiguous response ( as long as your case is active on the docket ). I believe that Valon is intentionally not responding in order to avoid accountability for possible stay violations.
Misrepresentation of debt and lying to state regulators about delinquency days. Valon Mortgage says in there letter that it is not subject to mortgage broker laws when they denied receipt of XXXX certified mail notices and did not have to produce the wet-ink note. The XXXX XXXX XXXX XXXX 's seems to think lying to state regulators is outside of its jurisdiction being as all this information was supplied to them and they could not seem to catch them in the lies that were told, or simply did not care to deal with it. The XXXX credit report shows the loan was sold to Valon mortgage XXXX. Valon Mortgage then illegally transferred the loan to XXXX XXXX XXXX who said they may be a debt collector trying to collect a debt while at the same time being foreclosure counsel, and both simultaneously billing. A payment of {$1300.00} was sent to XXXX Mortgage on XX/XX/year>, but XXXX Mortgage did not apply the payment to my account. The bank confirmed the money had been successfully sent to XXXX Mortgage. When I called, XXXX said they would resolve the issue, but they never did. When I sent emails, their response did not even relate to the issue at hand.

Valon Mortgage Inc I currently have a loan through Valon Mortgage. I opened my statement this weekend, only to see that my name and mailing address on the statement- but the mortgage information was not mine. I recieved a detailed mortgage statement for another borrower with their names, their account number, their recent payment amount and the current payment information. I called this morning and reported it to Valon and was told my statement was being reissued. They were aware of the problem and shared that it had been reported, but why wasn't I notified that my information was shared with someone else - just like someone else 's information was shared with me. I felt compelled to share it with the CFPB so that there is awareness of this issue.

We sent them over very quickly and thought this would be the end of the situation., however, nine months later, we are still dealing with this process. We never had a break in our insurance policy. We continue to send over our papers. They called and requested from our insurance company on five different occasions however the issue was still not resolved. Before I received a mail letter from XXXX, I had received a mail from another mortgage company and they said that they were doing the mortgage now. So XXXX XXXX had Valon Mortgage start and they are reducing money from my bank account. This is not good that I am having XXXX mortgage companies. Upon transferring, our insurance company provided our policy information to XXXX and showed that the policy was paid from our escrow account. Today, I requested to know why my value on their site was {$100000.00} over the price that was assessed by the county. This is an addendum to CFPB Complaint # XXXX. After filing my original complaint, I uncovered additional and more serious issues. When I requested written confirmation from Valon Mortgage regarding the statements their representative made to me by phone, he refused to include those statements in writing. Specifically, he omitted : his claim that my deferral was never actually approved, only that I was eligible, his insistence that I needed to make XXXX regular monthly payments so they could try again for a deferral, his promise that Valon would advocate for me if I did this and then, maybe I would be granted a deferral and any documentation regarding this alleged investor denial. I am filing a complaint regarding Valon Mortgage Inc, negligence in handling my homeowners insurance payment. We received our mortgage statement stating our escrow doubled. On XX/XX/XXXX we called the company and were told it was accident and 100s of customers got the same error. We were told a new statement would be mailed. On XX/XX/XXXX the new statement arrived with the same amounts. Raising our mortgage payment over {$300.00} per month.
