Our mortgage with Village Capital & Investment LLC originated in XX/XX/XXXX. Since that time, Village Capital failed to complete the required annual escrow analyses for both XXXX and XXXX, as required under the Real Estate Settlement Procedures Act ( RESPA ). Because those escrow analyses were never performed, Village Capital continued collecting an insufficient monthly escrow amount of {$180.00}, which was not enough to cover our actual tax and insurance obligations. The company did not notify us of any escrow shortage or payment adjustment during this period. In XX/XX/XXXX, we discovered a negative escrow balance of approximately {$27000.00}. We contacted Village Capital multiple times between XXXX and XX/XX/XXXX seeking clarification and correction.

This exemption has been : Approved by XXXX XXXX Verified and processed by the taxing authority Made retroactively effective to XX/XX/year> Submitted to and received by my mortgage servicer Despite having received and acknowledged this documentation, my mortgage servicer continues to : Collect escrow for property taxes that are no longer legally owed Increase my monthly payment from approximately {$3600.00} to {$4500.00} Require me to pay an alleged escrow shortage based on taxes that have been eliminated The servicer has stated that they will not adjust my escrow account until they receive a refund from the county.

I am filing a formal complaint regarding the mishandling of my FHA loss mitigation process by Village Capital. The servicer improperly canceled a valid home retention option during an active trial period and is now falsely classifying the situation as borrower non-completion in order to deny further review and proceed toward foreclosure. Summary of Issue : A home retention option ( trial payment plan ) was offered with a XXXX start date. I did not refuse this option at any time. During XXXX, I was actively engaged in resolving issues through Consumer Affairs, HUD, and the State of Georgia, and was awaiting guidance and direction. I was not informed that the plan would be canceled, nor was I given any final warning or deadline clarification.

My mortgage servicer denied me for a VA loan modification with two conflicting denial reasons. Denial Reason # 1 ( Written ) : Hardship must be resolved. My hardship is resolved, as shown in my application. Denial Reason # 2 ( Verbal ) : You defaulted on two previous modifications. However, the VA Servicer Handbook M26 4 ( 2024 revisions ) contains no prohibition against offering additional modifications due to prior mod defaults. My VA loan technician also confirmed this is not a valid VA guideline. The servicer claimed this was within VA guidelines, which is incorrect and misleading. Regulation X Violations Under 12 CFR 1024.41, servicers must : State accurate, specific reasons for denial Evaluate borrowers for all available options Use valid guidelines, not internal overlays misrepresented as federal rules My servicer provided conflicting, inaccurate reasons and refused to provide the guideline they claim supports this decision.

My outstanding balance shows {$9.00} more than what I actually owe due to a late application of additional principle payments I made on XX/XX/year>. Instead of applying my $ XXXX in additional principle on the day they received it ( XX/XX/year> ), they delayed application until XX/XX/year> and lumped it together with the $ XXXX additional principle from my XX/XX/year> mortgage payment. This forced an incorrect interest accrual on an incorrect loan balance for the month of XXXX resulting in the additional {$9.00} showing on my current balance. These monthly payments are the same each month and are auto-drafted by Village Capital & Investment , LLC each month so there is no surprises or variations in these payments.

This complaint is being submitted as a follow-up to CFPB Complaint No. XXXX. Village Capital closed the prior complaint with explanation ; however, the underlying issue remains unresolved. Village Capital committed a mortgage servicing error by misapplying funds from our escrow account to pay property taxes associated with an incorrect parcel number : XXXX # XXXX. Our property is associated with XXXX # XXXX. As a result of this error, escrow funds that were intended for our property were used to pay taxes for a different parcel. This improper escrow disbursement created an artificial escrow shortage on our account. Instead of correcting the servicing error, Village Capital increased our monthly mortgage payment to make up for the escrow deficit caused by their misapplication of funds. As a result, we are being required to cover a shortage that was created entirely by the servicers error.

I wasn't aware federal employees do not rece3ive XXXX XXXX XXXX and was placed on paid without leave for XXXX on leave without pay. When i returned to work, I had fallen behind four months and submitted a payment for {$7000.00} to Village Capital and Investments. They said I still owed {$5600.00} and I did not have it. When I submitted a hardship claim they denied it because I had just refinanced the home a couple of months before. This company refinanced my home at a value that did not meet the current market value and raised my interest rates from 4.3 to 6.75 % making my payments almost {$1800.00} more per month. I bout the home in XX/XX/XXXX and had never missed a payment until XXXX of XXXX. I continued to submit several hardship fillings and they kept denying me. XX/XX/XXXX, we were furloughed and I lost income for 45 more days.

I am selling my home. I have contacted Village Capital and investment eight times in the last month and a half. I have emailed them a request for a payoff quote. I have been on a list for a manager to call me back for a month every time I call them there is no manager in the office working. These people are working without managerial assistance. What type of company is this? That doesnt have a manager on site and that the managers never call you back I have been asking for a payoff quote for a month now. first one of the course Customer Service says that they will contact the payoff department then they tell me to email Village capital investment asking for a payoff then I call again and they say they told you the wrong things that you need to email a certain department when I emailed the certain department, I have never got an answer

I still had a part time job but I was struggling. I was told they can't help me until I am at least 90 days delinquent on my loan. So I followed their direction in hopes they were going to help me. XXXX of XXXX I contacted them again to say I'm 90 days delinquent can you help me now. They filled out a loss midigations application said I qualified sent me documents to sign and notarized all documents were sent back on time last document being from my ex husband of 13 years who was not even on my loan he received email confirmation stating the document was received.

Village Capital publicly advertises Borrower Assistance / Hardship Programs on its website. However, when I was contacted by a Loan Officer, she stated she was unaware of any hardship programs. When I called customer service, I was told the company does not offer hardship programs. After I referenced the information published on their website, I was then told that I do not qualify, despite no financial review being conducted and no eligibility criteria being explained. I am currently experiencing financial hardship and requested a formal loss mitigation evaluation while my loan is still current. The company has provided conflicting and misleading information regarding available assistance.

This is my second complaint regarding Village Capitals handling of my loss mitigation and payment options. My prior complaint was closed after regulators accepted the servicers summary without independently reviewing records, documents, or call logs. I am requesting a formal, documented review based on evidence, not representations. In XX/XX/XXXX, my co-borrower and I accepted a modification offer. We executed the required notarized documents and returned all required materials. Additional documents were signed separately based on availability, as permitted. On XX/XX/XXXX, I was informed that the documents were signed incorrectly and that the offer was canceled without a reasonable opportunity to cure. This occurred during the federal government shutdown when HUD oversight was unavailable. Shortly thereafter, I participated in a phone call presented as a question-and-answer review.

I was told that there was a glitch in the system and they took 3 payments ( {$7800.00} ) out of my account instead of 1. This caused my account to go into overdraft. I asked if they could either wire or overnight my return payment. I spoke to my mortgage company and was told that it was not their fault, and they will return my money within XXXX XXXX XXXX days. I also did a conference call with my mortgage company and bank. I was told by my bank that the money was sent and that there was nothing they could do accept credit me back a couple of the NSF fees. It seems that neither party is thinking of me. I have been to the doctor because of this sending my XXXX XXXX through the roof.

At XXXX XXXX on XX/XX/year> I received another email from another Village Capital Loan Officer by the name of XXXX XXXX who also acknowledged my payoff request, but then stated " My name is XXXX, I'm with Village Capital, your current loan servicer. Our system shows you requested apayoff, and I wanted to reach out and see what we could do to earn your business back. Village Capital is an extremely competitive lender, and will match/beat almost anything you have been offered to keep your business.

After this payment, my escrow account should have been current and my monthly mortgage payment should not have increased. Despite this, the servicer still raised my mortgage payment. Additionally, my homeowners insurance was paid twice by the servicer. I repaid the duplicate insurance payment ; however, the escrow account was still not properly corrected. The servicer has failed to pay my property taxes despite having funds in escrow. As a result, a tax lien has been placed on the property, and third parties have begun contacting me attempting to purchase the property due to the delinquent tax status. I have contacted the servicer multiple times to resolve these issues, but the errors have not been corrected. The servicers failure to properly manage my escrow account has caused financial harm, unnecessary stress, and placed my property at risk.

I bought a manufactured home with a VA loan through first signature and now is in the hands at village capital. I moved into the home in XX/XX/year>. My agreed payment was {$1400.00} which was paid on time. I have excellent credit and like all my bills paid on time. I received a letter in XXXX that stated a new analysis was done and that they figured my taxes wrong on my escrow account. My loan payment went from {$1400.00} to {$2000.00}. They told us they figured the taxes wrong and I was {$4100.00} in shortage. I Checked with the court house with the auditors and tax dept. they have no idea where they are getting their numbers and stated we were caught up on all our taxes. The land taxes were {$160.00} and at the time they could not even find taxes for the home due to not being registered or titled. When I called the loan company they gave me a tax ID number which I checked with the auditor and tax dept at the court house.

In additions XXXX did not have the correct full address on file so we did not receive any tax correspondence for 2 years as well. XXXX has documentation of this returned mail. Regardless the servicer should be responsible for maintaining annual escrow analysis. Previous Complaint IDs : XXXX XXXX XXXX Following these complaints we worked directly with the Reputation Management Manager - XXXX XXXX. The CEO : XXXX XXXX XXXX XXXX XXXX Legal Executive. We were assured, in writing that when catching up on our escrow balance that this would include calculations into the current tax year so we can verify staying caught up. Negative escrow balance of XX/XX/XXXX we have an {$11000.00} escrow balance on the account.

I have requested a modification, however, the lender has not given me an update or status of postponing the upcoming sale date on Monday, XX/XX/XXXX, XXXX. On XX/XX/XXXX, I sent to the lender a Non-Negotiable Notice of Debt Validation Request and Demand via Fax. The Notice was also sent to the foreclosing trustee, XXXX XXXX via fax. The Notice was also sent by United States Postal Service mail with tracking. These notices were sent in accordance with the Fair Debt Collection Practices Act ( FDCPA ), the Rosenthal Fair Debt Collection Practices Act ( RFDCPA ), and the Truth in Lending Act ( TILA ). Under 15 USC 1692g ( b ) and California Civil Code 1788.17, all debt collection activities including foreclosure must cease, and once a debt is disputed in writing, validation is provided. This means the foreclosure sale currently scheduled for Monday, XX/XX/XXXX must cease.

We refinanced our VA loan and closed on XX/XX/year>. At closing, we were advised that our escrow balance from our prior loan would be refunded directly to us. The payoff statement dated XX/XX/year> shows that our escrow balance of {$3600.00} was deducted from the payoff amount ( Less Current Escrow Balance ), reducing the payoff rather than being refunded to us. We did not authorize our borrower-owned escrow funds to be applied to the payoff. No written authorization exists. The payoff statement is marked Internal Purpo ses Only and contains no borrower consent. Village Capital has stated that only {$740.00} will be refunded, which represents an overpayment and not the escrow funds that were applied without authorization. We believe our escrow funds were misapplied in violation of mortgage servicing and escrow handling requirements. We are requesting reimbursement of the escrow funds applied without authorization, less any amount already refunded.

I recently had damage to my home and had to pay my mortgage late in order to start repairs while I filed a claim. On XXXX XX/XX/year>, I attempted to make XXXX payment and after several reps refused to take my payment as they wanted me to include XXXX as well, finally a rep took half payment for XXXX due to my card only allowing a certain amount. Total due for Decemeber was {$2700.00}, I was charged {$1300.00} and to pay remaining XXXX balance on XXXX XX/XX/year>, on this day after being on hold for a very long time, a agent in loss mitigation advised me that they were not interested in my payment unless I was also paying XX/XX/year>, which is not late until XXXX XXXX. I recently found that Village Capital has several claims against them and lawsuits as to how they mishandle XXXX and XXXX loans.

Upon transfer of servicing, Village Capital failed to recognize or properly apply these principal curtailments. Instead, they established my loan balance based on a standard amortization schedule that ignored the additional principal payments entirely. After I contacted Village Capital to correct this error, they attempted to fix the issue by essentially applying a single lump-sum principal payment of {$10000.00} in XXXX.
