This request was made pursuant to my rights under the Fair Debt Collection Practices Act ( FDCPA ), 15 U.S.C. 1692g. The collection agency failed to provide any validation or documentation. Instead of responding appropriately, they returned my original letter to me without providing any proof, confirmation, or explanation. To date, no debt validation has been provided. Additionally, I submitted written disputes to all three credit reporting agenciesXXXX XXXX and XXXXclearly outlining the violations of federal law and asserting my rights as a consumer.…

I timely disputed the alleged debt in writing and demanded strict validation pursuant to 15 U.S.C. 1692g ( b ). My dispute was submitted through the CFPB, transmitted directly to XXXX XXXX XXXX XXXX XXXX and acknowledged by XXXX in its written response. Despite receipt of my written dispute, XXXX failed to provide any legally sufficient validation. Specifically, XXXX did not produce a signed contract or financial responsibility agreement, itemized medical billing, insurance billing records or EOBs, a complete accounting ledger, proof of assignment or authority to collect, HIPAA authorization or Business Associate Agreement, or any disclosure regarding cancellation of debt or IRS Form 1099-C. Instead, XXXX relied on bare assertions that records allegedly exist, that the creditor substantiated the balance, and that a consent to treat is allegedly on file, without producing any documents. Such statements do not satisfy the validation requirements of the FDCPA.…

Then, XXXX minutes after that, at XXXX pm, my son got a call from this same number and name. He answered and it was the same thing. They said they are handling a business matter for me. He hung up on them. How Deceptive is this statement!!!…
I discovered a medical collection account reported by XXXX XXXX XXXX on my credit report. This was the first time I had ever seen or been made aware of this alleged debt. I never received a bill, notice, explanation of benefits, validation notice, or any communication from either the medical provider or XXXX XXXX XXXX prior to credit reporting. XXXX XXXX XXXX is reporting a balance that exceeds the listed high credit amount and reflects inconsistent payment history and delinquency dates. This constitutes inaccurate reporting under the Fair Credit Reporting Act, specifically 15 U.S.C. 1681e ( b ) and 1681i. XXXX XXXX XXXX has furnished this account without providing validation as required under the Fair Debt Collection Practices Act, 15 U.S.C. 1692g. Continued reporting of an unvalidated debt constitutes collection activity and violates 1692g ( b ).…
XXXX XXXX XXXX Account XXXXXXXX XXXX XXXX XXXX XXXX I am submitting this complaint to formally dispute the above-referenced account, which is currently being reported on my credit reports with XXXX, XXXX, and XXXX. I am requesting full validation of this alleged debt, as I have not been provided proof that this account is accurate or that I am legally responsible for it. I am requesting basic documentation to verify this account, including the name of the original creditor, the full account number, a detailed breakdown of the balance being claimed, any agreement showing my obligation to pay, and proof that this account was properly transferred to the current reporting or collecting party. This account is also being reported inconsistently across the credit bureaus, with conflicting balances and account statuses. These discrepancies raise concerns about the accuracy of the reporting under the Fair Credit Reporting Act.
I am submitting this complaint regarding an account XXXX & XXXX continues to report on my XXXX credit file. I have disputed this account multiple times, yet it remains listed, even though both XXXX and XXXX have already removed the same account. The fact that two major credit bureaus deleted it shows that the information can not be verified as accurate or complete. As the reporting collection agency, XXXX & XXXX is responsible for maintaining proper documentation to support this account. Under the Fair Credit Reporting Act ( FCRA 623 ( b ) ), you are required to conduct a reasonable investigation whenever a dispute is received and to stop reporting information that can not be fully verified. Furthermore, XXXX still shows this account as Account not disputed, despite my repeated disputes. This misrepresentation itself makes the reporting inaccurate.
XXXX XXXX XXXX is falsely reporting on my credit. I have never had any accounts with them. Per my research XXXX XXXX XXXX is a debt collector. They are falsely reporting on my credit!! Account number is XXXX is falsely reporting to my credit file and is against my rights and fair credit act. Under U.S Code 1618d - Disclosure of investigation consumer report ; you are in violation.
Wakefield and associates, LLC and XXXX XXXX ( later identified as XXXX XXXX in Arizona ) received collection letter ( XXXX ) owing Banner XXXX responded with which banner and what was the date and charges for? I never received a bill from XXXX! I responded with proof of insurance and mentioned never receiving a bill. ( I have tracking # showing my request ) Wakefield never responded and sent me into collections. I began my own investigation and found it was banner estrella from a visit in XXXX of XXXX asked XXXX why I never received a bill and denial letter from the insurance company if they didn't pay it. ( Banners response was they only send bills through email, and I didn't provide XXXX and somehow my insurance was never run. banner follow up ( somehow insurance still had not be processed it got stuck in other departments ).
I am submitting this request as a new CFPB case, as my prior complaint ( XXXX XXXX. XXXX ) has been closed. According to the companys response, the referenced account was closed and returned to the original creditor, and Wakefield & Associates , LLC has confirmed that it no longer owns or services the account. Since the account is no longer being collected and has been returned, there is no permissible purpose for the tradeline to continue reporting on my consumer credit reports. Accordingly, I am requesting that Wakefield & Associates , LLC direct all credit reporting agencies to delete the tradeline associated with this account, as the company no longer has an interest in the debt and has ceased collection activity. Please provide written confirmation that deletion requests have been submitted to XXXX XXXX XXXX XXXX Thank you for your attention to this matter.
XXXX XXXX XXXX responded to my complaint with unsupported assertions and no documentary evidence. They failed to provide validation required by FDCPA 1692g and failed to demonstrate a reasonable investigation under FCRA 611. The account is medical in nature, and XXXX is not the provider. They can not legally verify the debt without disclosure of protected health information. Their attempt to pre-empt future complaints is improper. I am requesting supervisory review, deletion, and confirmation of compliance.
Wakefield & Associates , LLC has engaged in misrepresentation and failed to comply with federal debt validation and investigation requirements after receiving multiple disputes, including a dispute submitted through the Consumer Financial Protection Bureau and a subsequent written validation request sent by mail and confirmed as delivered. XXXX XXXX Wakefield & Associates responded to a prior CFPB complaint on XX/XX/year>, asserting that no direct dispute had been received and that debt verification was allegedly sent to me on XX/XX/year>. Both representations are false and misleading. First, a dispute submitted through the Consumer Financial Protection Bureau constitutes formal notice. Wakefield acknowledged and responded to that CFPB complaint, which alone establishes receipt of a dispute.…

Re : Formal Dispute Alleged Balance {$1300.00} Unverified / Unlawful Reporting This letter constitutes a formal legal dispute, cease-collection notice, and immediate deletion demand regarding the alleged account that Wakefield & Associates is reporting in the amount of {$1300.00}. I have repeatedly disputed this account, and despite multiple requests, no lawful validation or supporting documentation has been provided. This account remains unverified, inaccurate, and improperly furnished, and therefore must be removed immediately.
