XXXX XXXX confirmed direct deposit within XXXX business days. XX/XX/XXXX I was told to follow up if not received timely. XX/XX/XXXX I followed up. No refund received. I received repeated unsolicited phone calls from the number ( XXXX ) XXXX, listed as originating from California, over a two-day period from XX/XX/year> to XX/XX/year>. On XX/XX/year>, calls were made at XXXX, XXXX, XXXX, XXXX, XXXX, and XXXX. On XX/XX/year>, additional calls were made at XXXX, XXXX, XXXX, XXXX, and approximately XXXX. All calls were flagged as spam and automatically blocked by my call screening service. In most instances, the caller either disconnected immediately or did not provide any identifying information. In XXXX instance, the call was answered by a call screening assistant, but the caller did not respond. When I have answered calls from this number in the past, I would say hello and the call would be disconnected immediately. I did not provide any information, did not engage with the caller, and took no action beyond allowing the calls to be blocked. Despite this, the calls continued at a high frequency across both days.

What happened : I am filing this complaint against Westlake Financial Services regarding wrongful repossession, excessive charges, and unfair and deceptive practices. In XX/XX/XXXX, I entered into a vehicle financing agreement through XXXX XXXX XXXX and made a {$4000.00} down payment. However, I was not provided a clear and separate itemized sales breakdown explaining how the vehicle price and my down payment were applied. Based on the contract, the vehicle price appears inflated, which reduced the true benefit of my down payment and resulted in an unfair financing structure. In XX/XX/XXXX, I was offered a settlement payoff of {$880.00}. Due to delayed workers compensation income from a work-related injury, I could not pay at that time. On XX/XX/XXXX, I contacted Westlake to pay the settlement. They refused to honor the {$880.00} offer and instead demanded {$1300.00}. Less than XXXX hours later, on XX/XX/XXXX, a repossession agent arrived at my home.

I am financed with Westlake Financial and I am trying to get my car registered in Texas i am XXXX XXXX XXXX i have emailed called and my local dmv has faxed them also to get some kind of title or some kind of proof i own the vehicle Westlake Financal has emailed back to me and the dmv saying they will send the title over to them and it would take up to 3 weeks the dmv and i have waited the 3 weeks and we contacted them again now Westlake Financial is claiming that they have no proof of anyone sending them any kind of request for anything the dmv and i have requested something from them 4 times and still nothing there are more issues we have with that company also they refuse to lower our interest rate and telling us there is no possible way they can send our title to the dmv our vehicle is not payed off and i understand they cant send us the title because of that but in the very first email they have ever sent me they said they can send it to the dmv my vehicle has been in this

I am submitting this complaint regarding inaccurate and unverifiable information being reported on my credit file related to an account with Wilshire Consumer Credit. This account is a vehicle title loan associated with a vehicle that was declared a total loss. Despite the loss of the collateral, the account continues to be reported with a balance and as an ongoing charge-off. Additionally, the account is reported as a profit and loss write-off, which creates inconsistencies in how the account is being reported. Because the collateral no longer exists, the remaining balance must be supported by a clear and accurate accounting of how the balance was calculated, including any insurance proceeds, salvage value, or other recovery related to the vehicle. To date, no such documentation has been provided. Under the Fair Credit Reporting Act, specifically 15 U.S.C. 1681e ( b ), consumer reporting agencies are required to maintain maximum possible accuracy of the information they report.

Westlake financial stated they could not send me any verfication of debt which violates the fdcpa and the fcra federal laws. I am asserting identity theft and identity misattribution under federal law. an ftc report has been filed and a report with the local police dept will XXXX be filed. ftc report is XXXX.

They never sent me : Notice of intention to sell the vehicle Notice of sale date/time Final sale results Any deficiency balance explanation or breakdown Any proof that I legally owe the amount they are reporting Under consumer law, I should receive documentation explaining the sale of my surrendered vehicle and how they calculated any remaining balance. I received nothing. Despite this, Westlake continues to report a negative balance/charge-off to the credit bureaus. I am asking the CFPB to investigate and require Westlake to either provide full validation of the debt or correct/delete the inaccurate reporting.

Since then, Byte has discontinued all customer support, and I have had no ability to continue or complete the treatment. I also consulted a licensed dentist, who advised that stopping treatment was necessary for my dental health. Despite the service being incomplete and unsafe to continue, I am still being required to make payments on the loan used to finance this treatment. I have attempted to contact Byte to request access to treatment, guidance, and resolution regarding the loan, but they no longer provide customer support. I am requesting that the lender investigate this matter, stop collection efforts, and provide a resolution, including possible cancellation or adjustment of the remaining balance, since the contracted service was never completed and was unsafe.

For almost XXXX years I fought and fought and fought to have my payments either lowered and/or rescheduled to monthly payments instead of the {$250.00} bi/weekly payments. When I purchased this vehicle in XXXX I was employed with XXXX XXXX and they are no longer in business. I tried to keep up with the bi/weekly payments as long as I could. Then came the beginnings of speaking with numerous agents, Some " professional '' and most not. Fast forward, XXXX transfers my account to Westlake Portfolio Mgmt and my nightmares continue. They offer no help. Refuse to lower my current payments and setup new monthly payments, which has been the bone of contention in this matter. NOTHING!!! After reading many reviews online which are for public access, I am fully convinced Westlake Portfolio is operating in a lot of sketchy ways. Their excuse? " Well, sir, you signed a contract.

I was forced to take a loan when a bought a used vehicle from a dealer with Westlake Financial services who agreed to provide me with a loan. I refinanced through XXXX of my home mortgage in order to pay off the loan. Westlake did not accept a wire transfer on time thus forcing me to pay more money at a later date and reported negatively to the credit bureau. It is impossible for any customer to reach any one at this bank, purposely delaying payments to increase liability. Subsequently they sold my information to Worlwide tracking system who made cold calls to sell me tracking equipment for the same vehicle. Extremely customer unfriendly, unnecessary delays in applying funds and thus increasing liability to the consumer.

I am submitting this complaint regarding Westlake Financial Services obstruction of a total loss insurance claim and the improper assessment of repossession and storage-related charges that are not attributable to me as the borrower. On XX/XX/XXXX, XXXX issued a payoff statement, confirming their knowledge of the total loss and expectation of insurance payment. I authorized the release of the vehicle to the insurance company ( XXXX ). However, the vehicle was removed and placed in storage without proper coordination with the insurer. I have not had possession of the vehicle since the accident. The storage facility required lienholder authorization from Westlake in order for XXXX to inspect the vehicle and proceed with payment.

XXXX XXXX will send the check for the market value of the car and any remaining balance in the account will be covered by the GAP insurance that is provided for your company Westlake Financial. I'm not to be able to make anymore monthly payments of the car and I should not because I'm covered for state farm and gap insurance, so I need this matter to be solved by the end of this week. If not by Monday I will have my lawyer to handle this situation for me, and my lawyer also will send an invoice with the expenses that currently I have because the inconvenience in the resolution for this matter.
