I currently have student loan debt that I have been working to pay off. At XXXX point, I was contacted by a third-party company claiming to be debt collectors for my student loans. This initially did not make sense to me, as I already had an established payment plan in place. However, the company appeared legitimate, and after researching them online, I believed they were real. Based on that, I provided them with the information they requested. On XX/XX/year>, I fully paid off my student loans through the official loan servicer. However, on XX/XX/year>, the third-party debt XXXX withdrew {$160.00} from my account without authorization. When I called the number associated with this company, a woman answered. She spoke unclearly and behaved unprofessionally. I asked why money had been taken from my account after my loans were already paid off and requested a refund. She instructed me to send proof that my student loans were paid in full via email, which I did.

I made a payment on this account, but the debt collector is claiming that I did not. I have already provided documentation showing that the payment was made by showing my account balance was XXXX from the university, and bank transactions and statements showing it was paid. I also received my diploma from the school, which indicates that my account was satisfied at the time. They state they will not send a diploma with a past due balance and you are also supposed to be dropped from the class entirely for none payment. Additionally, I was never contacted or notified that I owed any balance from XX/XX/year> until this account was sent to collections. I was not given an opportunity to address or resolve any alleged balance before it was escalated. Despite this, the debt collector continues to request additional bank statements and is attempting to collect the debt again.

The company name appeared on my caller ID. Later that same day, at XXXX XXXX EST, I received a second call on my cell phone from the number XXXX. They left a voicemail identifying themselves as Williams & Fudge and requested a callback to XXXX. On XX/XX/year>, they called my work line again, this time from XXXX at XXXX XXXX EST. This time, I spoke with someone who asked for me by name but then inquired about another individual. They claimed that I was listed as this person 's wife, but I am not married. When I was going to go to that school I had planned to live on campus and had a signed a housing contract not know that if it was terminated I would be forced to pay an amount to them for a room I never even got. The phone calls I got after the sold my debt to Williams and Fudge. The man XXXX XXXX continually called and harassed me threatening me by saying if you dont pay this soon we will be forced to take other actions that can destroy or hurt your credit so I felt like the only thing I can do was be forced to pay now I am paying almost XXXX dollars a month for something I will never ever see.

I tried to take a class through the XXXX XXXX XXXX. When I enrolled I was told that my previous education would be sufficient for the missing degree. I have an XXXX and other college education. I was withdrawn from the class for not having the correct degree. I was withdrawn from the email system. I sent in XXXX dollars toward the class thinking they cut me off while waiting for funding. I received a letter grade of XXXX which was later changed to withdraw. I also did a petition for retroactive withdraw on XX/XX/XXXX I have emails and phone calls and letters I have written from XX/XX/XXXX. Didnt know I had a problem so started keeping them in XXXX. Received a collections notice from Williams and Fudge stating I owe XXXX. I contacted them and stated I do not owe this bill and I am disputing the bill. I am still receiving phone calls. I have asked for information for the debt and who do I need to talk to at the university He stated he would get me the information.

I believe this debt is the result of identity theft or fraud. On XX/XX/XXXX, I filed an Identity Theft Report with the Federal Trade Commission ( FTC ). I subsequently submitted written disputes via certified mail to all three major credit bureaus : XXXX ( received XX/XX/XXXX ), XXXX ( received XX/XX/XXXX ), and XXXX ( received XX/XX/XXXX ). The representative who contacted me was aggressive and made me feel very uncomfortable with his line of questioning, asking questions about people Ive lived with or were related to and insinuated that he would be trying to hold them responsible for my debt when I made it very clear that it was my responsibility and only my responsibility. I said I dont want people being harassed for something that they hold no responsibility for, he said no one else has been called when I know this is not true because I have already been told they were contacted. I stated several times I am willing to make a payment agreement and resolve this issue, he continued to purse an aggressive and invasive line of questioning that made me feel very uncomfortable. I am a clinically diagnosed person with XXXX, and aggressive or authoritative speech causes me significant distress, which this person did.

In XX/XX/XXXX, William & Fudge contacted my mother regarding a debt. The man on the phone was very aggressive and my mother didnt want to confirm my information with him as she felt uncomfortable. He said to her tell her she needs to pay her debt effectively disclosing the debt to her. Along with making her extremely uncomfortable. On XX/XX/XXXX, my mother received another phone call from them. She hung up on them. I called the number to find out who called and discovered it was them contacting her again even though they already had in the past. I told the representative that last time they contacted her they disclosed my debt illegally. The woman I spoke with was very combative and rude. She told me this didnt happen. I explained that it did and that I wasnt saying SHE did so and that it was a man and it happened in XXXX. She told me I had no proof. She made condescending remarks about me needing to pay my debt.

This is a private student loan originally charged off in XXXX. I was never notified of default, charge-off, or that the debt may have been time-barred. In late XXXX, the loan was sold and a collection agency contacted me, representing that the loan was currently due. I was not informed the debt was old or potentially unenforceable. Based on this misinformation, I made monthly payments for several years. Payments were accepted without dispute, default notices, or clarification of the loans legal status. I had assumed it was a work call and picked up. I was told I was on a recorded line and this had involved a debt. I told her that I was at work and could not talk to which she had disregarded and stated that this needed to be taken care of. I had told her again that I was at work and could not talk and would be willing to handle this another time to which she responded that once we get it settled we could get off the phone. I had told her a third time that I could not talk and at that point she had become aggressive saying I hadnt responded to her calls or emails. I had cut her off and told her sternly that I was not going to argue with her and then hung up on her. This behavior is completely unprofessional and unacceptable. I told her I was at work and she had pushed those boundaries.

The callers XXXX was extremely difficult to understand, and I could not clearly determine the nature, amount, or origin of the alleged debt. I requested written verification and documentation of the debt before making any payment. The caller became argumentative and continued to pressure me to pay while refusing to provide documentation or validation. The call felt deceptive and potentially fraudulent due to the refusal to provide proof and the inability to clearly communicate required disclosures. The interaction was immediately hostile and escalated quickly due to the representatives conduct. I clearly stated that I needed to confirm details with my partner and suggested continuing the conversation the following day. I also communicated my intent to begin repayment, including an offer of {$50.00} per month in the interim while preparing to return to college in XXXX to finish my degree. Rather than acknowledging this, the representative repeatedly interrupted me, dismissed my explanation as a sob story, and implied I was being dishonest. Despite these requests, the calls have continued. I have also informed them that I do not know the individual they are attempting to reach. After blocking the number they were calling from, the company continued to contact me by switching to different phone numbers and calling again within minutes. I am filing a complaint against Williams & Fudge regarding a fraudulent debt they are attempting to collect in my name for XXXX XXXX XXXX. This debt is the result of identity theft. I did NOT enroll in, attend, or authorize any coursework with XXXX XXXX XXXX. Someone used my personal information without my knowledge or consent. Despite clearly stating this and disputing the debt, Williams & Fudge has continued their collection attempts and behaved unprofessionally. When I contacted them by phone to discuss the fraud and request proper documentation, the representative became rude, dismissive, and ultimately hung up on me. This behavior is unprofessional and potentially violates the Fair Debt Collection Practices Act ( FDCPA ). I have already reported this identity theft to government authorities and attempted to file a police report. I have also contacted the school directly and left a message requesting their enrollment documentation.

Williams and Fudge placed an account under my name without ever giving me a clear explanation of what it came from. I was never contacted with any real details. I did not receive a statement, a bill, or any documents that show how this balance was created or why they believe I am responsible for it. Since my previous marriage ended, I have been trying to untangle old financial issues that were never fully explained to me. This looks like another situation where my information was tied to something that I never agreed to. I have not been shown anything that proves I opened an account or signed for any service that would make me responsible for this balance. This has created real problems for me when trying to move forward with basic goals like stable housing and a reliable vehicle even though I work full time and take care of my obligations. I have also never been shown anything proving that I gave Williams and Fudge permission to access, handle, or report my personal information.

The primary account number associated with this collection is XXXX ; however, older documents from XXXX show a conflicting account number of XXXX for the same debt. This is provided to assist in your investigation of the company 's documentation chaos. Debt Not Owed ( Federal Portion ) : I was covered by the 100 % Group Discharge due to XXXX 's fraud. I possess a letter from my servicer dated XX/XX/XXXX, confirming my federal loans now have a ZERO balance and have been discharged. WF is unlawfully collecting on this debt, violating my rights and the FDCPA. Predatory Private Loan : WF is also pursuing a related institutional loan that is void due to the school 's fraud and its predatory 18 % APR, as confirmed by the original Promissory Note.
