I've submitted XXXX complaints ( XXXX / XXXX ) with specific requests in addition to the direct requests I sent via mail to Zion Debt Holdings LLC . Each correspondence from the debt collector was either vague, not what I requested, repeated/ automated responses, or declined to provide what requested, despite federal and XXXX precedence. I requested proof of a dunning notice within XXXX days of initial communication ( with initial communication being the agency adding the collection account to my credit report in XXXX ). Despite the request, the agency admitted the notice wasn't sent until XXXX in both complaints, well beyond the FDCPA requirement of XXXX days of initial communication. Also, I sent a letter requesting the bill of sale with this specific account, account-level schedule, assignment & assumption agreement , purchase & sale agreement, and complete chain of title.

Instead of providing the requested verification, Zion Debt Holdings responded by sending an invoice. This is not what was requested, nor does it satisfy their legal obligation to validate a debt. An invoice is simply a demand for paymentit does not prove ownership, accuracy, or that the alleged debt is legally enforceable. To be clear, my original request asked for : Proof of delivery of any alleged 1692g dunning notice, a sworn, notarized statement from a person with firsthand knowledge as verification under 1692g4, Full chain of title documentation ( including bill of sale, assignment agreements, and account-level schedules ) per 1692g4.

I am submitting a complaint regarding a debt collector ( Zions Holdings ) attempting to collect an alleged debt originally associated with Vivint. I dispute this debt in its entirety. The collector contacted me via text message using an incorrect name, while my name associated with any prior account was different. This raises serious concerns about misidentification and inaccurate records. Additionally, I previously resolved this account directly with the original creditor, Vivint, through a payment agreement related to equipment. Based on that agreement, I do not believe any valid balance remains. Your collection agency may be on the hook for thousands of dollars because you violated debt collection laws by not sending me a notice / dunning letter within the proper time frame. Hence, I didnt get the chance to dispute the account. Worse, your actions cost me a new car because my old car broke down, and when I applied for a loan to get a new car, I was denied. Now, XXXX will cost me on average {$310.00} per week to get to work. On top of that, Im going to have to pay extra money to have my child picked up from XXXX. I thought it was something I did, but when the denial letter came from the bank, it mentioned a collection account and Zion Debt Holdings is the cause of my XXXX situation. Under 15 US 1692g, youre required to notify me within five days of the initial communication of the alleged debt, with initial communication being indirect via adding the account to my credit report in this case. I didnt get a notice! As I said, I wouldve disputed the account from the start.
