I have requested a settlement agreement from Zwicker and Associates and a statment of account, how they are applying my monthly payments to the two separate loans but I have not received either. In fact, XXXX XXXX a XXXX at Zwicker has barred my accounts claiming they were blocked by XXXX XXXX XXXX the owner of the debt but they tell me that they haven't done such a thing and that the collection agency is directed to settle the debt with a financially feasible payment plan. At this point I don't know who to. believe because I am in the middle between XXXX personal loans and Zwicker. My credit reporting is not correct because the amount and the payments are not being applied each month. When I get the paper statement from Zwicker they only reference one account even though the payment is for two and it doesn't say or show how the account is being paid. I have not gotten a proper statement from XXXX nor Zwicker regarding how the money they take me is being applied.…

Zwicker & Associates has done nothing but treat me poorly and lie about my complaints. They said that their firm did not prevent me from making payments on my account. I called 3 times to make a payment and did they accept it???? NO! Then YES, their firm did prevent me from making payments on my account. They are trying to break me down with repeated violations of the law. That is what Zwicker & Associates does. They are aggressive, rude and unprofessional. They have absolutely no idea and can not verify if XXXX XXXX called me from a non- company, unrecorded line. They have lied repeatedly in their responses to my complaints.
I called Zwicker & Associates shortly after XXXX XXXX to make a {$750.00} payment to cover XXXX & XXXX. I made the payment and specifically asked XXXX XXXX to make sure that Zwicker did not try to take money out of my checking account since I had just made a double payment. He said they would not. Then on XX/XX/XXXX they tried, unsuccessfully, to draft my checking account for {$370.00} after I specifically asked them not to. This resulted in overdraft fees that I had to pay due to their mistake. When I first entered into my payment agreement with them I was told I would make XXXX payments of {$370.00} to settle the debt. When I call them to discuss my account they tell me that I owe them {$12000.00}. That is far more than the payment arrangement that we initially agreed to. They are trying to get me to pay more money that our agreed upon settlement. That is not fair to me and is dishonest.
Zwicker & Associates is forcing me to pay more than I can afford every month. I asked if I could pay less and they said no, and if I did not pay the amount they demanded in the time frame they demanded that they would take me to court. I offered to make lower monthly payments but they refused saying the debt had to be paid off in XXXX months or they would take legal action against me and my family. XXXX XXXX, an agent for Zwicker & Associates calls me constantly demanding money. He is polite when he calls at first. He says that he is on a recorded line. After we speak he calls me back from a different number and threatens me with financial ruin if I do not pay him. He called me a loser and said that its my fault that Im in this situation. I have settled XXXX debts with this credit reporting company and while settling they were given a cease and desist in which they violated multiple times without my consent. Additionally, I have paid the debts in which they are holding the reporting of these satisfied debts for over 21 days as they state they need to make sure that the check does not bounce. The creditor did not provide me any other format to pay these debts which have reduced the curation time and state that their processes are common knowledge. Which is not the case. Zwicker & Associates, XXXX. attempted to collect and report an alleged XXXX XXXX debt that has been assigned to multiple collection agencies over time, including XXXX XXXX XXXX XXXX and XXXX XXXX, XXXX. Each of these entities is reporting different information to the credit bureaus regarding the same XXXX XXXX account, such as inconsistent Date Last Reported, Date of Last Activity, and Date Last Payment. I disputed these inaccuracies in writing with all three credit reporting agencies and with Zwicker directly by certified mail. Each dispute was received and signed for, as shown by USPS Form 3811 receipts. Zwicker failed to provide validation of the debt or correct the reporting inconsistencies within 30 days, violating 15 U.S.C. 1692g ( b ) of the FDCPA and 15 U.S.C. 1681s-2 ( b ) of the FCRA. Zwickers continued reporting of inaccurate data and failure to mark the account as disputed also violates 1692e ( 8 ) of the FDCPA.
I had a health scare that put me out of work for some time, and have never been late on any of my accounts .had thought my payments were paid in full to later discover it was not of course I havent talked to anyone or have known what was going on, to discover it was sent to a debt law firm, the managers are very nasty omgoodness I pray the god they dont ever experience what I been through .this company Zwicker & Associates P.C cares about nothing the manager that assisted me could care less what I was going through and we ended no where
