On XX/XX/year>, AES began treating the prior XXXX Consolidation loans as In Repayment and demanding payment. The balances on those AES-serviced XXXX Consolidation loans were approximately {$81000.00} and {$110000.00}. My Direct Consolidation was later completed, and XXXX became the servicer of the new Direct Consolidation loans. The new Direct Consolidation balances are approximately {$81000.00} and {$110000.00}. These are the same underlying loans as the prior XXXX Consolidation loans, with the small difference apparently due to payoff interest or capitalization.

Verification is attached showing Higher Education Services Corporation, Dept. of Education and XXXX XXXX have all confirmed cancellation of this loan numerous times. All documentation has been repeatedly sent into PHEAA verifying cancellation of this loan totaling {$4000.00} and date. Why is cancellation of loan amount still being included in overall owed amount on my balance? Second issue, multiple loans amounts are incorrect and different from what I initially borrowed and agreed upon.

Despite this, the servicer has continued to collect payments from me after discharge. I have paid substantial amounts since XXXX. I have reason to believe this loan does not qualify as a " qualified education loan '' under 11 USC 523 ( a ) ( 8 ) and should not have survived discharge. I contacted the company and requested documentation, including the promissory note and evidence that this loan qualifies as a qualified education loan as well as the basis for continued collection post discharge. I have not received a response. This account had never previously appeared on my credit report at any point. On or around XX/XX/year>, the account suddenly appeared for the first time reporting a 90-day delinquency. Notably, no 30-day or 60-day late payment was ever reported prior to this the account went from completely absent on my credit report to showing a 90-day delinquency overnight with no prior warning or graduated reporting. Upon discovering this on XX/XX/year>, I immediately paid the outstanding balance in full the same day and set up automatic payments to prevent any future issues. The delinquency was the result of an inadvertent oversight I was unaware the account had become delinquent as it had never appeared on my credit report previously.

I have already received a full federal discharge and a cash refund from the U.S. Treasury for my enrollment at a school federally recognized for fraud. I was then told to contact XXXX XXXX XXXX, identified as the loan Program XXXX for XXXX XXXX XXXX, at XXXX. Based on the information provided in AESs letter, I submitted a CFPB complaint to XXXX XXXX XXXX XXXX. On XX/XX/XXXX, they responded by providing a chain of title indicating that my loan had been sold to another entity on XX/XX/XXXX. Given these conflicting responses, it remains unclear who the current owner of my loan is.

I received 9 promissory notes and full payment history in pieces for me to figure out what loans went to which documents. I then sent a fax XX/XX/XXXX ( attached ). When I called for their fax number and verbally asked for some of the information, I was told that they could not give me that information or that they did not know the answer. They sent me a letter stating they would respond within 10 days. After the 10 days they sent a letter including 12 loans, when the original loans were only 9. Which I only received 9 promissory notes for. According to XXXXAES payment history I have 90mo on 70mo terms, they stated they could reset those and the 70mo terms without my knowledge or new loan agreements.
