I am filing this complaint against SST/XXXX for unauthorized XXXX withdrawals, failure to provide written authorization, false credit reporting, and retaliatory delinquency reporting. BACKGROUND : I was a customer of XXXX, a debt management app that ceased operations in XXXX. When XXXX shut down, a company called SST obtained my banking information without my knowledge or consent. I never signed any agreement with SST, never authorized them to access my bank account, and was never notified that my account was being transferred to them. UNAUTHORIZED WITHDRAWALS : Despite having no agreement with me, SST began making automatic debits from my checking account. This continued for approximately XXXX years. All funds withdrawn were applied to interest only, meaning my principal balance never decreased. I have bank statements documenting every unauthorized withdrawal.

I have been unable to make payments on my account due to technical errors on XXXX XXXX XXXX XXXX ' payment portal. Both the ACH automatic payment enrollment and the one-time debit card payment options return errors, making it impossible to submit payment through their website. On XX/XX/year>, I contacted the company via email documenting both errors and requested they be resolved. I also requested removal of any negative credit reporting resulting from payment delays caused by their system failures. The company responded twice with an identical form letter stating they do not discuss account information via the internet and directing me to call. They did not acknowledge the technical errors, did not offer any resolution, and refused to communicate in writing. Their system errors are preventing payment. Any late fees charged or negative credit bureau reporting during this period is a result of their platform 's failure to accept payment, not a failure to pay on my part.

My mathematical analysis shows my balance should be approximately {$1300.00} based on the stated 27.74 % APR and {$2.00} daily interest accrual. I am submitting this complaint regarding SST Banks failure to properly apply Servicemembers Civil Relief Act ( SCRA ) benefits to my account, despite multiple requests and repeated submission of required documentation. I became eligible for SCRA protections beginning XX/XX/year>. Since that time, I have made several attempts to have my account adjusted in accordance with SCRA requirements, including submitting my military orders and supporting documentation on multiple occasions. Despite this, SST Bank failed to correctly apply the benefits in a timely manner. After continued follow-ups, the company eventually applied the SCRA benefit only to future billing periods, rather than retroactively to XX/XX/year>, as required under federal law. As a result of this failure, I have overpaid a significant amount of interest over the course of more than XXXX XXXX. I have contacted SST Bank numerous times by phone and have been given inconsistent and unhelpful responses.

Summary SST Card Services is reporting a XXXX late payment on my Experian credit report for an account ( # XXXX ) that I never applied for, never agreed to, and never received any card, statement, bill, or correspondence for. You can not be late on a payment you never agreed to make. SST does not have my mailing address and has never sent me a single statement or bill. Despite this, SST reported me 30 days past due, damaging my credit score and my ability to operate my small business. I previously disputed this account through XXXX XXXX investigation sided with SST, and my report now states Completed investigation of FCRA dispute consumer disagrees. I do disagree. SST must remove this late payment immediately.

Despite this, SST continues to report and verify the tradeline to XXXX and XXXX. Continued furnishing under these circumstances violates the Fair Credit Reporting Act requirement to ensure maximum possible accuracy. ( SST ), the servicer of my solar loan, requesting disclosure of the current owner or assignee of the promissory note pursuant to 15 U.S.C. 1641 ( f ) ( 2 ). SST responded on XX/XX/year> by providing debt validation materials, payment history, and a copy of the original loan agreement. However, SST did not identify the current owner of the loan, nor did it state whether the loan has been sold or assigned since origination. Federal law requires a loan servicer, upon written request, to disclose the name and address of the entity that owns the loan. Providing validation documents is not responsive to this requirement. Despite multiple written communications, SST has failed to provide the required ownership disclosure. I am requesting that SST be required to comply with federal law and provide written identification of the current owner or assignee of the promissory note.

I called SST on XX/XX/year> to discuss payment options or potentially lowering my interest rate as I've experienced some financial hardship over the last year. They were unwilling to offer more than a XX/XX/XXXX month delay in payments but when I logged into my account SOMEONE ELSE 'S LOAN INFORMATION POPULATED. Screenshot has been linked below. XX/XX/XXXXXXXX This was a loan I took out with XXXX, who closed and sold my loan to SST. SST has more than doubled my interest rate - and that's whatever, XXXX - but my bigger issue here is that I now have someone else 's name, loan information, home address, car make/model/vin..... this is clearly a breach of personal information. I am concerned that someone else may have access to my personal details. SST suggested that they cancel my account and have me re-register... but I don't see how that will solve the concern here. I have logged into this account numerous times over the years and NEVER seen someone else 's information.

The sole and only contract I have was signed by me on XX/XX/XXXX. In that agreement my APR is 8.99 %, there is an annual fee of {$300.00} and I was approved for a line of credit for $ XXXX. ( I have a copy of this contract for your review ). I never missed a payment and had outstanding credit at the time I applied. XXXX ceased operations in XX/XX/XXXX and stopped lending altogether. At that tie loan servicing was transferred to Systems & Services Technology ( SST ). They informed me that I now had an interest rate of more than 14 % and my loan had been converted from a line of credit to an installment loan. I began making payments and never questioned it, as I did not realize that SST had completely changed the terms of my agreement.

I was told the person responsible for XXXX filings was out of the office and would return on XX/XX/year>. During this call, I explained that my roof was being replaced and the solar panels would not be reinstalled. XXXX advised that the roofer could dispose of the panels as they saw fit. On XX/XX/year>, I called and spoke with XXXX in the Title Department. She stated my point of contact would be XXXX XXXX, who was in a meeting and would call me back. I again raised the issue of disposing of the panels during roof replacement. XXXX stated she was unsure of the process and asked what XXXX had advised, noting he had more experience. I explained that XXXX stated the panels could be disposed of. Later on XX/XX/XXXX, I spoke with XXXX XXXX in the Title Department.
