I am filing this complaint because Military Star failed to timely stop the allotment being deducted from my military retirement pay, even though my account had already been brought current. My Military Star account has a past due balance of {$0.00} and a minimum payment due of {$0.00}, yet {$320.00} was still withheld from my military retirement pay and applied to my account. The attached documentation shows : * My Military Star account is current with no past due balance. * A payment of {$320.00} was applied to my account. * My DFAS Retiree Account Statement shows a {$320.00} allotment was deducted from my military retirement pay. * DFAS records later show the allotment was changed from {$320.00} to {$0.00}, confirming the allotment was eventually removedbut only after my retirement pay had already been withheld. Military Star had an obligation to timely notify XXXX to stop the allotment once my account became current.

I am disputing the accuracy and completeness of the information that Military Star is furnishing to the consumer reporting agencies regarding my revolving credit account. My credit report reflects this account as closed and reports a paid collection/charge-off history. I respectfully request that Military Star conduct a thorough and reasonable investigation to verify the accuracy of the payment history, account status, dates, and all other information being reported. If any information can not be verified with competent documentation, I request that it be corrected or removed from my credit reports in accordance with the Fair Credit Reporting Act. I have attached a formal dispute letter explaining my concerns and the resolution I am requesting.

I am disputing a debt in the amount of XXXX I first became aware of this debt during the summer of XXXX after collections efforts and a lawsuit were initiated. After learning of the debt I sent a written request disputing the account and request disputing the account and requesting validation. I did not receive the documentation I requested. I am requesting a thorough investigation because I have experienced multiple identity theft related concerns and data security incidents that unknown individuals appeared to be using my residential address. My account has been paid for in Full since XX/XX/year>. The company keeps garnishing my wages and keeps send me refund checks months later. I have called numerous of times and asked them to please send the paid in Full to XXXX. Everytime there seems to be some excuse from the collections department. They have no direct phone number and all they sent me was a email to call XXXX. This was a federal Non Vol allotment meaning I have no control and can not stop on my own. I have called XXXX many times and they have said no one from XXXX star has sent us that your account is paid in full, so we can not remove the allotment. I have all the voice memos to prove what military star has said to me. Additionally, On XX/XX/XXXX, they sent me a Bankrupty letter pertaining to the account. I have never filled for Bankruptcy, When I called to inquire they had no idea what i was reffering to and simply said i should of not received the letter.

I am submitting a complaint concerning the XXXX XXXX XXXXMilitary Star account ending XXXX. My XX/XX/year> statement charged {$100.00} in interest and identified an APR of 21.74 % on a balance subject to interest of {$5700.00}. The arithmetic appears consistent with a 21.74 % APR ; however, Military Star has not adequately explained why this high rate applies to my account or provided evidence that the rate was properly imposed. The statement contains language indicating that payment reversals or returned checks may cause the account to accrue interest at a penalty APR of 21.74 %. I dispute that Military Star has established that a qualifying event occurred, that I received proper notice of the rate, or that the rate continues to be legally and contractually applicable. During the billing cycle, Military Star credited a {$1000.00} payment on XX/XX/year>, and a {$320.00} XXXX payment on XX/XX/year>. The XX/XX/XXXX statement shows a past-due amount of {$0.00}.

This should include the name of the original creditor, the amount owed, a full payment record, and proof that I am responsible for this debt. I am making this request to ensure the information being reported is accurate and not the result of a mistake, fraud, or confusion. While waiting for proper validation, I ask that you pause all collection activity and reporting related to this account, as allowed by law.

I asked if my monthly payment was applied to the highest interest rate balance first before being applied to XXXX percent interest promotional balances. I also asked why the promotional balances do not appear on my statement. The only useful thing that appears on my statement is the date the promotional offer expires, but not the balance remaining of the promotional purchase. The customer service representative I spoke with said that I need to call them to tell them how to apply my payment to the different balances. This info does not appear on my statement. I believe that they are intentionally paying down my interest-free promotional balances before the offers expire so that my retail purchase balance remains and acrues interest. My monthly payment usually ( if not always ) is greater than my monthly regular purchases. The intention is to avoid paying interest by paying in excess of my regular purchases.

I am a XXXX XXXX XXXX veteran. AAFES/Military Star used the Treasury Offset Program ( TOP ) to seize my XXXX federal tax refund for a private-label retail credit card debt without providing the legally required pre-offset notice under 31 U.S.C. 3716 ( c ). In early XXXX, I filed my XXXX federal tax return expecting a refund. When the refund arrived, it was significantly reduced. Upon investigation, I discovered AAFES/Military Star had offset my refund through TOP for an alleged debt on a Military Star card. I received ZERO advance written notice of the debt, the offset, or my right to dispute in direct violation of federal law. I have checked all mail, email, and spam folders. No notice was ever sent. The Military Star card is a private-label retail credit card, not a federal debt that qualifies for TOP. Using TOP for this type of debt may violate the Administrative Procedure Act and due process protections.

On XX/XX/XXXX, {$4500.00} was taken from my federal tax refund through the Treasury Offset Program for this alleged debt. However, AAFES previously responded to a CFPB complaint stating that this account was charged off on XX/XX/XXXX and marked paid in full on XX/XX/XXXX. Despite this paid in full designation, collection activity has continued. When I contacted the collection agency servicing this account, I was informed that multiple Treasury offsets have already been applied over several years, totaling approximately {$15000.00}, in addition to the recent {$4500.00} offset. This indicates that nearly {$20000.00} has been collected on this account, yet no complete accounting has been provided, this far exceeds the original balance. I have requested a full itemized accounting of the debt, including the original balance, all transactions, payments, offsets, fees, and adjustments. Both AAFES and the collection agency have failed to provide this information clearly.

There is not sufficient legal justification for the addition of approximately {$1100.00} in collection charges. Under 15 U.S.C. 1692f ( 1 ), a debt collector may not collect any amount unless it is expressly authorized by the original agreement or permitted by law. I request documentation showing : The original signed agreement authorizing third-party collection fees. A complete itemization of the balance, including all fees added post-charge-off. The contractual or statutory basis permitting XXXX to impose these fees. As the originating creditor, the Army & Air Force Exchange Service retains responsibility for ensuring that any third-party collection activity on its behalf complies with federal law. Referring me to XXXX does not resolve this dispute.
