Back in XXXX I reached out to Ava finance to close two accounts that I had with them. One being a savings account in which I paid {$25.00} a month for 12 months and the other was the monthly subscription. On the website there is nowhere you can go to cancel the services. So I reached out by email. I received email confirmation from the customer service representative that they would close my account. This was in XXXX. 2 months later, I noticed that I had late charges from not paying my monthly fee. I was under the impression that the account was closed based on the email that I received from the customer service representative.

I am submitting this complaint regarding Ava Finance 's refusal to make a goodwill adjustment after a late payment was reported to the credit bureaus. I enrolled my Ava Card in AutoPay because I intended for my payments to be made automatically. According to Ava, my bank connection through XXXX became disconnected, causing the automatic payments to fail. I was unaware that the connection had been disconnected and did not intentionally fail to make my payment. The Ava Card was only being used for a small recurring subscription, and I reasonably relied on AutoPay to process my payments. Once I became aware there was an issue, I immediately paid the outstanding balance in full. The debt has now been paid in full, the account is closed, and Ava has received every dollar that was owed. Although Ava states that reminder emails were sent, I believe the company should have provided clearer and more effective notice that my AutoPay had stopped functioning because of a Plaid disconnection.

I opened a secured credit-builder installment loan with Ava and successfully made payments for approximately XXXX years. My account reflects a strong payment history, with only XXXX final payment remaining before completion of the loan and release of my secured funds. Near the end of the loan term, Ava disconnected the bank account that had been used for payments. Following this disconnection, I was unable to make the final payment through the Ava app. The app displayed messages indicating that my account connection needed to be restored and that payment functionality was unavailable. After discovering the issue, I immediately attempted to resolve it. I re-linked my bank account as instructed by Ava and made multiple attempts to complete the final payment. Despite following their instructions, the app continued to prevent me from making the payment. The account showed a remaining balance but did not provide a working method to bring the account current and complete the loan.

In their previous response ( XX/XX/year> ), Ava Finance claimed that their {$9.00} monthly fee is a voluntary " membership '' subscription and not a finance charge, thereby attempting to bypass the 25 % fee-harvester cap under 12 CFR 1026.52 ( a ). However, new evidence from an automated " past due '' email sent by Ava on XX/XX/year> ( attached ), explicitly contradicts this defense. In the email, Ava threatens that failing to pay the " membership '' fee will result in the loss of the XXXX XXXX XXXX, which they state would " spike your credit utilization up to 185 %. '' This communication proves that the fee is a mandatory condition for maintaining the credit line and its associated reporting benefits. Under Regulation Z, because the fee must be paid to keep the credit line open and active, it is a finance charge.

I am filing a complaint against Ava Finance regarding an unauthorized charge on a closed account. I closed my Ava Finance account in XX/XX/XXXXXXXX and received my remaining balance at that time. The account was fully settled and has also been reported as closed on my credit report. Despite this, Ava Finance processed a charge of {$57.00} on XX/XX/XXXX. There has been no account activity, no usage, and the card associated with the account is not activated. This charge appears to be an automatic renewal of a subscription that should have been canceled when the account was closed. I contacted Ava Finance to request a refund. However, they have refused to process the refund unless I provide excessive identity verification, including a photo of my drivers license and a selfie holding my ID. I am not requesting access to the account or any sensitive changesonly a refund of an unauthorized charge.

Federal Fee Cap Violation : Ava reports this account to credit bureaus as a 'Credit Card ' with a {$270.00} limit. Under federal law, total non-penalty fees in the first year can not exceed {$67.00} ( 25 % of {$270.00} ). The Math : Ava reports a credit limit of {$270.00} to the bureaus but charges a mandatory monthly fee of {$9.00}. This totals {$110.00} per yearwhich is 43 % of the credit limit. This far exceeds the federal 25 % cap ( {$67.00} ) for first-year accounts. The company 's attempt to rebrand this as a 'membership ' is a deceptive workaround, as the fee is required to maintain the credit line. 2.

I am submitting this complaint regarding Ava Finance , Inc. and the reporting of a late payment to the credit bureaus. I enrolled in Avas credit-building service and made efforts to maintain my account in good standing. When attempting to make a payment through their app, I experienced repeated technical issues. The app would not properly process or accept my payment, despite multiple attempts over a period of time. I continued trying to resolve the issue and complete the payment through their platform. Despite my repeated efforts to make a timely payment, Ava ultimately reported my account as 30 days late to the credit bureaus. I was not able to successfully complete the payment due to what appeared to be a malfunction or failure within their app, not a refusal or neglect to pay. Once I realized the payment had not gone through and had been reported, I immediately paid the balance and brought the account current.

I do not have their application installed on my device and have not authorized recurring transactions. These withdrawals violate the Electronic Fund Transfer Act ( 15 U.S.C. 1693e ) and Regulation E ( 12 CFR Part 1005 ). Under federal law, authorization for preauthorized electronic fund transfers must be revocable, and I have revoked authorization.
