To whom it may concern, My name is XXXX XXXX. I am a war veteran who currently lives in XXXX Illinois. My wife and I bought our home in XXXX. Our current mortgage company is BSI Financial. Being a veteran, I am exempt from paying property taxes in the state of Illinois. Each year, I fill out the homestead exemption form and submit it to XXXX. Last year, I was a little late in submitting it. The form is due by XX/XX/XXXX, and I submitted it XX/XX/XXXX. We noticed in XXXX of XXXX, we were being charged property taxes again. We reached out to BSI, and they informed us that the city had not done their part by updating our status to exempt. We reached out to the city, and they stated they had in fact done so. The city of XXXX tax office stated they had notified BSI several times of our exemption, but BSI would not acknowledge this. In the meantime, due to BSI charging us property taxes, it caused our monthly payment to pretty much double.

I refinanced my mortgage and my loan with BSI Financial Services has been paid off and closed. At the time of payoff, my escrow account had approximately {$5800.00} that was owed back to me. BSI Financial Services performed an escrow analysis in XXXX and stated they mailed a refund check. I never received that check. After waiting XXXX weeks, I called and was told they could cancel and reissue it. A second check was supposedly mailed, which I also never received. They later stated they performed another analysis and voided the prior check and issued another, which again was never received. Most recently, I was told a new check was mailed approximately XXXX weeks ago, which I have still not received. I was told I must wait additional time before they will cancel and reissue it again. Alternatively, they offered to wire my funds but only if I pay a {$30.00} fee, despite the delays and failures being on their end.

We have experienced ongoing and significant issues with BSI Financial throughout this short sale process. The short sale process began with BSI Financial on XX/XX/year>. The file was deemed complete on XX/XX/year>, and since that time, we have been waiting for BSI to order the required appraisal for this XXXX short sale. We were originally advised that we would be contacted regarding the appraisal within XXXX business days. However, weeks have now passed with no appraisal ordered and no meaningful updates despite multiple follow-up calls and escalations. There was already a foreclosure sale date scheduled during the review process. BSI did postpone that sale date, but we have been advised that another foreclosure date may be scheduled if the file does not continue moving forward. The delays and lack of action by BSI are placing the borrower at continued risk of foreclosure. We have also repeatedly received inaccurate and conflicting information from BSI representatives.

The servicer ( BSI Financial XXXX ) has acknowledged satisfaction but has failed to perform its legal obligation to release the lien. Instead, it has issued multiple incomplete releases that omit properties and contain incorrect or partial legal descriptions. As a result, the lien remains open of record across multiple parcels. This has directly delayed transactions, including a pending sale and refinance involving multiple properties totaling hundreds of thousands of dollars. The delays have caused increased interest costs, lost opportunity to deploy capital, and disruption of ongoing real estate operations.

Unallocated XXXX Payment : On XX/XX/XXXX, I made a full monthly payment of {$3200.00} via ACH from XXXX XXXX XXXX XXXX ( Proof of payment attached ). However, BSIs own transaction ledger dated XX/XX/XXXX shows that for the XX/XX/XXXX " XXXX '' entry, only {$2300.00} was applied to the account ( {$2100.00} interest and {$270.00} principal ). This leaves an unexplained discrepancy of {$830.00} from that single transaction that was never credited to my principal balance or returned to me. 2. Failure to Refund Principal Overpayment : The loan was paid in full via wire on XX/XX/XXXX. The ledger shows that BSI moved {$320000.00} into an " Unapplied '' status on that date.

These payments were made on time and cleared my account. BSI recently informed me that they performed an internal account adjustment to remove a prepayment penalty. In doing so, they reversed previously posted payments and reapplied them. This internal accounting action caused their system to generate late notices and report my account as delinquent to the credit bureaus. As a result, my credit score has dropped approximately XXXX points and I received a notice from XXXX indicating negative reporting. I have never missed a payment. Any delinquency status was caused solely by BSIs internal adjustment process.

I have XXXX tracking confirming delivery, and BSI later confirmed by email that the check was received. BSI later informed me that the payoff check had been routed to the wrong department internally. Because the payment was not processed in time, an automatic debit of {$4600.00} was executed from my account on XX/XX/XXXX. On that same day, XX/XX/XXXX, a three-way call took place between myself, BSI, and the buyers title company. The issue was corrected immediately, the buyers tittle company was charged and the account showed paid in full on the BSI portal that same day. I requested an immediate reversal of the {$4600.00} draft. Despite the account being acknowledged as paid on XX/XX/XXXX, BSI retained my {$4600.00} for XXXX additional days, issuing the refund only on XX/XX/XXXX. BSI stated that this delay was due to internal procedure.

My mortgage company " XXXX '' uses a loan servicing company called " BSI Financial Services '' that purposely uses inaccurate information on their loan servicing portal so that you miss your payment and have to pay a large 10 % of the mortgage fee. Here is their website- XXXX XXXX XXXXXXXX They purposely show that a payment of {$0.00} is due all the way up until exactly the 1st of the month. Then list the amount owed on the 1st of the month and charge you a late fee if it's not submitted by the 5th or often the 3rd of the month if the 5th falls on a weekend. Many times, even when I check how much my payment is on the 1st it will say {$0.00} and not allow me to make a payment. I have had to submit my monthly payment as a " principal '' payment to force my payment into the system. They do this because they want you to miss your payment. Even when I'm enrolled in auto-pay the portal does not accurately show that I have a payment scheduled within the deadline.

Per 12 CFR 1024.41, BSI was required to acknowledge receipt of this package within XXXX business days and provide a status update. BSI has failed to do so. We have attempted to contact the Default Resolution Team by phone multiple times, but we are repeatedly placed on hold for extended periods and then disconnected. We ( my wife and I ) are unable to reach a Single Point of Contact. The point of contact we were provided, XXXX XXXX, does not have a direct line, and the number provided is to the call center.
