I am filing a follow-up complaint against Consumer Portfolio Services , Inc. ( CPS ) regarding Account No. XXXX. I previously filed CFPB Complaint No. XXXX on XX/XX/XXXX, about this same account. CPS closed that complaint with a form response and the underlying violations never stopped. CPS is subject to a Stipulated Order for Permanent Injunction entered in United States v. Consumer Portfolio Services , Inc., Case No. XXXX ( C.D. XXXX. XXXX ), which permanently prohibits it from communicating after written cease and desist requests, using deceptive collection practices, and furnishing inaccurate information to credit bureaus. In XX/XX/XXXX, I sent CPS written cease and desist notices. CPS 's own customer portal logged three active cease and desist requests on XX/XX/XXXX, and XXXX, XXXX ( attachment included ). CPS confirmed them in writing on XX/XX/XXXX and XX/XX/XXXX.…

Company Name : Consumer Portfolio Services , Inc . Product : Auto loan or lease -> Vehicle loan Description of Incident : I have a perfect, never-late payment history on my auto loan with Consumer Portfolio Services ( CPS ) .I am at the end of the life of the loan as i only have {$1700.00} left to pay. I successfully made my regular monthly payment of {$590.00} for XX/XX/XXXX. However, I checked my account today XX/XX/year> and CPS has suddenly altered my online dashboard to show a " past due '' balance of {$1100.00} due immediately on XX/XX/XXXX. This {$1100.00} is not a missed payment ; it is the accumulated interest from historical, approved deferred payments used over the life of the loan. CPS is front-loading this deferred interest and classifying it as an immediate delinquency to force a lump-sum payment. This violates the spirit of the approved deferments.…

I am a documented Federal Identity Theft Victim, FTC Affidavit # XXXX, Upon my mother 's death, for which I was her XXXX XXXX I instantly lost my sole source of income. XXXX days after my mother 's death a Consumer Portfolio agent began aggressive daily collection calls. I did not deny that I was behind on my payment, after explaining my sudden loss of income and my decision to take equity out of my home to bridge me until I found sustainable employment, with the intention of paying of my car loan in full, was when I discovered my homes title was encumbered and I was unable to to access equity from my home. I explained to her that this had sent me instantly into a financial crisis when I discovered that my homes title had been encumbered by the very same people who sold me my home, due to Federal Identity Theft and Title Fraud. Consumer Financial Protection Bureau Complaint Company : Consumer Portfolio Services , Inc. ( CPS ) Product : Vehicle Loan I am filing this complaint because Consumer Portfolio Services , Inc. ( " CPS '' ) has failed to accurately account for my vehicle loan, has continued collection and repossession activity without providing a complete accounting of my payments, and is furnishing credit information that I believe is inaccurate. My vehicle loan originated in XX/XX/XXXX. I made regular payments on the account and continued making payments throughout late XXXX and XXXX. In XX/XX/XXXX alone, I made three payments totaling {$1500.00}, all of which CPS accepted and posted to my account. CPS later informed me that my account had been charged off in XX/XX/XXXX. I was never notified that my account had been charged off. I only learned of the charge-off later while attempting to resolve my account directly with the company.…
On XX/XX/XXXX, this company did a credit inquiry with XXXX. They did not have my permission to run any type of inquiry. They previously tried to collect on debts that were included in a bankruptcy discharged in XX/XX/XXXX.
I received a phone call from Consumer Portfolio Services this morning and a woman named XXXX was speaking. I asked her to identify the company she was calling on behalf of and she vaguely said " a finance company '', which obfuscated her reason for calling. She asked me to provide information on my mother-in-law, who is estranged. My wife has not spoken or seen her mother in more than a decade, and I have never met or spoken with the mother. We do know that her mother has some kind of debt, but we only know this because my wife gets repeated calls from debt collectors attempting to contact her mother. Despite my wife repeating each time to stop contact, these companies continue. Now they reach out to me for the first time, and the only way they'd call me for my MIL is because they know my wife is married to me. This indicates ongoing intent to harass family members despite repeated requests to stop contact, and they are expanding their contact pool to spouses.…

Cars was totalled out and the remaining balance is left on me .anytime I try to apply for something I am getting denied.
I am writing to formally dispute the accuracy of the account you are reporting on my credit file. The information reported is incorrect because I did not complete the purchase of the vehicle, and no valid sale or loan should have been established in my name. I went in to begin the process, but I decided not to proceed with getting the car. Because I never bought the vehicle, it does not make sense that this account is being reported as a negative item on my credit report or that the loan was paid off on my behalf. This reporting is inaccurate and misleading. I request that you immediately investigate this account and remove or correct all inaccurate information related to this matter. Please also update any credit reporting agencies to which you furnished this information. Please provide me with written confirmation of your investigation results and the correction or deletion of this account. Hide full

* Attention CFPB /FTC investigator * This is not a duplicate complaint as the lender states it is. They using administrative bypass of duplicated complaint to avoid answering the complaint. This Indirect lender has violated TILA while being non compliant with FTC monitoring and required assessment reporting. Consumer Portfolio Services Inc. This debt collector has engaged in conduct that violates the Fair Debt Collection Practices Act ( FDCPA ). They are reporting an account that I did not authorize, and no signed agreement exists bearing my signature to validate any obligation. A legally binding contract requires clear consent from all parties, which is absent in this case. Additionally, the collector has failed to provide proper validation of the alleged debt as required under the FDCPA. Without sufficient documentation verifying the debts legitimacy, their continued reporting and collection efforts are unlawful. These actions constitute violations of my consumer rights. As a result, I demand the immediate deletion of this account from all reporting agencies. Failure to comply may result in further legal action, including claims for damages.
This finance company finances a vehicle that does not work will not power on and I need to be released from the contract since the contract is only two weeks old and the vehicle has not worked within the two weeks
On or about XX/XX/XXXX. I purchased a XXXX XXXX XXXX and entered into a financing agreement through the dealership and lender. The vehicle purchase price and financing terms resulted in a loan with a high interest rate, which significantly increased the total amount I am required to repay. After reviewing my loan documents and researching the vehicles market value, I became concerned that the vehicle may have been sold for substantially more than its actual value. As a result, I believe I am paying for a vehicle that was overpriced at the time of purchase while also being charged a high interest rate on the financed amount. Since the purchase, I have made payments as required under the loan agreement. However, the combination of the vehicles inflated price and the high interest rate has created a financial burden and has caused me to pay considerably more than I believe is reasonable for the vehicle.…
I am filing this complaint against Consumer Portfolio Services regarding my high-interest auto loan, Account # XXXX, because I believe the loan terms, servicing practices, and lack of meaningful refinance, modification, or hardship assistance are unfair, unaffordable, and potentially predatory. My XXXX account shows a contract date of XX/XX/XXXX, an amount financed of {$14000.00}, an APR of 24.90 %, and a monthly payment of {$430.00}. As of XX/XX/XXXX, the principal balance is still listed as {$14000.00}. This means the principal balance has only decreased by approximately {$200.00} from the original amount financed, despite the loan being open since XX/XX/XXXX. The account also shows a past due amount of {$870.00}, fees of {$43.00}, and an amount due of {$1300.00} by XX/XX/XXXX.…

I was informed by the dealership that the title to the vehicle was in their possession and had been sent to the lender, Consumer Portfolio Services Inc.
